RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR SHILOH
ESTATES,AMENDED PLANNED UNIT DEVELOPMENT FINAL PLAN,AMPF#354 -
JAMES AND CHERI SCOTT
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated May 10,2006,the Board approved the application of James
and Cheri Scott, 35236 Cornerstone Way, Windsor, Colorado 80550, to subdivide Lot 7, Shiloh
Estates, into 4(four) lots,for a parcel of land located on the following described real estate, to wit:
Part of Section 4, Township 6 North, Range 67 West
of the 6th P.M., Weld County, Colorado, and
WHEREAS,on November 6, 2006, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements(Private Road Maintenance), between the County of Weld,State of Colorado, by and
through the Board of County Commissioners of Weld County, and James and Cheri Scott with
terms and conditions being as stated in said agreement, and accepted check#1734, from Shiloh,
Inc., in the amount of$119,629.00, and
WHEREAS, the Board, through Resolution#2007-0734, dated March 21, 2007, released
cash collateral, in the amount of$26,195.30, to the applicant as improvements were completed,
retaining $93,433.70, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works have conducted a visual inspection and recommend partial release of said collateral, in the
amount of$27,523.00, retaining $65,910.70.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a portion of the collateral being held, in the amount of$27,523.00 be, and
hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

The Department of Planning Services has received a request for partial release of collateral for
Shiloh Estates PUD, 1st Amendment(File No. AmPF-354) in the amount of$27, 523. This request
is being made after completion of the requirements for telephone, gas, and electric improvements.
Please see the attached.
Planning Services and Public Works have reviewed this request and support this partial release.

This letter is to request the partial release of collateral for the gas,telephone and
electric line. These utilities are complete and functional. As per our improvements
agreement with the County the value of these items are $27,523.00. As per Joshua
Holbrook we request 100%of the collateral to be released. The form of our collateral
was a cash deposit with the county.

Request #2 - We are still waiting on them to correct the shoulders (4 ' , and submit a set
of As-built plans for us to review.
Request #3 - Weld county pubic works needs to have letters from all the utility companies
stating that all their work has been completed and installed per spec. I personally told
Jim Scott this on April 23rd, and to date pubic works has not seen anything.
No collateral can be released until the above items have been done.

Subject: AmPF-354 Partial release requests
Jesse,
Shiloh Estates has once received a partial release of collateral (water lines) .
They now have 2 other requests in. The first was dated 3/19/07 for road culverts/swales,
and on 3/26/07 you indicated that they were not quite ok'd for release.
They are also now requesting, on 5/3/07, whether another release for telco, gas, and
electric could be released for $27, 523 (100% cost of these items) .
Could you please advise me whether one or both of these are OK'd for release?
