RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR AMENDED USE
BY SPECIAL REVIEW#1416 -ANN STONEBRAKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 13, 2005,the Board approved the application of Ann
Stonebraker, 4502 County Road 11, Dacono, Colorado 80514, for Amended Use By Special
Review #1416 for a Use Permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the Commercial or Industrial Zone District (fireworks storage display and equipment
staging facility and office) in the A (Agricultural) Zone District, on the following described real
estate, to wit:
Lot B of Recorded Exemption #3589; being part of
the NE1/4 of Section 28, Township 2 North, Range
64 West of the 6th P.M.,Weld County, Colorado,and
WHEREAS, on August 1, 2005, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County,and Ann Stonebraker,with terms
and conditions being as stated in said agreement, and accepted Business Check#6138 from the
Stonebraker Rocky Mountain Fireworks Company Account, drawn on the First National Bank of
Colorado, in the amount of$3,545.00, and
WHEREAS, it has been determined by the Board that the collateral being held by Weld
County is no longer necessary to secure said Improvements Agreement According to Policy
Regarding Collateral for Improvements (Private Road Maintenance) for Ann Stonebraker, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works have conducted a visual inspection and recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Business Check#6138, from the Stonebraker Rocky Mountain Fireworks
Company Account, drawn on the First National Bank of Colorado, in the amount of$3,545.00 be,
and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

SUBJECT: Release of Collateral for AMUSR-1416 (Stonebraker)
On April 13, 2005 the Weld County Board of Commissioners accepted collateral in the form of a
check in the amount of Three-Thousand Five-Hundred and Forty-Five Dollars ($3,545.00)for
on-site improvements for Amended Use by Special Review Permit 1416 (Stonebraker).
Collateral covered the following items:
Site Grading estimate $ 2,888.00
Street Grading estimate $ 300.00
Street Base estimate $ 100.00
Landscaping estimate $ 257.00
Total Estimated Cost of Improvements and supervision $ 3,545.00
The Department of Public Works and Planning Services have determined that their
improvements have been completed and recommends the release of this collateral.

SUBJECT: AmUSR-1416, William and Ann Stonebraker
The Weld County Public Works Department has received a letter dated August 31, 2007, asking for a final
inspection and release of collateral in the amount of$3,545.
In checking the site, we have verified that the transportation portion has been completed to our satisfaction and
recommend release of that portion of the collateral.
All other non-transportation portion item such as landscaping shall be verified by Planning Services prior to
release.

We have completed the improvements per Improvements Agreement AM-USR1416 at
our warehouses located at 26986 County Road 18, Keenesburg, CO 80643. We paid
$3,545.00 to the Weld County Board of County Commissioners on July 20, 2005 as a
financial guarantee for these improvements.
This letter is a request for release of collateral. If you have questions, you may call me at

Our first request for release of these funds was made February 20, 2007. We would
