HomeMy WebLinkAbout20070152.tiff HEARING CERTIFICATION DOCKET NO. 2007-02 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1575 FOR A USE SIMILAR TO THE USES LISTED AS USE BY SPECIAL REVIEW(ASSISTED LIVING RESIDENCE) AS LONG AS THE USE COMPLIES WITH THE GENERAL INTENT OF THE A(AGRICULTURAL) ZONE DISTRICT - MARILYN TAYLOR A public hearing was conducted on January 31, 2007, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner William H. Jerke, Pro-Tem Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Jacqueline Hatch Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 11, 2007, and duly published January 17, 2007, in the Fort Lupton Press, a public hearing was conducted to consider the request of Marilyn Taylor for a Site Specific Development Plan and Use by Special Review Permit#1575 for a use similar to the uses listed as Use by Special Review(assisted living residence)as long as the use complies with the general intent of the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal,entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site and surrounding land uses. Ms. Hatch stated the site is within the three-mile referral area for the City of Fort Lupton and Town of Hudson,and each indicated no objection to the application. She stated thirteen referral agencies reviewed the proposal,three indicated no comment,and six responded with comments that have been addressed in the Conditions of Approval and Development Standards. She further stated staff received no correspondence from the Colorado Division of Wildlife,Platte Valley Soil Conservation District,Sheriffs Office,Federal Aviation Administration,or surrounding property owners. Ms. Hatch stated the applicant has requested an amendment to Development Standard #4 to increase the number of employees from three (3) to four (4). Responding to Commissioner Jerke, Ms. Hatch stated the proposal is for an assisted living facility with 16 elderly residents who are aviation enthusiasts. Char Davis, Department of Public Health and Environment, stated the site is proposed to be serviced by a commercial well and an engineer-designed septic system. Responding to Chair Long, Ms. Davis stated the site is small;however,the applicant is working with staff to ensure there is adequate space for the required septic system. 2007-0152 /GC.)j / PL1869 Oi-e' 7 HEARING CERTIFICATION - MARILYN TAYLOR (USR#1575) PAGE 2 Donald Carroll, Department of Public Works, stated Weld County Road 39 is adjacent to the site on the west,and he reviewed the surrounding land uses. Mr.Carroll stated Weld County maintains Weld County Road 39;however,there is an agreement with the Red Baron Estates Subdivision for road stabilization from the airpark through the subdivision,as well as incorporating stabilization for the subject lot. He stated the two Recorded Exemption lots will share an access via a cul-de-sac located at the intersection of Weld County Roads 39 and 16. He stated the proposed parking and circulation are adequate, and the development will be required to avoid placing structures in the public right-of-way. Responding to Commissioner Masden, Mr. Carroll reiterated Weld County Road 39 is maintained by Weld County to the intersection of Weld County Road 16. In response to Commissioner Garcia, Ms. Davis stated the site is proposed to have a commercial well; however, the water will need to be tested to ensure the quality is adequate. Responding to Commissioner Rademacher, Ms. Hatch stated the site is within the Hudson Fire Protection District, and staff is requesting the applicant provide additional plans forfire protection,sprinkling,etcetera. (Changed to Tape#2007-03.) Responding to Chair Long,Ms. Hatch stated the site is slightly larger than three(3)acres. Mr. Carroll stated the Recorded Exemption lots will share a common access from a cul-de-sac, as depicted on the plat. Marilyn Taylor,applicant,explained an assisted living facility helps residents with the necessities of daily life,such as administering medication and providing meals,thereby offering an extension of their independence. She emphasized that it will not be a nursing home, nor will full-time nursing care be provided. Ms.Taylor stated the definition of an assisted living facility is anything providing more than three beds for unrelated residents, and a license is required through the State. She stated the proposed facility will be similar to Beehive Homes,with sixteen residents,and common living and dining areas. She stated the distinguishing feature of the proposed facility is that it will provide an aviation theme for enthusiasts to assist the clients with the transition of moving out of their homes and gaining commonality with other residents. She stated the facility will be located directly across the road from the Platte Valley Airpark and the Colorado International Aviation Museum. She further stated the facility will be called Eagle's Nest and will provide stimulation for the residents,although they are no longer able to participate in flying. Ms.Taylor stated the eastern lot is part of Recorded Exemption#4053,and there is an easement and well sharing agreement in place between the two lots. She stated the septic system is being designed by High Plains Engineering;however,theyare still completing the final drawings to ensure the system will fit on the lot and accommodate sixteen residents and four employees. She further stated the well, located on the subject lot,will provide an adequate water supply,and the plans for a sprinkler and fire alarm system are in place and will be submitted to the Hudson Fire Protection District. Ms.Taylor stated the layout of the parking lot has been redesigned to meet fire requirements and accommodate large equipment,and two underground cisterns,associated with the Red Baron Estates Subdivision,will provide a backup water source for fire control. She explained the State will assign a Health Safety Inspector to ensure the facility meets regulations. Responding to Chair Long,Ms.Taylor stated the water quality will be tested for domestic use,the underground cistern can be utilized forfire control, and there will also be a backup generator in case of a power outage. In response to Commissioner Jerke, Ms. Taylor stated the application for a State License is ready for submittal, and they are proposing sixteen residents, two full-time employees, a cook,and a director,which equals a ratio of one staff member for every six residents. Responding further to CommissionerJerke, Ms. Hatch 2007-0152 PL1869 HEARING CERTIFICATION - MARILYN TAYLOR (USR#1575) PAGE 3 stated Condition of Approval #1.C requires State licensing. In response to Commissioner Rademacher, Ms. Taylor stated the assisted living requirements do not require on-site medical assistance,just monitoring and dispensing of medication; however, the staff will be licensed and keep detailed records. She further stated if any of the residents start requiring more intensive care, then the family will be consulted to consider transferring them to a nursing home or bringing in the necessary nursing staff at the cost of the family. She stated the administrator is a retired Registered Nurse who will not be providing care,but has the necessary background to manage the facility. She stated the intent is to house residents, in relatively good health,who are able to enjoy the surroundings and interact with the other residents. In response to Commissioner Rademacher, Ms.Taylor stated the facility will provide reasonable transportation,if requested. She further stated she has personally resided within the neighboring development and a good relationship exists with the nearby chicken facility operated by Sparboe Horizon Corporation,which is quick to address any complaints. She added the front porch will be screened to avoid the nuisance of flies while residents are watching the activities at the airstrip. In response to Chair Long,Ms.Taylor stated the modified septic system design has been approved by staff. Ms. Davis stated everything appears to be adequate and a second septic envelope will be added, if needed. Russell Riley, surrounding property owner, stated he has lived the in area his entire life and he supports the proposed use at the subject location. He further stated Sparboe Horizon Corporation is a great company, and nuisances, such as flies and odor, are not a major issue. The Board indicated concurrence with amending Development Standard#4 to increase the number of employees to four(4). Responding to Commissioner Long,Ms.Taylor stated she has reviewed, and concurs with, the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Masden moved to approve the request of Marilyn Taylor for a Site Specific Development Plan and Use by Special Review Permit#1575 for a use similar to the uses listed as Use by Special Review(assisted living residence)as long as the use complies with the general intent of the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record, and the modification of Development Standard#4. The motion was seconded by Commissioner Jerke, and it carried unanimously.
