HomeMy WebLinkAbout20073654 RESOLUTION RE: ACTION OF THE BOARD CONCERNING PERMITS FOR TEMPORARY ASSEMBLY TO RICK FISHER - MARCH 29 AND 30, AND SEPTEMBER 20 AND 21, 2008 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rick Fisher, 1942 27th Avenue, Greeley, Colorado 80634, has presented to the Board of County Commissioners an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held from 6:00 a.m., until 7:00 p.m., on March 29 and 30, 2008; and from 6:00 a.m., until 7:00 p.m., on September 20 and 21, 2008, on property described as follows: 20749 Highway392, Greeley, Colorado 80632; being further described as Lot B of Recorded Exemption #3779; being part of the SE1/4 of Section 16, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid Weld County the sum of TWO-HUNDRED DOLLARS ($200.00) for said Weld County Permits for Temporary Assembly, and WHEREAS,having examined said application,the Board deems it appropriate to deny Weld County Permits for Temporary Assembly to Rick Fisher, due to the proposed events being scheduled for two different times of the years and various other concerns, and the Board has recommended that Mr. Fisher work with the Department of Planning Services staff to obtain the appropriate permit for Mr. Fisher to conduct the events with, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said Weld County Permits for Temporary Assembly on March 29 and 30, and September 20 and 21, 2008, be, and hereby are, denied to Rick Fisher, to conduct a temporary assemblage at the hereinabove described location. 2007-3654 LC0022 (1() `. The following are the recommendations made by this Department: 1) Temporary hand washing stations should be located outside the portable toilets. We recommend that there be one hand washing station for every two portable toilets. 2) Ensure that the temporary hand washing stations have soap and drying devices (hand sanitizer should be used in conjunction with, not in replacement of soap and drying devices). 3) Item number 7 discussed where water could be obtained, but not how it will be made available to staff and customers. I was asked by the Board of County Commissioners to make a report concerning this application. After researching this matter I would like to submit the following list of concerns: • No plans have been provided as to how entrance and exit from this event will be handled. As far as I can tell there is only one entrance/exit to the event property. This entrance/exit is located off of Hwy 392. This entrance/exit is a dirt lane located just west of WCR 43. Both Hwy 392 and WCR 43 are heavily traveled roads. This lane isn't wide enough to handle 2 way traffic. Because there is very little shoulder on Hwy 392, spectators waiting to enter would have to come to a complete stop and wait on the road until they can enter onto the property. I believe this will create a traffic hazard. • I believe that it will be very easy for spectators to bring alcoholic beverages onto this property. There is also expected to be a large number of people gathered for this event. I am afraid that these 2 factors create the possibility of people drinking and driving when they leave the event. How will this be monitored? • During the time when the event is scheduled to take place the Sheriffs Office only has 1 deputy scheduled on duty in that area. I fear that this event will increase the call load for this deputy and create a potentially unsafe situation for the citizens of this portion of the county. • The owner states he will act as security for this event. I don't believe this is adequate for an event that will have up to 1500 people. Does the applicant have the training necessary to act as security for an event such as this? • In the application it states that the event organizer has no plans for lighting or electricity. However applicant will provide overnight camping for spectators. I believe this also creates an unsafe condition. The security personnel will have a difficult time monitoring the crowd in the low light conditions. • Have the neighbors been contacted and informed of these events? How will this affect their quality of life and rights as property owners? Because of the above listed concerns I cannot give my support to this application. Maximum number of tickets: No tickets are being sold 6. Plan to limit the number of people: They have no plan to limit the number of people. The 1500 is based on similar activities and includes spectators and participants. They have 70 acres with 40 acres for parking. Health Department and Planning should consider facility. ***THIS DOES NOT COMPLY WITH CODE REQUIREMENTS TO HAVE A PLAN IN PLACE.*** 7. Adequate supply of potable drinking water: They say they have 4 hydrants. This does not address the potable (drinkable) water issue. They must provide at least 3 gallons of water per person per day per the Code. The medical facility must have running water and a lavatory. ***THIS DOES NOT COMPLY WITH THE CODE REQUIREMENTS.*** 8 . Disposal of solid waste: They say there will be trash barrels and dumpsters and that all trash will be disposed of by North Colorado Disposal the day after the event. They need to determine how many barrels and dumpsters will be placed on the property. There is no plan as to how they will monitor full barrels - how often they will be checked etc. As they plan to have guests overnight, the number of barrels and dumpsters really need to be considered. 9. There will be one unit per 10 people per ten hours of use. The facilities will be provided by Gallegos Sanitation. The units will be placed throughout the parking area. 10. Plans to provide medical facilities: The Code requires people on site. The applicant states that Stadium Medical of 5363 Parfet (SP?) Street, Arvada, Colorado 80002, will be on site from 6:00 a.m. until 7:00 p.m. Ambulance service will be provided by Stadium Medical, as well. If there are to be overnight guests, medical personnel will have to remain on site through the night. They are required to have 2 medical personnel for the first 350 persons and one for each additional 350 guests; therefore, they must have at least 5 medical personnel on site. They must also provide proof of insurance for the Company providing the medical services. ***NEED PROOF OF THE NUMBER OF MEDICAL PERSONNEL ON SITE AND DURING THE NIGHT*** 11. Nighttime Illumination: They say NA. However, if they have overnight guests, they must provide illumination at the rate of at least five (5) foot candles. ***NEED TO CHECK.*** 12. Plans for parking: They say they have 40 acres for parking. That should be sufficient for 375 vehicles. Access is from Highway 392. There are no plans with regard to the direction of traffic. ***NEED PLAN FOR PARKIG/TRAFFIC CONTROL*** 13. Plans to communicate with emergence personnel: The applicant will contact emergency police and fire personnel services by cell phone or landline. The medical provider will communicate with a hospital if needed. 14. Identify camping facilities: There is no indication that the camping area complies with any state or local requirements for people who stay overnight. ***NEED PROOF OF COMPLIANCE WITH STATE AND LOrAT RULES.*** 15. Plans for fire protection: There is one 1700 gallon water truck, one 500 gallon water truck and one 350 gallon water truck. The Windsor Fire Protection District should be contacted to determine if this is sufficient. ***THE CODE REQUIRES THAT OFF-SITE FIRE PROTECTION SERVICES MUST BE ARRANGED.*** 16. Plans for security: The applicant states that security will be provided by the property owner. ***I DO NOT BELIEVE THIS MEETS THE CODE REQUIREMENT FOR SECURITY, WHICH CALS FOR AT LEAST 2 SECURITY PERSONS FOR EVERY 350 PEOPLE, AND THOSE SECURITY FOLKS MUST BE LICENSED PRIVATE GUARDS OR OFF-DUTY PEACE OFFICERS.*** 17. Sound Control and Sound Amplification: There will be a temporary sound system, described as a 5-7 pole style speaker. The system will be established throughout the parking area. 18. Plans to meet County Health standards for food concessions and concessionaires: The applicant states that this will be determined at a later date, and that whatever they decide will comply with county health standards. ***THIS IS NOT SUFFICIENT FOR THE APPLICATION, AS THIS MUST BE SET FORTH IN THE APPLICATION.*** 19. Plans for Electrical Systems: The applicant says this is NA. However, as they must provide light and a sound system which is powered by electricity, some provision must be made. ***NEED TO MAKE PROVISION FOR POWER.*** 20. Plans for Dust Control: Part of the dust control will be met with the use of the water trucks. - NEED TO BE CERTAIN THIS DOES NOT IMPACT THE EFFICIENCY OF THE WATER TRUCKS AS A SOURCE OF WATER IN THE EVENT OF FIRE. The other element of dust control will be through the use of magnesium chloride on the roadways. 21. Bonding Company Statement: They have a commitment for a bond for $2500 from Flood Peterson for Sand Creek Sports Park, LLC. It will be written by Travelers Casualty and Surety. Flood and Peterson need to be notified that the bond is required, and then proof of the bond will be required. ***WHO IS SAND CREEK SPORTS PARK, LLC?*** 22. Insurance Company Statement: The applicant provided proof that the American Motorcycle Association, inc. has $1,000,000 in insurance coverage. However, medical expenses are excluded. The local additional insured is Fisher Productions - NOT RICK AND TAMMI FISHER OR SAND CREEK SPORTS PARK, LLC, AND THE EVENT DATE IS 3-30-06. ***NEED CURRENT INSURANCE AND SOME DOCUMENTATION THAT THE APPLICANT IS THE INSURED.*** 23 .
