Potomac Way Centennial CO 80111 Subject: Highland Farms PUD Dear Mr. Bulthaup: • This letter is in response to your letter dated June 13, 2007 regarding a proposed lot line change between Lot 5 and the open space as delineated on the PF-1045 Final Plat recorded August 24, 2005 via reception number 3316277. The Department of Planning Services has determined at this time that the appropriate application process is an Amended Final Plat. Please keep in mind that the home owners association will need to provide written evidence that they are in support of this change and that the open space acreage does not go below 15% as required per the Weld County Code (15% of 56.9 acres is 8.53 acres of open space). Staff also notes that a new emergency access road will need to be incorporated into the existing PUD. Staff requests a written sign off by all emergency providers for the access. The 30' access easement to outlot may need to be re-evaluated. Other concerns or issues may arise during the application process. Please find enclosed the Final Plat application. I am also part of the Executive Board of the Highland Farms HOA. If you recall, we recently had some dealings with you concerning our project. Those issues have been resolved and I thank you for your help in that matter. I am writing for clarification on procedures in the Weld County Code. I and the HOA are trying to determine what process would be required to do a lot line adjustment between Lot 5 and Open Space owned by the HOA. As background, when the first plans were being made for the PUD,there was some question as to the required size of the detention pond for drainage. It was determined that whatever the ultimate size would be, the land for the pond would continue to be owned by the HOA. Plans were prepared and approved that included a tract of land for the pond that was roughly 5 acres larger than was ultimately required. The HOA believes it may not be in its best interest to continue own such a large tract of open space. The HOA has contracted with a Landscape company to maintain all of the ground, except for the 5 acres. The remaining 5 acres are native grasses and would serve as a good small pasture. I may mind, it makes sense to do a lot line adjustment between the existing Lot 5 and this 5 acre tract to create a 7.5 acre parcel for Lot 5. The thought is that if the process was simple enough, the HOA and I would consider doing a lot line adjustment. Attached are the following maps— 1. Final Plat 2. Final Plat showing location of Existing HOA open space 3. Final Plat showing location of Existing Lot 5 4. Final Plat showing location of Proposed Lot 5 5. Final Plat"showing location of Proposed HOA open space No future division of Lot 5 would be allowed and all easements would remain exactly as they are today. The question is which, if any of the following sections of the code would have to be followed for such a change- • Sec. 24-8-30 Subdivision Exemption. 2. For adjustment of property lines between two(2)contiguous parcels, • Sec. 27-8-40. Changes to a PUD final plan. A. Amendments, or • Sec. 27-8-40. Changes to a PUD final plan. B. Minor Modifications, or • Such sections as you believe apply Can you please review and let me know the proper procedure to be followed if I should decide to move forward?Due to personal difference with Ms Jacqueline Hatch, I would request that she not be assigned to this request.
