Gentlemen,
The District has received the referral for the referenced Case No.,for facilities located at the
intersection of Weld County Road 14 and Weld County Road 19.The District has a 6"water
main located in Weld County Road 19 servicing the site with two one-inch(1")meters.
Due to the high hazard materials processed at this site,and in regards to updated State Health
requirements for backflow prevention and confined space entry,the District requires that the
metered connections to these facilities be retrofitted with a high hazard backflow prevention
device and an upgraded meter vault. The District will provide a drawing of the proposed
improvements and a cost for the installation of these improvements.
The District is concerned about the number of high hazardous materials pipe lines crossing its
water mains in a relatively short distance,increasing the potential for contamination of the water
in the line, We will require a vent be installed every 100 feet above our pipe line along the length
of frontage of the facilities at this location.
The District hereby informs you that the water system in this area may not provide adequate fire
flow.The local Fire Protection District should be contacted to determine the fire flow
requirements for this facility.A hydraulic study will be required to determine the amount of fire
flow available and the improvements needed to meet the required fire flow.The cost of this study
is$1,000.00.

any questions regarding the above,please advise.

Dear Mr. Ogle,
Thank you for the referral regarding the proposed Site Specific Development
Plan and Special Use Review for the Duke Energy Mineral Resource
Development Facility located at the intersection of WCR's 14 and 19. It is
understood that the proposal includes modernization upgrades to the existing
gas plant.
The portion of the proposed development located on the west side of WCR 19 is
within the Town's Planning Area and is eligible for annexation. This portion of
the development is also located within the Town's Community Buffer as
designated in the Town's Comprehensive Plan. As such, any development
within the Community Buffer requires special consideration to maintain contiguity
with the surrounding land uses and mitigate the impact of that development with
the intent of the Comprehensive Plan. Furthermore, a significant component of
the Land Use Code requires more intensive (industrial facilities) uses to be
screened from less intensive uses (open space).
Please note that since the development already exists, annexation will not be
required at this time. If and when the existing development significantly increase
its capacity or production, changes its configuration, or alters its use, it is likely
that the Town will require annexation. However, in light of the limited scope of
improvements that are proposed on the subject parcel, the Town requests that
the proposed improvements include measures to meet the provisions of Article 2

Development Standards of the Town's Land Use Code. This includes but is not
limited to fencing requirements, down cast lighting, significant landscape
screening with trees and shrubs, the application of muted earth tone colors, and
the like. Furthermore, please ensure that the site conforms to state noise and air
quality requirements with appropriate study's and mitigation measures, if
necessary.
Please note that the use of barbed wire is prohibited by the Town. Therefore, the
Town requests that an alternative fencing material be installed (with a pilaster
every 50 feet along the perimeter fence line of the property to comply with the
Town's other fencing requirements). If an alternative fence is not installed,
please apply a plastic coating to the chain link fence to soften its visual impact
and install enhanced landscaping for visual mitigation to buffer the less intensive
uses around the perimeter of the site.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 19 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
WCR 14 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot

There are three parcel associated with the proposed USR, Parcel No. 1 (easterly) Parcel No. 2 (west side
south parcel), Parcel No. 3 (west side north parcel). These are the parcels associated with the proposed USR
and I will refer to them throughout my comments.
REQUIREMENTS:
Parcel No. 1: Utilize all existing access points from WCR 14 and WCR 19 associated with the facility. The
main parking lot and adjacent office accesses from WCR 14.
Parcel No. 2: Utilize the south access point for the truck entrance and exit to the scale house and loading
facilities.
Parcel No. 3: Utilize the two entrance and exit gates from WCR 19 for the support trucking facility.
Parking Lots and Circulation: Utilize all existing parking lots and provide parking and circulation through the
three parcels. Utilize designated parking areas adjacent to office.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
The applicant shall complete a Weld County Road Access Information Sheet identifying all the existing and
proposed accesses to the facility.

Storm Water Drainage:
he applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE)
regulations regarding berming and spill prevention for materials and liquids stored on site.
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
Control Division regulations regarding storm water quality permitting and protection and construction storm
water discharges.

1. A building permit will be required for all new buildings on site. A building permit will also be required for
additional equipment that will require a foundation.
2. A plan review is required for each building. Plans will require the wet stamp of a Colorado registered
architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application.
4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review
5. Provide letter of approval from Fort Lupton Fire Protection District prior to applying for permits.
6. Building records do not show any outstanding permits on site based on the parcels supplied.

Environmental Health Services has reviewed this proposal for a natural gas processing
facility. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
2. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment.
3. The applicant shall submit an odor abatement plan for all Mercaptan storage or
injection sites for review and approval, to the Environmental Health Services,
Weld County Department of Public Health & Environment.
4. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
5. In the event any of the vehicle maintenance shop(s) are equipped with a floor
drain the following shall apply:
The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any vehicle maintenance facility located on the site that is equipped with a
floor drain. Alternately, the applicant can provide evidence that they are not
subject to the EPA Class V requirements.
6. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.

4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall operate in accordance with the approved "odor abatement
plan".
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in
the Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees
and patrons of the facility.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County
Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and
sanitary purposes.
11.AII potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimizes
the release of hazardous air pollutants (HAP's) and volatile organic
compounds (VOC's).
12.The operation shall comply with all applicable rules and regulations of the
State and Federal agencies and the Weld County Code.
