FOR A SINGLE FAMILY DWELLING UNIT, OTHER THAN THOSE PERMITTED
UNDER SECTION 23-2-20.A OF THE WELD COUNTY CODE(A GUEST HOUSE TO BE
BUILT IN ADDITION TO AN EXISTING TWO-STORY RESIDENCE) IN THE
A (AGRICULTURAL) ZONE DISTRICT - SLW RANCH COMPANY
A public hearing was conducted on April 18, 2007, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair

The following business was transacted:
I hereby certify that pursuant to a notice dated March 30,2007,and duly published April 4,2007, in
the Fort Lupton Press, a public hearing was conducted to consider the request of SLW Ranch
Company for a Site Specific Development Plan and Use by Special Review Permit#1600 for a
Single Family Dwelling Unit,other than those permitted under Section 23-2-20.Aofthe Weld County
Code(a guest house to be built in addition to an existing two-story residence)in the A(Agricultural)
Zone District. Bruce Barker, County Attorney, made this a matter of record. Chris Gathman,
Department of Planning Services, presented a brief summary of the proposal,entered the favorable
recommendation of the Planning Commission into the record as written,and gave a brief description
of the location of the site. He stated two existing residences are located on the property,consisting
of a two-story home and a bunkhouse. He further stated the bunkhouse will be removed from the
property to correct the non-conforming use,and will be replaced with a new guesthouse. He stated
the site is accessed from Weld County Road 58.5, and the entrance is gated. Mr.Gathman stated
the Department of Planning Services is not requiring the applicant to complete the Recorded
Exemption process since the use of the guesthouse will be limited to immediate friends and family
of the applicant, and it will not be utilized as a rental, as described in Development Standard#12.
He stated as long as the applicant remains in compliance, there will be no requirement for future
land division, as stated in Development Standard #11. In response to Commissioner Jerke,
Mr. Gathman stated the site consists of approximately 56 acres. He further stated several of the
surrounding properties are also owned by the applicant.
Char Davis, Department of Public Health and Environment, stated the site will be serviced with
water from the North Weld County Water District and a proposed septic system for the new
guesthouse.

Don Carroll, Department of Public Works,stated the site is accessed from Weld County Road 58.5,
which is north of the South Platte River and north of the Town of Kersey. He stated one existing
access with a gate exists, and it is adequate. He further stated the most recent traffic count
indicates approximately 50 vehicle trips per day on Weld County Road 58.5.
Linda Hulse, Casseday Creative Designs, LLC, represented the applicant and expressed her
appreciation to Planning staff for the help she has received concerning the application. In response
to Commissioner Garcia,Ms. Hulse stated the applicant concurs with Development Standard#12,
and realizes that the guesthouse may not be used as a rental property. She further stated the
guesthouse will be utilized by the applicant's sister when she visits. She stated the applicant has
a strong desire to keep the existing ranch in tact, and not to subdivide the parcel.
No public testimony was offered concerning this matter.
In response to Chair Long,Ms. Davis stated language from her memo,dated January 31,2007,was
inadvertently omitted from the Resolution, and she requested the language be added to
Development Standard #5 to state: "An Individual Sewage Disposal System is required for the
proposed guesthouse and shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) Regulations. The system is required to be designed by a Colorado
registered professional engineer, according to Weld County I.S.D.S. Regulations." The Board
concurred with the additional language. Responding to Chair Long, Ms. Hulse stated she and the
applicant have reviewed,and concur with,the Conditions of Approval and Development Standards,
including the addition of the language described as new Development Standard #5.
Commissioner Masden moved to approve the request of SLW Ranch Company for a Site Specific
Development Plan and Use by Special Review Permit#1600 for a Single Family Dwelling Unit,other
than those permitted under Section 23-2-20.A of the Weld County Code(a guest house to be built
in addition to an existing two-story residence) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. His motion included the addition
of Development Standard #5, and necessary renumeration. The motion was seconded by
Commissioner Rademacher, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:15 a.m.
