RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#841 - JZM, LLC, C/O
JOHN ZADEL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 31, 1988, the Board approved Use by Special
Review Permit#841 for a Recreational Facility(hot air balloon launch area) in the A (Agricultural)
Zone District for Suckla Farms on the following described real estate, to-wit:
Part of the NW1/4 of the SW1/4 of Section 10,
Township 1 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,the Board has received a request from the current property owner, JZM, LLC,
c/o John Zadel, 4200 Weld County Road 19, Fort Lupton, Colorado 80621, to vacate said Use by
Special Review Permit#841, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#841 be, and hereby is, vacated.

SUBJECT: Vacation of USR-841
The Department of Planning Services has received the attached letter dated July 28, 2006 from
John Zadel President of JZM, LLC. Mr. Zadel is requesting that USR-841 for a recreational
facility (hot air balloon launch area) be vacated. This vacation is a requirement for a Planned
Unit Development (PUD) Final Plat application for Distant Thunder PF-600.
Background information:
Legal Description: Part of NW4 SW4 of Section 10, T1N, R67W of the 6th P.M., Weld
County, CO.
Location: East of and adjacent to County Road 19 and approximately '/4 mile north
of County Road 10.
USR-841: USR-841 was approved by the BOCC on August 31, 1988, for a
recreational facility (hot air balloon launch area) in the A (Agricultural)
Zone District.

I, John W. Zadel president of JZM, LLC, do hereby request the Weld County Board of
County Commissioners to vacate Special Permit 841 from all portions within the
following described property:
That part of the South 1/2 of Section ten (10), Township one (1) North, range sixty-seven
(67) West of the sixth (6th) Principal Meridian, County of Weld, State of Colorado, being
more particularly described as follows: BEGINNING at the West 1/4 corner of said
Section 10; thence South 00°00'00" West on an Assumed bearing along the Westerly line
of the Southwest 1/4 of said Section 10 a distance of 70.00 feet; thence North 89°46'45"
East a distance of 2566.48 feet to a point 85.00 feet Westerly of the Easterly line of said
Southwest 1/4 of Section 10 and 65.00 feet Southerly Of the Northerly line of said
Southwest 1/4 of Section 10; thence continuing North 89°46'45" East a distance of
253.87 feet; thence South 00°06'39" East a distance of 1256.87 feet to a Point 188.87 feet
Easterly of the Center-South 1/16 corner of Section 10 and on an Extension of the
Southerly line of the North 1/2 of said Southwest 1/4 of Section 10; Thence South
89°53'07" West along said extension of the Southerly line of the North 1/2 of Said
Southwest 1/4 of Section 10 a distance of 168.67 feet to said center-South 1/16 Corner of
Section 10; thence continuing South 89°53'07" West along said Southerly line of The
North 1/2 of the Southwest 1/4 of Section 10 a distance of 2653.90 feet to the Southwest
