I have had telephone conversations with both Carl Hale and the applicant, Brian Ridnour. These parties are in agreement on location and placing of the two cattle guards and an access culvert adjacent to WCR 68. One of the cattle guards will be placed at the right-of-way line adjacent to WCR 68, and the second cattle guard will be placed at the property line for the Ridnours, all within the public right-of-way. Carl Hale indicated that there is a hill to the east of the section line access and recommends that the County place an appropriate sign for that condition. In the Non-exclusive License Agreement granted to the Ridnours, these items are the responsibility of the applicant and not the County on issues of the cattle guards fences, and snow plowing. Summary: In working with both the applicant and the adjacent property owner, I feel that all the issues have been worked out between the two to provide reasonable access utilizing the County's public right-of-way (section line access) and to acquire access to the Ridnour land- locked parcels. I will contact our signing crews to relocate the blue and white section line access sign to the appropriate location and to review the sight distance and if any appropriate should be posted warning the traveling public of an intersection access. Masden Glenn Vaad Board of Commissioners Weld County, Colorado 80631 This letter is to inform you that since you do resolutions behind people's back, Marlene Hale may be getting her own advice, and let you know almost a year later what is happening. It is most unfair that you notify property owners almost a year later that you have decided to put an unnecessary access road through our property without letting us know. Why is that? You as government representatives are unbelievable. You can just do what you please, and just too bad for the citizens of this county. Since you are putting in an access road, I will assume you plan to maintain it. Do you? I would like to know who has to put up the cost of the fences that will be needed to keep our cattle off the road? I would like to know who has to put the gate in so our cattle can get access to water to drink? If this is our cost, it would be nice of you to have let us know. I would like to know if we have to find a way to get our cattle to water when the snow plows go through and cover up the road. I'll probably find that is my cost, too. Just so you are aware, we have received no notification of anything having to do with a recorded exemption to our property. We have never received a self-addressed stamped envelope for convenience, and received no certified mail receipt acknowledge notification. We only received the copies from the Ridnours today, but I am sure that will just be my husband's and my problem. My husband and I talked to the county attorney a few years ago when we received a phone call saying that the Ridnours were going to put a road through our land whether we liked it or not. We were assured at that time that it could not be done that way and not without our knowledge. I guess the county attorney does not always tell the truth, but I guess that does not surprise me. Could you explain to me why the Ridnours could not use Weld County Road 70 on the north side where other Ridnours already live. This access road has been used for a number of years. Just curious! I am sure that I will find that people like my husband and I have no rights. I do have one right though, Mr. Long. I am a voting citizen and with that being my right, I will not be voting for you. I will be sending you a copy of what we received today. Please note the date. This is the first notification we have received. There was no self- addressed stamped envelope, and no certified mail receipt signature. Thank you so much for allowing us to give our opinion of this resolution almost a year later. When that is granted, we will be using the section line for access to our residence on the exemption parcel. The reason for this notification is that it will add another residence sharing the current access road,and Weld County Public Works requires that all landowners be notified. Please acknowledge that you have been notified of the proposed Recorded Exemption,and plans for the land by signing and returning this letter. RESOLUTION RE: APPROVE NONEXCLUSIVE LICENSE AGREEMENT FOR THE UPGRADE AND MAINTENANCE OF WELD COUNTY ROAD 81 AND AUTHORIZE CHAIR TO SIGN - BRIAN AND GLORIA RIDNOUR WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Nonexclusive License Agreement for the Upgrade and Maintenance of Weld County Road 81 Right-of-Way between the County of Weld, State of Colorado,by and through the Board of County Commissioners of Weld County,on behalf of the Department of Public Works, and Brian and Gloria Ridnour, 3329 North County Road 9, Fort Collins, Colorado 80524, with terms and conditions being as stated in said agreement, and WHEREAS,after review,the Board deems it advisable to approve said agreement, a copy of which is attached hereto and,incorporated herein by reference.
