IN THE MATTER OF REPEALING AND REENACTING,WITH AMENDMENTS, 15 VEGETATION,
OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1,enacting a comprehensive Code for the County of Weld, including
the codification of all previously adopted ordinances of a general and permanent nature enacted
on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and
hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to
read as follows.
CHAPTER 15
Vegetation
Repeal and Reenact Sec. 15-1-40 to read as follows:
Sec. 15-1-40. Noxious weeds.
§1203-19, Part 3), identify seventeen (17) noxious weeds species designated for
Noxious Weed Species"). The State Noxious Weed Management Plans for List-W
Noxious Weed Species is in Appendix 15-A. The species include:
African rue (Peganum harmala)
Camelthorn (Alhagi pseudalhagi)
Common crupina (Crupina vulgaris)
Cypress spurge (Cuphorbia cyparissias)
Dyer's woad (Isatis tinctoria)
Giant salvinia (Salvinia molesta)
I Iydrilla (I Iydrilla verticillata)
Meadow knapweed (Centaurea pratensis)
Mediterranean sage (Salvia aethiopis)
Medusahead (Taeniatherurn caput-medusae)

Myrtle spurge (Cuphorbia myrsinites)
Purple loosestrife (Lythrum salicaria)
Rush skeletonweed (Chondrilla juncea)
Sericea lespedeza (Lespedeza cuneata)

Tansy ragwort (Senecio jacbaea)
Yellow starthistle (Centaurea solstitialis)
B. The noxious weed species designated for management in Weld County-areas
follows
Field bindweed (Convolvulus arvensis)
Chinese clematis (Clematis orientalis)
Orange hawkweed (I-lieracium aurantiacum)
Diffuse knapweed (Centaurea diffusa)
Spotted knapweed (Centaurea maculosa)
Russian knapweed (Acroptilon repens)
Leafy spurge (Euphorbia esula)
Tamarisk (Tamarix ramosissima)
Canada thistle (Cirsium arvense)
Musk thistle (Carduus nutans)
Piumeless thistle (Carduus acanthoides)
Scotch thistle (Onopordurn acanthium)
Dalmatian toadflax (Linaria dalmatica)
Absinth wormwood (Artemisia absinthium)
Added to this list are the remaining "B"weed species which are listed in the Rules (8 CCR
§1203-19, Part 4), and as such list may be modified by the Colorado Department of Agriculture
The remaining "B" weed species list is found in Appendix 15-B to this Chapter.
A. The rules pertaining to the administration and enforcement of the Act (8 CCR §
1203-19, Part 3), identify seventeen (17)noxious weeds species(known therein as
"List 'A' Noxious Weed Species"), which species have been designated for
eradication in the State of Colorado and consequently, the County. As the species
designated for eradication may change, the specific species are not enumerated
within the Code, but are posted on the following websites. The State Noxious Weed
Management Plans for List'A'are found at the Colorado Department of Agriculture
website: http://www.ag.state.co.us/CSD/Weeds/Weedhome.html,and on the Weld
County Website: www.co.weld.co.us or www.weldweeds.org. In addition, copies of
the lists and additional information are available upon request from Weld County
Public Works, Weed Division.
B. The State of Colorado and Weld County designate certain noxious weed species
for control and/or eradication, known as "List 'B' Noxious Weed Species". These
species designated for control and/or eradication vary from year to year,the specific
species are not enumerated within the Code, but are posted on the following
website: The 'B'Weed Species' Management Plans for Weld County are found at:
www.co.weld.co.us or www.weldweeds.org. In addition, copies of the lists are
available upon request from Weld County Public Works, Weed Division. The
species listed include all of the 'B' List Species listed by the State and certain
additional species which have been added for management in Weld County.

C. Weld County also designates a third category of noxious weed species for
management, known as "List 'C' Noxious Weed Species" list species. As the
species in this category may change,the specific species are not enumerated within
the Code, but are posted on the following website: The 'C' Weed Species
Management Plans for Weld County are found at: www.co.weld.co.us or
www.weldweeds.org. In addition, copies of the lists are available upon request from
Weld County Public Works, Weed Division. The species listed include all of the 'C'
List Species listed by the State and certain additional species which have been
added for management in Weld County.
Delete Appendix 15-A
Delete all of Appendix 15-B.
BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization,grammar, and numbering or placement of chapters, articles, divisions, sections, and
sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection,paragraph,sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 2007-10 was, on motion duly made and
seconded, adopted by the following vote on the 14th day of November, A.D., 2007.
