RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
I-INDUSTRIAL DISTRICT FOR STEVE AND CAROLINE BRANCUCCI,
8120 EAST 104TH AVENUE, HENDERSON, COLORADO 80640
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
O Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 21st day of
January, 1981 at 2 : 00 o 'clock p.m. for the purpose of hearing
the petition of Steve and Caroline Brancucci , 8120 East 40th
Avenue, Henderson, Colorado 80640 , requesting a change of
zone from A-Agricultural District to I-Industrial District
` for the following described parcel of land, to-wit;
A parcel of land located in the South-
-east Quarter of Section 30 , Township 1
North, Range 66 West of the 6th P.M. ,
Weld County, Colorado being more parti-
cularly described as follows :

WHEREAS, Section 81 of the Weld County Zoning Resolution
-authorizes the -Board of County Commissioners to grant a change
of zone upon the showing by the petitioner of certain facts , and
WHEREAS, the Board of County Commissioner€ heard all of
the testimony and statements of those present, has studied
the request of the petitioner and the recommendations of the

Weld County Planning Commission, and having been fully informed,
finds that changing conditions in the area justify said change
of zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of _Steve
and Caroline -Brancucci for a change of -zone from 7.-Agricultural
District to I-Industrial District on the above described tract
of land be, and hereby is, _granted.
BE LT - FURTHER -RE-SOLVED _by the -Board of County Commissioners
that the masons for approval contained in the -Planning Commis-
sion recommendations dated December 2, 19=80 he, and hereby are,
adopted as the findings of fact of the -Board of County Commis-
sioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 21st day of

The following business was transacted:
I hereby certify that pursuant to . noticesdated December 15 , 1980 and
duly published December 18 , 1980 and January 3 , 1981 in the Johnstown
Brerive a public hearing was held on -the following requests of STEVE
AND CAROLINE BRANCUCCI : DOC 81-4 , COZ , A to I (2 . 324 acres) ; DOC 81-5,
COZ , A to I (4 acres) ; SE u126 (2. 324 acres) ; RE X470 (4 acres) .
Chairman C. Carlson stated that he was on the Planning Commission when
this issue was presented to them for their recommendation therefor he
will abstain from voting on the two COZ issues.
Mr. Honn read the Planning Commission' s favorable recommendations on
both COZ ' s.
The applicant was present with his le-gal counsel, Melvin Dinner.
Mr. Dinner elaborated at length on the applicants plans for each parcel
of land and for each requested action.
No one was present in opposition to the COZ requests.
Commissioner Steinmark made a motion to approve the COZ , A to I , on the
2 . 324 acre parcel described in DOC 81-4 . Commissioner Kirby seconded the
motion and it carried. The Chairman abstained from voting.
Commissioner Kirby made a motion to approve the COZ , A to I , on the
4 acre parcel described in DOC 81-5 . Commissioner Martin seconded the
motion and it carried. The Chairman abstained from voting.
Mr. Honn reviewed RE "470 . This request is to split the property into
23. 149 acres and 4 . 0 acres. The Planning staff rerommended this request
be approved. Commissioner Martin made a motion to approve RE ';`470.
Commissioner N. Carlson -seconded the motion and it carried unanimously.
Mr. Honn reviewed SE .',126 and the Planning staff ' s favorable recommendation.
This request is to seperate 2.324 acres from the 36.39 acres for rental purposes only.
Commissioner N. Carlson made a motion to approve SE 1127. Commissioner
Kirby seconded the motion and it carried unanimously.

request the Board of County Commissioners of Weld County, Colorado, to
hereby grant the Change of Zone Application filed by Steve Brancucci and
Caroline M. Brancucci on that certain 2.324 acre parcel located in the

Moved by Fred Otis that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Pla-nning Commission that the appli-
cation for rezoning from "A" ( Agricultural Zone District) to
"I" ( Industrial Zone District) covering the following described
property in Weld Count, Colorado, to-wit:

for the following reasons:
1. The applicant has complied with Section 81.7 et. seq. of the Weld County Zoning
Resolution regarding the application requirements for a Change of zone.
2. It is the opinion of the Planning Commission'that the p=osed
request is consistent with the Weld County Comprehensive Plan. Said plan states:
"In order to minimize conflicting land uses and minimize the cost of new
facilities and services to the taxpayer, industrial, commercial, business
and residential development will be encouraged to locate adjacent to the
existing 27 incorporated towns and in accordance with the Comprehensive
plans and stated wishes of each community."
The property is located across Weld County Road 4 from a designated industrial
area of the Brighton Comprehensive Plan. The City of Brighton Planning
Commission has approved this request for a change of zone.
3. It is the opinion of the Planning Commission that this request will be compatible
with the surrounding land uses, will have adequate water and sewer service to
serve the permitted uses within the proposed zone district, and will have adequate

Dear Ms. Traxler:
The Brighton Planning Commission reviewed two referral§
concerning rezoning applications from Steve and Caroline
Brancucci. A concern was voiced in regard to the type of
development that has been occurring between Brighton and
Fort Lupton. It was felt that each case must be reviewed
carefully to insure compatable development in this area.
It was also felt that it would be extremely difficult to
prohibit the conversion from agricultural to industrial uses
along this corridor.
The Brighton Comprehensive Plan calls for low intensity
agricultural use for the area immediately surrounding our
projected municipal boundaries. In addition, the plan con-
tains a policy that discourages strip development between
Brighton and Fort Lupton.
After considerable discussion, the Brighton Planning
Commission voted (4 to 3) to recommend approval in both cases.

November 25, 1980, I represent Mr. and Mrs. Steve Brancucci who reside
at 8120 East 104th Avenue, Henderson, Colorado 80640, in connection with
F--\ the change of zone applications filed by Mr. and Mrs. Brancucci with the

J acres in size and another 2.324 acres in size, both of which are located
in North Weld County near the City of Brighton.
Lf cOZ 343:80:13 covers a tract of 2.324 acres, which tract of land is
adjacent to a much larger tract of land owned by Mr. and Mrs. Brancucci
which is utilized for agricultural purposes. The property is presently
zoned A-Agricultural. Currently located on the 2.324 acre tract is a
warehouse unit which has existed on the premises for some period of time
and which has heretofore been utilized by the Brancucci family in connection
with their agricultural activities and operations. A domestic well is
presently located on the Brancucci farm and the pipeline from this
domestic well which is at least 50 to 60 years old, provides domestic
-water into the warehouse unit for drinking and sanitary facilities. As
outlined during the course of our telephone conference, if the change of
zone application is granted, it is the intention _of Mr. and Mrs. Brancucci
to lease out the warehouse unit and related 2.324 acre tract to oil and
gas supply firms desiring warehousing space in the area as a part of the
-on-going oil and gas operations now taking place generally in that area
of the county. As previously indicated, domestic water is now piped
into the warehouse unit and has been for some period of time and provides
domestic water mervice for both drinking and sanitary facilities. It is
not intended that the water through the existing pipeline be used for
industrial purposes but as a domestic source of supply by the people

Mr. and Mrs. Brancucci, the applicants for recorded exemption, presently
reside at 8120 East 104th Avenue, Henderson, Colorado 80640. Mr. and
Mrs. Brancucci own approximately 98 acres of land located in Weld
County, Colorado, which acreage is contained in three separate parcels,
one containing approximately 28 acres, a second containing approximately
40 acres, and a third containing approximately 30 acres. Parcels one
and two, as you will note from examination of the vicinity and the land
use map, are adjacent to each other and are located in the SE' of Section
30, Township 1 North, Range 66 West of the 6th P.M. Parcel three,
containing approximtely 30 acres, is located on Weld County Road 6 and
is approximately three miles away from the other two parcels.
As you are fully aware, the area immediately surrounding the proposed
area for recorded exemption has drastically changed in character over
the past 10 years from a predominantly agricultural area to what now
appears to be a predominantly industrial service and supply area with
numerous oil and gas industrial establishments located in the adjacent
and general area. A. map demonstrating numerous industrial outlets in
the immediate area is attached to this letter of explanation.
It is my understanding that the City of Brighton and the Adams County
Comprehensive Master Plan now includes that portion of Weld County lying
South of Weld County Road 4 immediately adjacent to the proposed recorded
exemption and that the Comprehensive Master Plan includes the adjacent
area to the South as proposed industrial activity. As you are fully
aware from existing business enterprises now located in the area, numerous
concrete, batch plants, gravel quarries, melding and machine shops and
oil and gas service and supply firms are now located within the area,
some of them immediately adjacent to the proposed area of recorded
exemption
Based upon the business activity which has occurred in the recent -past and
which is now occurring, being oil and gas development and the increasing
demand for industrial warehouses and industrial services to be provided
in the area there is a changing character o₹ business activity from A—
Agricultural to I-Industrial. In numerous instances firms have contacted
the applicants and requested the ability to purchase a tract of 4 acres
for the construction of buildings to be used in connection with industrial
activities. As a matter of fact, the applicants have indicated to me
that because of the failure to have their property presently rezoned and
capable of being sold as a separate parcel they have been unable to
proceed forward with a sale to prospective purchasers.

At the request of Mr. Melvin Dinner of Dinner and Hellerich,
Attorney at Law, I have investigated the gravel potential on two
parcels of land proposed for rezoning from Agricultural A to I-
Industrial. The two tracks are located in the SE/4 sec. 30,
T1N, R66W and lie on gravel deposits shown as T3 on our gravel
resources map of the Fort Lupton quadrangle.
Although gravel has been mined elsewhere on this same deposit, the
material is probably too fine grained to be considered an important
resource. The actual sizes of these parcels are more limiting
-factors. Certainly the smaller tract, 2.3 acres, obviously is
not workable. The larger tract, 4 acres, apparently is divided
by Colorado 85 and the UP rights-of-way and, therefore, would not
constitute a conveniently workable site.

Dear Mr. Dinner,
Attached is the soils map and soils description you requested. Please
note that the major limiting factor for building sites is the shrink -
swell -potential of the subsoil as it wets and dries. Special care will
need to be taken in the design of any septic system due to the rapid
permeability of the sand and gravel substratums.
Please be advised that this soils information is general in nature. An
on-site investigation should be conducted before any construction takes
place.

Dear Ms. Traxler:
We have reviewed the above referenced zone change requests.
The first request (COZ 343:80:13) contains no mention of water use or
availability and, therefore, we cannot recommend approval. The second
request (COZ 343:80:14) is to utilize a permitted well (registration no.
116824). This well has as conditions of approval that it will be used for
drinking and sanitary facilities only in an individual commercial business
and use will not exceed 300 gallons per day. If the proposed use is
within these limitations, we would have no objection to approval of this
plan.
