WALDBAUM COMPANY WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of December, 1984 , at the hour of 2 :00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Milton G. Waldbaum Company, 501 North Main, Wakefield, Nebraska 68784 , for a Use by Special Review for an egg production, processing and shipping facility on the following described real estate , to-wit: 34 J- Part of the E1/2, Section J2 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan. The Comprehensive Plan encourages the development of agribusiness and agriculturally oriented industry provided these enterprises do not adversely affect the local economy or environment. b. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an egg production, processing and shipping facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant and/or operator shall be required to obtain all applicable building or electrical permits for USR 655 : 84 : 51 . 4 . Prior to scheduling a hearing before the Board of County Commissioners, the applicant shall submit an erosion control plan, as approved by the Platte Valley Soil Conservation District, to the Department of Planning Services. 5 . Special Use Permit Number 90 : 71 : 6 shall be vacated. 6 . Prior to recording the mylar plat for Use by Special Review Permit 655 : 84 : 51 , the applicant and/or owner shall provide evidence that the proposed water wells are in compliance with the rules and regulations of the State of Colorado. Evidence of properly registered wells shall be submitted to the Department of Planning Services . 7 . The Use by Special Review mylar plat shall be revised to contain the facilities located at Special Use Permit #90 which the applicants will be operating as Use by Special Review #655 . The uses permitted shall be a poultry farm as described in the application materials on file with the Department of Planning Services. 2 . The maximum number of chickens , as described in the submitted application materials, shall be 750 ,000 . 2 . The applicant shall implement the erosion control plan approved by the Platte Valley Soil Conservation District. 4 . No run-off associated with the subject operation as allowed by the Use by Special Review Permit shall be allowed to flow off the property of the owner and/or operator onto the land of surrounding property owners without their written consent. 3 . All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 6 . Flies and fly breeding shall be controlled year-round. 7 . The applicant shall comply with the design standards for the -Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. B . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 9 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations . 10 . The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Btandar_ds . Section 35, T2N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 1.5 miles northeast of Hudson; north of 1-76 and west of Weld County Road 47 APPEARANCE: Eugene J. Ebner, General Manager, Milton G. Waldbaum Company, stated they are asking for replacement and expansion of their facility at -Hudson. He distributed twelve pictures of their -plant at Complex Two to the Planning Commission to show what the upgraded -plant would look like. The photographs were retained as evidence. They plan to replace the tall round buildings with low-profile st-eel buildings. Tape 181 - Side 2 They will also increase the number of birds to approximately seven hundred and fifty thousand. There will be no stockpile of manure; this will be removed daily. _Dead birds are also removed on a daily basis. There. should be no odor, or very little oder, associated with the operation of the upgraded facility. The plant will employee sixty to seventy-five full—time employees Grains used in the poultry feeds are bought from local farmers. Completed plans for improvement and expansion will take about two and one-half to three years and when _completed there will be twelve buildings. The Chairman asked Rod Allison to read the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff into the record. Rod Allison suggested Condition 5 be deleted and a new Condition #5 be added to read Special Use Permit Number 9-0: 71:6 be vacated. The Chairman called for discussion from the audience. William Albion Carlson, Attorney, representing Margaret Eichthaler, adjacent property, spoke in opposition of this request. He discussed -problems that may occur with odor, flies, dust, dead birds, noise and air pollution. Summary of the Weld County Planning Commission Meeting November 13, 1984 Page 3 Robert Ream, supplier of the equipment which will be installe-d in the new buildings, explained the design and operation of the equipment. He also explained that manure must removed daily as this is the way the equipment is designed to operate. Lee Morrison reported there is reference of the old facility in the new applicati-on. Where there is -some reference there can be some carry—over, but it is limited. Tape 182 — Side 1 Wes Potter, Director, Environmental Services, Weld County Health Department, reported they have had several complaints on the odor of manure that has been stockpiled, but it is his feeling once all the new buildings and new equipment has been installed this will no longer be a problem. Rod Allison suggested and new Condition #6 -be added to read as follows: Prior to recording the mylar plat for Use by Special Review Permit #655:84:51 , the applicant and/or owner shall provide evidence that the proposed water wells are in compliance with the rules and regulations _of the State of Colorado. Bob Eoiinski, employee, Everitt Lumber Company, stated he did not attend today's hearing for this mas-e, but he has been to Morning Fresh Farms unannounced and he saw no -flies and smelled no odor. It was this feeling this request should be approved. It would offer employment opportunities for residents of the area, a place for farmers to sell their grains, and would be a big improvement over the present facilities. Jeanette Arens and Margaret Eichthaler spoke in opposition to this request. Russell Riley stated he has visited the applicant's #2 facility this summer and found it very clean and odorless. Eugene Anderson, Representative, Hudson Chamber of Commerce, stated the Chamber ofCommerce is supporting this request. Jane La Porta, tenent for Margaret Eichthaler, adjoining property owner distributed pictures of the fly problems they have had from she old facility. The pictures were retained as evidence. She stated they really had no problem with the new facility if the fly and odor problems could be controlled. 4 Summary of the Weld County Planning Commission Meeting November 13, 1984 Page 4 Elmer Sobobel stated he has sold is grains to the applicant for several years now, and as a farmer, he welcomes a ready market for his crops. Jim Walters reported he lives one and one-half mile from the applicant's property. He has visited Morning Fresh Farms, and if the applicant could obtain this level of profieciency he would have no complaints regarding the proposed new facility. George Shaklee stated he is not against this proposal if the current site is cleaned—up and deoderized. MOTION: Stephen Hamilton moved Case Number USR-655:84:51 for Milton G. Waldbaum Company for a Use by Special Review Permit for an Egg Production, Processing, and Shipping Facility be forwarded to the Board of County Commissioners with the Planning Commission's recommendation _for approval based upon the recommendations, conditions, and operation standards as outlined by the Department of Planning Service-s staff with condition #5 amended to read Special Use Permit Number 90: 71:6 shall be vacated, and condition #6 to read as amended by the staff and on the testmony heard by the Planning Commission. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Jack Holman - Yes, because the town of Hudson's Planning Commission did recommend approval. It is an agricultural entity located in an agriculturally zoned area. Louis Rademacher - yes; Bill McMurray - yes; Stephen Hamilton - Yes, because the has been inside, and involved with newtechnology within these chicken houses and the odor tan and is being controlled. Paulette Weaver - Yes; however, she does want the people who objected to know that we do appreciate their comments, but we are looking at a new facility with a company that currently has an example that is apparently well run. Also, it is an agricultural area and the town of Hudson has recommended approval of this facility. Box 429 Hudson, CO 80642 ATTN: Mr. Gene Ebner Dear Mr. Ebner: After visiting with you on the site of your proposed expansion/rebuilding project, I would make the following recommendations. 1 ) The majority of the project is being constructed on the Osgood Sand soils. When left in a completely bare state this soil is highly sus- ceptible to wind erosion. Losses can range upward of 100 tons/acre/ year. By careful and proper management this loss can be reduced to less than 5 tons/acre/year, which is an acceptable level . 2) During construction, I would recommend keeping unsheltered (bare-open areas) distances to less than 200 feet. This could be accomplished by using straw bales and/or snow fencing to break up the large areas. Also, if water is available, the areas could be kept wet to control any soil blowing which might take place. 3) If any areas are to be left bare for extended periods I would recommend seeding some type of fast growing crop such as: annual ryegrass, winter or spring wheat or sorghum to provide a ground cover. Of course, if these fail to establish quickly, emergency measures such as in #2 above should be used. 4) After construction is completed, I would recommend seeding Crested Wheat- grass at a rate of 10# pure live seed per acre. All areas not in road- ways, etc. should be seeded as soon as possible. If the areas are fairly large I would recommend mulching the area with 4000# of straw per acre. The proposed sources of water for the operation are wells 26948F-A and 7289R. Well no. 26948F-A was issued as a non-tributary Laramie-Fox Hills well limited to 52 acre-feet. This quantity of water would not be enough for a poultry operation of 750,000 birds. The second source, well 7289R, is permitted and adjudicated for irriga- tion purposes. The well is currently being augmented by Central Colorado Water Conservancy District (CCWCD) for irrigation in accordance with the -Revised Rules and Regulations for the South Platte Basin. The use of well 7289R should be changed in the Water Court to reflect the proposed use and the well permit should also be amended to reflect the pro- -posed use. The applicant must also apply to Central Colorado Water Conser- vancy District to see if they will augment for the new use. The well cannot legally be operated for the egg production operation until the above changes are made. In summary, we can conditionally recommend full expansion subject to the applicant's changing well 7289R to the proposed use as discussed in the pre- vious paragraph. Present Method- Round Barns A. Manure scraped off cage tops into a manure pit locatea ir: one area of each barn, 3. Once a week this accmnulation of manure is removed frcm the barn by a rract.,r, loaded onto a truck and hauled to a stockpi'e. The local farmers come with their loaders and trucks and haul the manure to their field for spreading. C. Disad-:autages of this system. I. Manure is piled in a pit - it cannot dry out. 2. If (-dded water seeps into the pile, there develops both an odor and possible fly problems. 3. Stock pile is exposed to elements and loss of value as fertliz-er. 4. The water system for these -barns are known as "open trough" watering. This system's disadvantages are spillage and it gets dirty quickly. We can eliminate these problems -by replacing all the round barns barns with the new barns. II . New Manure Removal = New 3arns A. Each row of cages -has an endless belt under it. The -manure is voided by the birds in each cage onto this belt. B. Advantages of this system. 1. Manure is spread out over this belt and is exposed to the air. a. rhe air velocity is rated at 20 to 25 C.F.M. per minute or approximately 6 to 8 -miles -per hour. b. This air flow begins the -drying process of the manure at once. 2. Mere are no pits in the new barns. a. All manure is suspended on these endless belts which are cleaned daily. b. No piles of manure standing in the building. c. Dry manure reduces -odor and eliminates fly problems. 3. Daily this manure is conveyed out of -each barn and dropped directly into a waiting truck which takes the manure out to the fields -where it will be used. 4. _Sample manure - 7 of moisture taken: 5. Each day a licensed sanitation truck picks up all -mortalities in bags \ and deposits them in -a legally approved disposal -site. N No dead animals have been buried on this -property with my knowledge for over two years. Milton G. Waldbaum Company for a Use by Special Review for an egg production, processing and shipping facility. Lee Morrison, Assistant County Attorney, made this matter of record. Rod Allison, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record. He said the Planning Commission's recommendation included six conditions. Terry Baker, representing the Waldbaum Company, came forward to make a presentation. Eugene Ebner also -made a presentation for the Waldbaum Company. During these presentations there were several exhibits submitted to the Board. Others representing Waldbaum and coming forward to speak were: Ann Castle; Jeff Henning; and Robert Green. Margaret Eichthaler; Jane Carlson, Attorney; and Mike LaPorta; spoke in opposition to the proposed facility. Their main concerns were the odor and the flies. Those speaking in favor were L. J. Oster, Tom Torlifson and Elmer Kobobel. Wes Potter, representing the Health Department, also made comments concerning this matter. He said, in his opinion, the Operation Standards should be adequate to ensure that this facility is correctly operated. Mr. Allison said the Planning staff would like to recommend that an additional condition be added to read as follows: "The Use by Special Review mylar plat shall be revised to contain the facilities located at Special Use Permit #90 which the applicants will be operating as Use by Special Review #655." The applicant was agreeable to this added condition. Following discussion, Commissioner Johnson moved to approve Use by Special Review #655 for Milton G.
