Mr. Honn read the Planning Commission' s favorable recommendations on both COZ ' s. The applicant was present with his le-gal counsel, Melvin Dinner. Mr. Dinner elaborated at length on the applicants plans for each parcel of land and for each requested action. No one was present in opposition to the COZ requests. Commissioner Steinmark made a motion to approve the COZ , A to I , on the 2 . 324 acre parcel described in DOC 81-4 . Commissioner Kirby seconded the motion and it carried. The Chairman abstained from voting. Commissioner Kirby made a motion to approve the COZ , A to I , on the 4 acre parcel described in DOC 81-5 . Commissioner Martin seconded the motion and it carried. The Chairman abstained from voting. Mr. Honn reviewed RE "470 . This request is to split the property into 23. 149 acres and 4 . 0 acres. The Planning staff rerommended this request be approved. A concern was voiced in regard to the type of development that has been occurring between Brighton and Fort Lupton. It was felt that each case must be reviewed carefully to insure compatable development in this area. It was also felt that it would be extremely difficult to prohibit the conversion from agricultural to industrial uses along this corridor. The Brighton Comprehensive Plan calls for low intensity agricultural use for the area immediately surrounding our projected municipal boundaries. In addition, the plan con- tains a policy that discourages strip development between Brighton and Fort Lupton. After considerable discussion, the Brighton Planning Commission voted (4 to 3) to recommend approval in both cases. Thank you for including us in your review process. Currently located on the 2.324 acre tract is a warehouse unit which has existed on the premises for some period of time and which has heretofore been utilized by the Brancucci family in connection with their agricultural activities and operations. A domestic well is presently located on the Brancucci farm and the pipeline from this domestic well which is at least 50 to 60 years old, provides domestic -water into the warehouse unit for drinking and sanitary facilities. As outlined during the course of our telephone conference, if the change of zone application is granted, it is the intention _of Mr. and Mrs. Brancucci to lease out the warehouse unit and related 2.324 acre tract to oil and gas supply firms desiring warehousing space in the area as a part of the -on-going oil and gas operations now taking place generally in that area of the county. As previously indicated, domestic water is now piped into the warehouse unit and has been for some period of time and provides domestic water mervice for both drinking and sanitary facilities. As you are fully aware from existing business enterprises now located in the area, numerous concrete, batch plants, gravel quarries, melding and machine shops and oil and gas service and supply firms are now located within the area, some of them immediately adjacent to the proposed area of recorded exemption Based upon the business activity which has occurred in the recent -past and which is now occurring, being oil and gas development and the increasing demand for industrial warehouses and industrial services to be provided in the area there is a changing character o₹ business activity from A— Agricultural to I-Industrial. In numerous instances firms have contacted the applicants and requested the ability to purchase a tract of 4 acres for the construction of buildings to be used in connection with industrial activities. As a matter of fact, the applicants have indicated to me that because of the failure to have their property presently rezoned and capable of being sold as a separate parcel they have been unable to proceed forward with a sale to prospective purchasers. The first request (COZ 343:80:13) contains no mention of water use or availability and, therefore, we cannot recommend approval. The second request (COZ 343:80:14) is to utilize a permitted well (registration no. 116824). This well has as conditions of approval that it will be used for drinking and sanitary facilities only in an individual commercial business and use will not exceed 300 gallons per day.
