SIGNAI'URb OF Ph II IONEK ✓ DP I /26 d NOD 207 62 87/07 July 16, 2007 To Whom It May Concern: In 1996 I built a daycare building for a daycare business. This business rented the building for 5 years. I left the building open for 11/2 years and started Platteville Child Development Center in 2003. We opened in March 2003. We closed that business because of losses on August 4, 2004. I went to the Town of Platteville and had town services shut off. The building was built with a special use permit and a new permit would have to be issued for a new daycare. At the end of December, after 3 months of calling all Daycare facilities within 20 miles of Platteville and trying to sell the building or at least rent it with no interest shown by any, I decided to rent the building as a house. Two people responded, but it wasn't rented. I called the Assessors office at the end of December and told them the special use permit for a daycare or commercial building in a residential neighborhood was revoked and it should be put back as a residential property. At that time the person I spoke to said the matter would have to be presented in April 2005 as a tax protest to get it changed. I went in and protested in April 2005 and the tax person told me it should have been reported by Jan. 1, 2005 to be eligible as a change in use. I said ok - paid $3500.00 taxes on an unusable building, and they said it would be on record for 2006. I called at the end of December in 2005 and was told no such change or record was found so I talked to Stan Session and Chris Woodruff about the situation. Mr. Sessions was very helpful and said he would write a letter to the county for a tax rebate for 2004 if I wanted to pursue it. He also said bring in a residential lease and the county Assessors office would make sure it was changed for 2006. I did that and got a copy of receipt for document at that time. April came around and I paid $3500.00 taxes again for the same vacant unusable building. I decided not to rent the building after all and tore the building apart inside and started re-framing interior walls and redoing the plumbing for kitchen, 3 bathrooms, 4 bedrooms, a family room and dining room. I then got sick with urinary infection, diabetes, and diverticulitis and was hospitalized and recuperating through December. In December 2006 I applied for a building permit to open up an end of the building, tear out wood floors, pour retaining walls and convert that end to a garage, as well as changing the electrical in the building to meet codes for residential instead of commercial. When we received tax evaluations in 2007, the building was still listed as commercial. I called the Assessor and was told they had no lease turned in or any conversation from the previous year and a new appraiser was sent out. He took pictures and said it would not be changed at all until someone actually lives in the building as a house. I explained I was fixing it to sell it, not rent it, and the average sale is 1 year. He told me that didn't matter and by law he has to see people living there. My only option is to rent it and I have 17 rentals in Platteville, 6 of which are already empty. He also said I should pay the years taxes, another$3500.00, while this is still in limbo. Also, he said 2007 taxes would still be as commercial unless all these conditions were complied with. That brings it to $10,500.00 for those 4 years taxes on a building non-usable, torn apart and remodeled for a different use. My evaluation of value of the property for this period from Jan. `05-July '06 is $80,000.00 which accommodated land, taps and building shell without respect to zoning uses or city zoning rules.
