HomeMy WebLinkAbout20073832.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR MIGRANT/SEASONAL HEAD START PROGRAM AND AUTHORIZE CHAIR TO SIGN - WELD COUNTY SCHOOL DISTRICT 6 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for the Migrant/Seasonal Head Start Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County(FENWC),and Weld County School District 6, commencing September 21, 2007, and ending May 30, 2008, with further terms and conditions being as stated in said memorandum, and WHEREAS, after review, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for the Migrant/Seasonal Head Start Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County(FENWC), and Weld County School District 6 be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum. Speckman, Executive Director, Human /v Services SUBJECT: Memorandum of Understanding between FENWC Migrant/Seasonal Head Start Program and Weld County School District 6 Enclosed for Board approval before the Weld County Board of County Commissioners is a Memorandum of Understanding between Weld County School District 6 hereinafter referred to as School District and the Weld County Migrant/Seasonal Head Start Program hereinafter referred to as "FENWC." Memorandum of Understanding: School District and FENWC have obligations with respect to identifying and providing educational services to certain children with disabilities pursuant to the Individuals with Disabilities Education Improvement Act (IDEA), the federal Head Start Program, the Colorado Exceptional Children's Educational Act and the rules and regulations relating to them. The School District is responsible for locating, identifying and evaluating all children residing in its attendance area between the ages of birth to twenty-one(21)years who may have a disability and be eligible for special education services. FENWC is mandated to have a formal partnership agreement with School District concerning identifying and serving pre-kindergarten children with disabilities. FENWC and the School District have determined that it is in their mutual interests to define the services and procedures to be provided by each and to identify area of collaboration to ensure that available resources are used in the most effective manner. If you have any questions, please contact Janet Flaugher, Director, at 353-3800,pxtenSion 3340_ 2007-3832 MEMORANDUM OF UNDERSTANDING BETWEEN WELD COUNTY SCHOOL DISTRICT NO. 6 and FENWC HEAD START AND MIGRANT AND SEASONAL HEAD START This Memorandum of Understanding is by and between Weld County School District No. 6 ("School District") and the Family Educational Network of Weld County Head Start ("FENWC") and Migrant and Seasonal Head Start, operating under the auspices of the Weld County, Colorado, Department of Human Services (collectively "Head Start"). BACKGROUND INFORMATION A. School District and Head Start have obligations with respect to identifying and providing educational services to certain children with disabilities pursuant to the Individuals with Disabilities Education Improvement Act("IDEIA"), the federal Head Start Program, the Colorado Exceptional Children's Educational Act and the rules and regulations relating to them. B. School District is responsible for locating, identifying and evaluating all children residing in its attendance area between the ages of birth to twenty-one(21) years who may have a disability and be eligible for special education services. C. Head Start operates Head Start programs for children between the ages of six (6) weeks and five (5) years at approximately eight(8) sites within School District's attendance boundaries. D. Head Start is mandated to have a formal partnership agreement with School District concerning identifying and serving pre-kindergarten children with disabilities. E. Pursuant to C.R.S. §29-1-203, School District and Head Start are authorized to enter into intergovernmental Agreements regarding the provision of functions or services related to their obligations and responsibilities concerning children with disabilities. F. School District and Head Start have determined that it is in their mutual interests to define the services and procedures to be provided by each and to identify areas of collaboration to ensure that available resources are used in the most effective manner. NOW THEREFORE, in consideration of the mutual promises, covenants and agreements contained herein, the parties hereto agree as follows: 1 AGREEMENT 1. Incorporation. The foregoing Background Information is incorporated herein by reference. 2. Term. The term of this Agreement shall commence on September 21, 2007 and shall end on May 30, 2008, unless otherwise terminated as provided herein. This Agreement may be renewed annually for successive one year periods upon written consent of each party hereto. 3. Responsibilities of Head Start: Head Start agrees to: a. Recruit, enroll and serve children who are eligible under FENWC and the Migrant and Seasonal Head Start children, and to ensure that no less than ten percent (10%) of the total number of enrollment opportunities in these programs shall be made available for eligible children with disabilities. b. Screen children within two (2) weeks of enrollment to identify potential health problems and potential disabilities and/or developmental delays. c. Refer children residing within School District's attendance boundaries to School District and/or other appropriate community resources for purposes of evaluation for eligibility and planning for special education services. d. Participate with School District to promote the advertisement of community screening and evaluation involving all activities under School District's Child Find program. e. Participate in the development and implementation of an Individualized Education Plan ("IEP") for children enrolled in Head Start within School District's attendance boundaries who are eligible for services under Part B of the IDEIA or an Individual Family Service Plan ("IFSP") for children eligible for services under Part C of the IDEIA, and to assist in ensuring that all federal, state and local requirements related to such plans are met. f. Work collaboratively with School District to develop staff training opportunities to increase knowledge and ability to provide services to children with disabilities. g. Actively assist families of children with disabilities to access community resources for those children. 2 4. Responsibilities of School District. School District agrees to: a. Locate, identify and evaluate all children residing in the School District between the ages of birth to twenty-one (21)years, who may have a disability and be eligible for special education services, through community screenings (auditory, vision and developmental), using School District's screening team. b. Refer individuals who have been screened, when deemed appropriate by the screening team, for purposes of evaluation for eligibility and planning. The evaluation process shall include an assessment by a person with expertise in the individual's suspected area of disability, in accordance with the regulations promulgated by the Colorado Department of Education. c. Ensure that prior to said referral for evaluation, families receive appropriate Informed Consent forms, Procedural Safeguards information and other notice as required under federal, state and local law and regulations. d. When the foregoing referral for evaluation has been completed, determine eligibility for services under IDEIA, and when appropriate, develop and implement an IEP for students enrolled in Head Start and ensure that all applicable requirements related to such development and implementation are met, including without limitation, obtaining parental consent, convening an IEP team and providing notice of all meetings. School District will include appropriate Head Start staff in the development and implementation of the IEP. e. Provide special education and related services to eligible children enrolled in Head Start pursuant to such child's IEP. f. Work collaboratively with Head Start staff to implement specially designed instruction to meet the unique needs identified in a child's IEP, such as content, methodology and/or delivery of instruction. g. Work collaboratively with School District to develop staff training opportunities to increase knowledge and ability to provide services to children with disabilities. 5. Cooperation in Transition Planning. To provide for a smooth transition from the pre-school setting to a public school setting, School District and Head Start agree to undertake the following: 3 a. Prior to a child entering the public school setting, the appropriate Head Start staff and public school teachers will meet to share strategies. Transition Plans will be developed jointly by School District and Head Start at an IEP meeting or Annual Review at the time the child exits from Head Start to the School District. b. School District and Head Start will jointly provide information regarding changes in service delivery to parents. 6. Counting and Reporting. School District and Head Start will comply with the requirements of their respective systems with respect to counting and reporting on children receiving special education and related services. 7. Termination. Either party hereto may terminate this Agreement by giving 30 days prior written notice. 8. Relationship of the Parties. Nothing herein shall create or be construed as creating a partnership,join venture or agency relationship between the parties, and no party shall have the authority to bind the other in any respect. School District employees providing services hereunder shall be and at all times shall remain employees of School District and Head Start shall be and shall remain at all times Employees of Head Start. Accordingly, each party shall have the sole responsibility for paying the salaries of its respective employees providing services hereunder, including payment of all required withholdings, and it shall maintain such workers' compensation and unemployment insurance coverage as are required by the State of Colorado. 9. Confidentiality. During and after the term of this Agreement, all parties shall comply with the rules and regulations of the Health Insurance Portability and Accountability Act(HIPAA) and the Family Educational Rights and Privacy Act (FERPA) and any other applicable federal state or local laws and regulations concerning confidentiality. 10. Notices. Entire Agreement; Modification. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter contained herein, and it supersedes all prior and contemporaneous agreements, representations and understandings of the parties. No modification or amendment of this Agreement shall be binding unless executed in writing by all parties. 12. Binding Effect; Assignment. This Agreement shall be binding upon and inure to the benefit of the parties hereto, their successors and permitted assigns. Neither party may assign this Agreement without the prior written consent of the other party. 13. Severability. If any term or condition of this Agreement shall be held by a court of competent jurisdiction to be invalid, illegal or unenforceable, this Agreement shall be construed and enforced without such a provision to the extent this Agreement is then capable of being performed within the original intent of the parties. 5 IN WITNESS WHEREOF, the parties hereto have duly executed this Agreement.
