RE: APPROVE CERTIFICATION OF WEED ENFORCEMENT LIEN - DARYL AND CAROL
PROPP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 15-2-40 of the Weld County Code, the Board of County
Commissioners may certify to the Weld County Treasurer any assessment for weed enforcement
work not paid within 33 days, to constitute a lien against each lot or tract of land until paid, and
WHEREAS,the Vegetation Management Specialist performed weed enforcement work on
property owned by Daryl and Carol Propp, 12600 West Colfax Avenue, Suite B-130, Lakewood,
Colorado 80215, on property described as Parcels #146709100004 and #146709000009,
Section 9, Township 1 North, Range 68 West of the 6th P. M., Weld County, Colorado, and
WHEREAS,a Billing Invoice was delivered by Certified Return Receipt mail on July6,2007,
in the amount of$2,630.50, and
WHEREAS, to date, said Billing Invoice has not been paid, and
WHEREAS,after review, the Board deems it advisable to certify a lien against the property
described as Parcels #146709100004 and #146709000009, in the amount of $2,630.50, with a
delay of seven (7) days to allow an opportunity for payment to be remitted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a lien against the property, after seven (7) days have passed without a
payment being remitted,described as Parcels#146709100004 and#146709000009,in the amount
of$2,630.50, be, and hereby is, certified, pursuant to Section 15-2-40 of the Weld County Code,
due to failure to pay within 33 days.
BE IT FURTHER RESOLVED by the Board that the Weld County Treasurer be,and hereby
is,authorized to place said lien against each lot or tract of land under the parcel numbers described
above, in accordance with Section 35-5.5-109(5)(a), C.R.S., until such lien is paid in full.

SUBJECT: Agenda Item: Assessment of Enforcement of Bills
In compliance with County Code, Section 15-2-70, Failure to Pay Assessment, I request that the
weed enforcement bills listed below be certified by resolution by the Board of County
Commissioners to the County Treasurer to be collected as taxes in accordance with Section 35-5.5-
109(5)(a) C.R.S.
The amount due is $114.00 for the property owner Deutsche Bank National Trust CO; Parcel
#130927414006, Section 27, Township 2 North, Range 66 West in the 6th P.M., Weld County,
Colorado.
Another amount due is $2630.50 for the property owner Daryl and Carol Propp; Parcel
#146709100004 and 146709000009, Section 9,Township 1 North,Range 68 West of the 6th P.M.,
Weld County, Colorado.
The bills were delivered to each landowner by Certified Return Receipt mail on July 6, 2007.

Dear Mr. Propp:
On Monday,August 27, 2007, at 9:00 a.m. the Board of County Commissioners of Weld
County will consider placing a lien in the amount of$ 2,630.50 on the property owned by
you which is described as parcel number 146709100004 and 146709000009, section 9,
township 1 north,range 68 west. The lien is for the cost of weed eradication by Paratex
Colorado Inc. which occurred on June 21 and 22, 2007. You were previously billed for
this amount, and have not paid as of this date. The Board's consideration of placing this
lien will take place in its First Floor Meeting Room, 915 10th Street, Greeley, Colorado.
Please feel free to attend if you wish to provide testimony or other evidence regarding the
lien.
Weld County Commissioner Douglas Rademacher received your letter of August 6,
2007,by mail on August 13, 2007. If you consider your letter of August 6`h to be an
appeal pursuant to Weld County Code Section 2-4-10, the consideration by the Board on
August 27, 2007,will act as the appeal hearing pursuant to Section 2-4-10 (C). The
appeal would only be as to the issue of the billing for weed eradication. The other issues
you mention in your letter must be addressed to the appropriate departments(tax
assessments to Chris Woodruff, Assessor, and planning issues to Tom Honn, Director,
Department of Planning Services).
