RE: APPROVE REQUEST TO MODIFY DEVELOPMENT STANDARDS #17 AND #18 OF
THIRD AMENDED USE BY SPECIAL REVIEW PERMIT#894 - KAUFFMAN LAND AND
DEVELOPMENT, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on December 20, 2006, the Board of County Commissioners approved the
application of Kauffman Land and Development, LLC, 1675 Broadway, Suite 2800, Denver,
Colorado 80202-4628, do Todd Hodges Design, LLC, 1269 North Cleveland Avenue, Loveland,
Colorado 80537,for a Site Specific Development Plan and Third Amended Use by Special Review
Permit#894, for Mineral Resource Development Facilities, including an oil and gas support and
service facility, contractor's shop for vehicle maintenance, and a helicopter pad, in the
A (Agricultural) Zone District, for property which is described as Lot A of Recorded Exemption
#1921; being part of the SE1/4 of Section 9, Township 2 North, Range 67 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, Development Standard #17 was approved, to read as follows:
"A maximum of five(5) helicopter landings and take-offs, per day, is
allowed during the hours of 9:00 a.m. to 5:00 p.m., Monday through
Friday,with the exception of emergency situations, including life and
safety", and
WHEREAS, Development Standard #18 was approved, to read as follows:
"The hours of operation for all activities on the site will be daylight
hours, Monday through Saturday,with the exception of emergency
situations, including life and safety."
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Weld County
Departments of Public Health and Environment and Planning Services and, having been fully
informed, finds Development Standards #17 and #18 shall be amended to read as follows:
"A maximum of five(5) helicopter landings and take-offs, per day, is
allowed during daylight hours, Monday through Saturday, with the
exception of emergency situations, including life and safety."
"The hours of operation for all other activities on the site will be
daylight hours,with the exception of emergency situations,including
life and safety."

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that Development Standards#17 and#18,on the hereinabove described parcel
of land be, and hereby are, amended as follows:
"A maximum of five(5)helicopter landings and take-offs, per day, is
allowed during daylight hours, Monday through Saturday, with the
exception of emergency situations, including life and safety."
"The hours of operation for all other activities on the site will be
daylight hours,with the exception of emergency situations,including
life and safety."
BE IT FURTHER RESOLVED that all other Conditions of Approval and Development
Standards included in Resolution #2006-3222, approved on December 20, 2006, remain in full
force and effect.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 2nd day of April, A.D., 2007.

3rd AMUSR-894 was approved by the Board of County Commissioners on December 20,
2006 for a Site Specific Development Plan and a Special Review Permit for a mineral
resource development facilities including oil and gas support and service facility,
contractor's shop for vehicle maintenance, and a helicopter pad in the A (Agricultural) Zone
District.
Development Standard 17 of the approved resolution states, "A maximum of five (5)
helicopter landings and takes off, per day, is allowed during the hours of 9:00 am to 5:00
pm, Monday through Friday, with the exception of emergency situations, including life and
safety"
Development Standard 18 of the approved resolution states, "The hours of operation for all
other activities on site will be daylight hours, Monday through Saturday, with the exception
of emergency situations, including life and safety"
Kauffman Land & Development LLC in a letter dated February 26, 2007 signed by Gordon
Allott Jr. Executive Vice President and General Counsel is requesting that Development
Standards 17 and 18 be modified to reflect the following:
Development Standard 17 with the applicants proposed change would state the following,
"A maximum of five (5) helicopter landings and takes off, per day, is allowed during the
hours of 9:00 am to 5:00 pm daylight hours, Monday through Friday Saturday, with the
exception of emergency situations, including life and safety"
Development Standard 18 with the applicants proposed change would state the following,
"The hours of operation for all other activities on site will be daylight hours, Monday through
Saturday, with the exception of emergency situations, including life and safety"
The Weld County Department of Planning Services is not in support of the proposed
amendment for the following reasons: close proximity of residential developments,
compatibility with surrounding land uses, and in the Town of Firestone's referral dated June
20, 2006. Staff comments originally stated the following for Development Standards 17
and 18 which took into consideration the above mentioned concerns.
A maximum of five helicopter landings and takes off per day is allowed during the hours of
9:00 am to 5:00 pm Monday- Friday.
The hours of operation for all other activities on site shall be limited to 6:00 am to 6:00 pm
Monday through Friday.
At the Planing Commission on July 18, 2006 the applicant representative Anne Best
Johnson asked to amend Development Standards 17 and 18 to the following:
A maximum of five helicopter landings and takes off per day is allowed during the hours of
9:00 am to 5:00 pm Monday - Friday with the exception of emergency uses
The hours of operation for all other activities-inI-s le shall be 6:00 am to 6:00 pm Monday
through Friday seven days a week, with the exception of special circumstances.
The Planning Commissioners denied the applicants request to amend Development
Standard 17 but did change Development Standard 18 to read the hours of operation for
all activities on the site will be daylight hours, Monday through Saturday.
At the Board of County Commissioners hearing on December 20, 2006 the applicants
representative Ms. Johnson requested the following modification to Development
Standard 17, "A maximum of five (5) helicopter landings and takes off, per day, is allowed
during the hours of 9:00 am to 5:00 pif rdaylight hours, Monday through Friday, with the
exception of emergency situations, including life and safety." She also requested
Development Standard 18 be amended to state, "The hours of operation for all other
activities on site will be daylight hours, Monday through Saturday, with the exception of
emergency uses situations, including life and safety." At the hearing the Board did not
accept/approve the proposed changes.
The Department of Planning Services is not in support of the applicants proposed changes
because of the close proximity to a residential development (Gloraloma Estates),
compatibility with surrounding land uses, and the concerns of the Town of Firestone.

This letter is a request for a 9 a.m.hearing at the earliest date possible to review two Development
Standards for 3 Amended USR-894. Our consultants had requested these changes be made at our December 20,
2006 hearing. We were under the impression these amendments had been made. However,after reviewing the
tapes,minutes and the resulting Resolution,the changes were not made. This request for the following
amendments is being made at the direction of the Clerk to the Board's office and the County Attorney.
Development Standard 17: A maximum of five helicopter landings and takes off per day is allowed

Hi Anne,
I received your voice mail regarding Development Standards#17 and#18 and after reviewing the record it does
not appear the Board ever formally accepted/approved your request for"daylight hours" related to the helicopter
use. I reviewed the tape to complete my minutes for that portion of the hearing and the discussion revolved
around adding the exception for emergency situations, but there was no mention of eliminating the flight hours.
If this is a serious matter for the applicant, they will need to submit a written request to Planning staff for
reconsideration of Development Standard#17, which will be heard by the Board as a 9:00 Planning item.

Have the corrections to the Board's Resolution/Minutes for this hearing been made? After you and I listened to
the tape of the hearing, we both concluded the Resolution/Minutes do not reflect what I had requested regarding

Minutes/Resolution in her attached memo. Can you check into this matter so that the Board has accurate

2. Project Overview:
a. Access -- Access will remain as it is today from WCR 22.
b. Mineral Notice—Mineral Notification was mailed on May 19, 2006
by Bill Crews, a certified Land Man. Evidence was provided to DPS.
c. Purpose—This application is to add a helicopter pad to an existing USR for
oil/gas service/support operations. The amendment includes the addition of
the helicopter landing pad and a helicopter fuel tank.
d. Surrounding Land Uses — Surrounding land uses include Agricultural,
Special Use Permits, Rural Residential including confined animal feeding
operations (hogs, turkey), other oil and gas support, maintenance and repair
facilities.
e. Site as USR—The site has been under a USR since 1989.
f. Work with Referral Agencies and Planning Staff - The applicant has
worked with referral agencies including the Gilcrest Fire Protection District,
Airport Authority, Weld County Department of Public Works and Public
Health to address staff and referral comments prior to this hearing.
K.P. Kauffman Operations Overview Gordon Allott will now briefly discuss the operations.
Closing—
This proposal meets and exceeds portions of the review and approval criteria for
a USR in the Weld County Code. We therefore request a favorable
recommendation. We would be happy to answer public testimony and your
questions after the public has had the opportunity to speak.

There are three Conditions that have been satisfied. Planning Staff indicated to me this morning that
the Board of County Commissioners is review entity to determine the Conditions have been met as she
cannot do so.

discuss with you re amending language. Staff is aware of these requests.
Plat Note: IB10 pg 5 ANNE WILL ASK BCC TO APPROVE EXISTING FENCE: purchased, not up per SPO
1M , pg 6 ANNE: The Annexation Agreement is not applicable. The definition of Development in
Discuss w/BCC Section 19-2-40 states, "Any land use requiring regulatory approval by the elected governing
body of the applicable party in the Urban Growth Area except for an amendment to a plat or
Gordon/Brent Coan a down-zoning, neither of which creates any additional lots, and except for a Subdivision
work on language Exemption." This application is for an amendment to an existing Use by Special Review plat
KPK can agree to. and therefore does not meet the definition criteria for"Development"and does not require an
