RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ANDREA NEIDIG FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Andrea Neidig,VI#0600548, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of May, 2007, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Andrea Neidig was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until June 8, 2007, to allow adequate time for the property owner to submit a Use by
Special Review application for a radio station to bring the subject property into compliance and for
an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0600548 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Andrea Neidig to remedy the violation of the Weld County Code,and
any other persons occupying the properties,any persons claiming an interest in the properties,and
any persons acting in active concertwith the identified parties,with an instruction for delay of action
upon such referral until June 8, 2007, to allow adequate time for the property owner to submit a
Use by Special Review application for a radio station to bring the subject property into compliance.

REMEDY

office for immediate legal action.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on April 10, 2007 at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:

To bring the property into compliance:
I received a phone call from Alberto Loya stating that the mobile home will be used to
store equipment for a future radio station and that you are currently in the process of
submitting a Use by Special Review(USR)for. Unfortunately, until the USR application
has been completed and submitted to the Department of Planning Services the property
is in violation of the Weld County Code as no other required zoning permits have been
obtained for this mobile home.
A permit application for either USR or Accessory Structure shall be completed and
submitted to the Department of Planning Services or the mobile home shall be removed.
For questions regarding the USR application or process I suggest you speak to one of
our"On-Call" Planners. To better serve the public, we have two locations open. Our
North office is located at 918 10th Street, Greeley, Colorado. At our North office,an"On-
Call" Planner is available, Monday thru Thursday from 7:30 a.m. - 11:30 a.m. Our
Southwest office is located at 4209 CR 24.5, Longmont, Colorado. At our Southwest
office, an "On-Call" Planner is available Monday thru Thursday from 12:30 p.m.—4:30
p.m. You do not need to schedule an appointment, because individuals are seen on a
sign in basis. Neither t e will have a planner available on Fridays walk-ins. To
better serve you, please bring this letter with you.
DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE)
HOME that is partially or totally damaged by fire, earthquake wind or other natural
causes, or is in a state of general dilapidation, deterioration or decay resulting from
improper lack of maintenance,vandalism or infestation with vermin or rodents. Any such
DERELICT MANUFACTURED(MOBILE)HOME shall be returned to and maintained in
the condition as originally established on site and as inspected by the Building Inspection
Department, or it shall be removed from site.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary

DERELICT MANUFACTURED(MOBILE)HOME: A MANUFACTURED(MOBILE)HOME that
is partially or totally damaged by fire,earthquake wind or other natural causes,or is in a state of
general dilapidation, deterioration or decay resulting from improper lack of maintenance,
vandalism or infestation with vermin or rodents. Any such DERELICT MANUFACTURED
(MOBILE)HOME shall be returned to and maintained in the condition as originally established
on site and as inspected by the Building Inspection Department, or it shall be removed from
site.
MOBILE HOME: A transportable STRUCTURE which as originally built exceeds either eight
(8) feet in width or thirty-two (32) feet in length, was originally built on a chassis and was
originally designed to be used as a year-round DWELLING UNIT with or without a permanent
foundation. A SINGLE-FAMILY DWELLING which is certified pursuant to the "National
Manufactured Housing Construction and Safety Standards Act of 1974," 42 U.S.C. 54O1 et
seq., as amended, but does not meet all of the other provisions of the definition of a
MANUFACTURED HOME, is considered to be a MOBILE HOME. A MOBILE HOME or
MANUFACTURED HOME shall not be converted to any USE other than a SINGLE-FAMILY
DWELLING and shall not be allowed to deteriorate to the condition of a DERELICT MOBILE
HOME. A MOBILE HOME or manufactured home, converted or in its original condition, shall
not be used as an AGRICULTURALLY EXEMPT BUILDING or as a TEMPORARY
STRUCTURE for storage.
It is the intention of.this office to assist and cooperate with you without imposing undue hardships; however,

Alberto Loya came by my office to say that Ms. Neidig intends to in 2 weeks submit an application for a USR for
the property. Alberto asked if Neidig needs to appear for the violations hearing on 4/9/07. I told him that it is up
to them, but that I would ask the Board to continue the matter to the May, 2007, violations hearings. Alberto said
he would forward that information on to Ms. Neidig.
