RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV#0701107 AGAINST THOMAS DARLING AND CINDY MEEKER FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Thomas Darling and Cindy Meeker, ZCV#0701107, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time, the matter was continued to November 13, 2007, to allow adequate time for the property
owner to be able to attend the hearing.
WHEREAS, on the 13th day of November, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Thomas Darling and Cindy Meeker were not present or represented at said
hearing,although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Thomas Darling and Cindy Meeker to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

USE. THIS WOULD SHOW THAT THE TWO HOMES ON THE PARCEL IS A GRANDFATHERED USE
WHEN THIS PAPERWORK HAS BEEN SUBMITTED THE CASE WILL BE REMOVED FROM THE
DOCKET; OTHERWISE, VIOLATION HEARINGS WILL CONTINUE AS SCHEDULED.
RECOMMENDATION

PAST THERE WERE SOME PROBLEMS WITH THE
NUMBER OF DOGS IN RELATION TO A DOG RESCUE
THE TENANT WAS OPERATING FROM THE
PROPERTY. HE IS GOING OUT TO THE PROPERTY IN
THE NEXT FEW DAYS AND WILL CALL WHEN HE
FINDS OUT MORE. HE WAS TOLD THE NUMBER
CANNOT EXCEED FOUR BETWEEN THE TWO
HOUSES ON THE PROPERTY. HE IS ALSO COMING

INSPECTION SHALL BE CONDUCTED OR A LETTER
SUBMITTED STATING THAT THE NUMBERS HAD BEEP
REDUCED. SINCE THERE WAS NO APPARENT
OUTSIDE ADVERSTISEMENT I WOULD NOT BE ABLE
TO ENFORCE A KENNEL PERMIT. AS FOR THE TWO
HOMES ON THE PROPERTY I TOLD HIM THAT IT IS
POSSIBLE TO APPLY FOR AN NCU BUT EXPLAINED
THE NUCD HOME CAN NOT BE REPLACED IN THE

DARLING AND GAVE HIM AN NCU APPLICATION
WHICH HE WAS TOLD SHALL BE SUBMITTED IN 30
DAYS TO AVOID FURTHER ACTION. HE IS GOING TO
CONSIDER AN RE AT ANOTHER TIME.
08/31/2007 Phone Call Cindy Meeker called (970-351-7129). She asked how
many dogs they could have. I explained that it looked like
they had a little under 3 acres which would allow a total of
4 dogs. She asked if that applied to 4 (four) dogs per
house (since there are 2 homes on this lot). I explained
that it did not. It was 4 (four) dogs total for the whole
parcel/lot. She asked what she was supposed to do in
order to keep her dogs. I explained that she could apply
for a Use by Special Review, but that application would
cost approximately$2500 and she would have to have the
landlord sign off on it. She said there was no way she
could come up with $2500. She asked what her other
options were. I explained that she really needed to
complete the USR process or remove dogs (so that only 4
remained on the property). She asked how much time
she had. I asked what she meant. She stated that her
landlord received a letter regarding the number of dogs on

the property. I told her that we typically send a 30 day
letter next. She said so that gives her some time to figure
out what she's going to do. I said yes and if she needed
more time, she would need to speak with Ann Siron (the
Compliance Officer handling the case). She said okay.
She asked that Ann send her a copy of the Violation
Notice as well as the landlord. Her name and address are

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

KENNEL: Any place other than a PET SHOP or veterinary clinic or HOSPITAL, where five (5)

p.m. -4:30 p.m. You do not need to schedule an appointment, because individuals are seen
on a sign in basis. Fridays are reserved by appointment only. To better serve you, please
bring this letter with you.
