RE: GRANT REQUEST FOR EXTENSION OF SUBMITTAL OF SITE SPECIFIC
DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PF#1099-
SOARING SKIES VENTURES, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 5, 2006, by Resolution #2006-0738, the Board approved the
application of Soaring Skies Ventures, LLC, P.O. Box 1245, Fort Collins, Colorado 80522-1245,
requesting Change of Zone, PZ#1099,from the A(Agricultural)Zone District to the PUD(Planned
Unit Development) Zone District for nine (9) residential lots, for a parcel of land located on the
following described real estate, to-wit:
Lot B of Recorded Exemption #3685; being part of
the S1/2 of Section 5, Township 7 North, Range 67
West of the 6th P.M., Weld County, Colorado
WHEREAS, on October 20, 2006, the Department of Planning Services administratively
approved the application of Soaring Skies Ventures, LLC, P.O. Box 1245, Fort Collins, Colorado
80522-1245, requesting a Site Specific Development Plan and Planned Unit Development Final
Plan, PF#1099, for nine(9)residential lots with E(Estate)Zone uses,three(3)open space tracts,
and oil and gas production on 54.6 acres, and
WHEREAS, Timothy Hallopoff, Managing Member, on behalf of said applicant, has
requested an extension of the submittal of the Planned Unit Development Final Plat for recording,
as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be
submitted by October 20, 2008, and
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Department
of Planning Services, and, having been fully informed, finds that this request shall be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Soaring Skies Ventures, LLC, for an extension of the
submittal of the Planned Unit Development Final Plat for recording,as required by Sections 27-8-60
and 27-8-70 of the Weld County Code, on the above referenced parcel of land be, and hereby is,
granted, with said Final Plat to be submitted by October 20, 2008.

RE: Sorrel Ridge Final Plat Extension Request

The Sorrel Ridge(PF-1099) Final Plat was administratively approved by staff on October 20, 2006.
The plat has not yet been approved, pending the required Improvements Agreement and surety.
The applicant is requesting an extension to the normal 1-year deadline for recording a PUD final
plat, as required by Section 27-8-60. The same Section allows for the Board of County
Commissioners to extend this deadline, if the Board finds that the PUD has not been abandoned
and that the applicant possesses the willingness and ability to record the plat.
Staff recommends extending the deadline for recording the final plat to October 20, 2008.
The applicant indicates that they are working to receive a loan, and that it will be able to provide a
Letter of Credit, finalize the Improvements Agreement, and record the Final Plat within a year. The
applicant has also indicated that, with a slower real estate market, their timeline for completing the
improvements is not as aggressive as it had been earlier. These are reasonable explanations and,
as such, an extension is warranted.

RE: PF-1099, Sorrel Ridge Final Plat Extension
Dear Mr. Mueller,
I recently received an E-mail from you explaining that all of the requirements forfull approval of
the Sorrel Ridge PUD have been met in order to begin construction of the subdivision, except the
receipt of the collateral for improvements on behalf of Weld County. Soaring Skies Ventures,
LLC (SSV,LLC) is currently in the process of applying for the construction loan that will both
pay for construction of the improvements and post the Letter of Credit (LOC) to Weld County.
Due to the lengthy process involved in receiving this loan, SSV, LLC would like to request an
extension on the 1-year deadline placed on the Change of Zone Plat. SSV, LLC kindly asks the
Board of County Commissioners to grant a I-year extension on the Change of Zone Plat to allow
us time to procure ample funding to successfully post the needed LOC and finance the project
improvements. As soon as we have received our loan, it is our intent to post the LOC and
construct the improvements.
SSV, LLC thanks you and the Board of County Commissioners in advance for consideration and
granting this request.

Brad,
Dale Tanaka with North Valley Bank will be contacting you by end of next week to begin the surety process. I
believe that we are still O.K. on the 1-year mark from the approval of the Zone Change and thus plan to have
everything recorded and construction going by the end of April. I will make the two changes to the Landscape
Plan and PDF them over to you for your approval. Thank you for the response and rest assured that we are
intensely pursuing the recording and developing of Sorrel Ridge.

Subject: Sorrell Ridge surety
Tim,
Several months have passed since you submitted the mylars and other documents for Sorrell Ridge, so I
thought I'd better check with you on the last outstanding items.
On January 11 we discussed that the Letter of Credit (or other approved form of surety)was needed, so
that we could get Board approval of the Improvements Agreement and, with that, record the plat.
At this point, we have not received the surety, and the plat remains unrecorded. Please note that a Plat
must be recorded within 1 year of its approval by the Board.
The mylar and other documents (CC&Rs, etc.) are in-hand and ready for recording. There are, however,
two small corrections that should be made to the Landscaping Sheet. (We have already discussed and
resolved that this can be recorded as a paper copy and separate from the mylar plat.) The Landscaping
Sheet should be modified to include the file number in the title block (i.e., "PF-1099"), as well as the
Section, Township, and Range. Finally, the reference to "see detail sheet 17" should be removed, or
revised to say"see detail sheet 17 on construction drawings".

Hello
