RE: DESIGNATION OF THE SITE SELECTION AND CONSTRUCTION OF ARTERIAL
HIGHWAYS, INTERCHANGES AND COLLECTOR HIGHWAYS (INCLUDING PRIVATE
TOLL ROADS AND TOLL HIGHWAYS), MASS TRANSIT AND RAPID TRANSIT
TERMINALS, STATIONS AND FIXED GUIDEWAYS, AND AREAS AROUND ARTERIAL
HIGHWAYS, INTERCHANGES, COLLECTOR HIGHWAYS(INCLUDING PRIVATE TOLL
ROADS AND TOLL HIGHWAYS), MASS TRANSIT AND RAPID TRANSIT TERMINALS,
STATIONS AND FIXED GUIDEWAYS AS A MATTER OF STATE INTEREST
A public hearing was conducted on December 17, 2007, at 9:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner William H. Jerke, Pro-Tem
Commissioner William F. Garcia
Commissioner Robert D. Masden - EXCUSED
Commissioner Douglas Rademacher
Also present:
Acting Clerk to the Board, Elizabeth Strong
County Attorney, Bruce Barker
The following business was transacted:
I hereby certify that pursuant to a notice dated November 9, 2007, and duly published
November 14, 2007, in the Fort Lupton Press, a public hearing was conducted to consider the
designation of the site selection and construction of arterial highways, interchanges and collector
highways (including private toll roads and toll highways), mass transit and rapid transit terminals,
stations and fixed guideways,and areas around arterial highways,interchanges,collector highways
(including private toll roads and toll highways), mass transit and rapid transit terminals, stations and
fixed guideways as a matter of State interest. Bruce Barker, County Attorney, made this a matter
of record. Mr. Barker explained this hearing will allow the designation of certain areas and activities
by the Board, and regulations concerning those areas and activities. He stated the title is
essentially the language used in the State Statute regarding this matter. He further stated this is
a three step process, the first step was scheduling this hearing and performing proper notification,
which was done approximately one and one-half months ago, the second step is conducting this
hearing to complete the designations, and the final step is the direction to County staff to enforce
the regulations and to impose a moratorium, which will state there will be related applications until
the regulations are in place. Mr. Barker stated he mailed letters to the Colorado Department of
Transportation (CDOT) and to the Prairie Falcon Express Parkway, since it affects these groups
directly.
Sharon Krogan, citizen of Keenesburg, stated she appreciates the Board moving forward with
these regulations and she looks forward to seeing the process through for the business and
property owners in Weld County.
There were no representatives of CDOT or Prairie Falcon Express Parkway in attendance.

Commissioner Garcia moved to approve a Resolution with the matters as proposed by Mr. Barker.
The motion was seconded by Commissioner Jerke , and it carried unanimously. There being no
further discussion, the hearing was completed at 10:55 a.m.
This Certification was approved on the 19th day of December, 2007.
