Moved by Roy Spitzer that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the application for:
CASE NUMBER: USR-1574
APPLICANT: New Hope Family Christian Church
PLANNER: Kim Ogle
LEGAL DESCRIPTION: Lot A of RE-4300 being part of the N2 NW4 of Section 28, T2N, R67W of the 6th
P.M., Weld County, Colorado.
REQUEST: Site Specific Development Plan and a Special Review Permit for a church, childcare center,
and private school in the A(Agricultural)Zone District.
LOCATION: South of and adjacent to CR 18 and east of and adjacent to CR 17.
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section
23-2-260 of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-2-260 of the Weld County Code as follows:
A. Section 23-2-260.A.1 --The proposed use is consistent with Chapter 22 and any
other applicable code provisions or ordinance in effect. Section 22-2-60.D.A Goal
4 states: "Conversion of agricultural land to nonurban residential, commercial and
industrial uses will be accommodated when the subject site is within an area can
support such development." The projected population of the congregation as
indicated in the application materials, the purported annexation agreement with
the town of Firestone and the required improvements to the site will ensure that
the area is able to support said use.
B. Section 23-2-260.A.2 --The proposed use is consistent with the intent of the A
(Agricultural)Zone District. Section 23-3-40.E.1 of the Weld County Code
provides for a church as a Use by Special Review in the A (Agricultural) Zone
District. Section 23-3-40.E.2 of the Weld County Code provides for a private
school as a Use by Special Review in the A(Agricultural)Zone District. Section
23-3-40.S of the Weld County Code provides for a child care center as a Use by
Special Review in the A (Agricultural)Zone District.
C. Section 23-2-260.A.3 --The uses which will be permitted will be compatible with
the existing surrounding land uses. Surrounding properties to the north is SUP-
118 for a 70,000 unit Turkey Farm, to the northeast is AmSUP-238 for a
Compressor Station; to the east are agricultural lands including USR-1231 for the
2500 head Bearson Dairy; to the south are agricultural lands including the 1450
head Busker Dairy and to the west are lands annexed into the Town of Firestone.
Conditions of Approval and Development Standards will ensure that this use is
compatible with surrounding land uses
D. Section 23-2-260.A.4 --The uses which will be permitted will be compatible with
future development of the surrounding area as permitted by the existing zoning
and with the future development as projected by Chapter 22 of the Weld County
Code and any other applicable code provisions or ordinances in effect, or the
adopted Master Plans of affected municipalities. The subject property lies within c
the Intergovernmental Agreement Area for the Town of Firestone and is also
within the three-mile referral area of the Towns of Frederick and Firestone and Y •
the City of Dacono. The Town of Frederick, in a referral dated August 18, 2006
2007-0972 „
Resolution USR-1574
New Hope Family Christian Church

had concerns on the impact of this facility on the surrounding transportation
system including roads annexed to the Town. The Town of Firestone and the
City of Dacono did not return a referral indicating a conflict with the request.
There are five property owners within 500 feet of this proposed facility and staff
has not received any letters or telephone calls of concern.
E. Section 23-2-260.A.5--The site does not lie within any Overlay Districts. Effective
January 1, 2003, Building Permits issued on the proposed lots will be required to
adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-
11). Effective August 1, 2005, Building permits issued on the subject site will be
required to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
F. Section 23-2-260.A.6--The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The subject
site is designated "Prime (Irrigated)" on eighty percent of the site and "Other" on
lands adjacent to County Road 18 on the Farmlands of National Importance by the
USDA Soil Conservation Services. The small size of the lot (13.8 acres) severely
limits its agricultural value.
G. Section 23-2-260.A.7 -- The Design Standards (Section 23-2-240, Weld County
Code), Operation Standards(Section 23-2-250,Weld County Code), Conditions of
Approval and Development Standards ensure that there are adequate provisions for
the protection of health, safety, and welfare of the inhabitants of the neighborhood
and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:

LEGAL DESCRIPTION: Part of the S2 of Section 33, T3N, R68W of the 6th P.M., Weld
County, Colorado.

Michelle Martin, Department of Planning Services, presented Case 2006-XX, Newby Farms LLC, reading
the comments and recommendations into the record. The Department of Planning Services
recommended approval of the application. Ms. Martin stated the applicants have applied for a petition for
inclusion into the Mixed Use Development Area of Unincorporated Weld County. Changes to Chapter 22
(Comprehensive Plan)and Chapter 26 (Mixed Use Development Plan Structural Land Use Map 2.1). The
property is located North of and adjacent to County Road 26 and east of and adjacent to County Road 5.
There are two criteria for review of this amendment to Chapters 22 and 26 Map#2.1: Structural Land Use
Map. The property in question is not located within the Mixed Use Development (MUD) area. Inclusion
into MUD would allow the applicants the opportunity to propose an urban scale development in an area
that can obtain adequate services. The proposed subdivision would include 600 single family residences
utilizing St. Vrain Sanitation and Longs Peak Water. The applicants have examined the goals and policies
of the MUD and have committed to provide 65 acres of open space. The applicants have discussed the
need for appropriate pedestrian circulation within the site and have committed to meet these needs. The
application states that the goal in creating this subdivision rests in the ability to create a mixture of
residential land uses with both passive and active recreational uses. The proposed site lies within
