HomeMy WebLinkAbout20071474.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR THE BUILDING HEALTHY MARRIAGES PROJECT (PROMOTING RESPONSIBLE FATHERHOOD) AND AUTHORIZE CHAIR TO SIGN - SUMMITVIEW COMMUNITY CHURCH WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Memorandum of Understanding for the Building Healthy Marriages Project(Promoting Responsible Fatherhood) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Education Network of Weld County,and the Summitview Community Church,commencing April 1,2007, and ending September 30,2007,with further terms and conditions being as stated in said memorandum, and WHEREAS,after review, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Memorandum of Understanding for the Building Healthy Marriages Project (Promoting Responsible Fatherhood) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Education Network of Weld County, and the Summitview Community Church be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum. SVCC will provide facilities to FENWC in which to conduct intake/assessment activities for SVCC Fatherhood program. SVCC will also recruit and refer candidates to FENWC for the Building Healthy Marriages program. SVCC will meet with FENWC quarterly to review progress on referrals and actions. FENWC Responsibilities FENWC will conduct intake/assessments for approximately 25 potential SVCC Fatherhood program participants and will also provide intake/assessment results from approximately 25 SVCC program participants who have signed a confidentiality waiver to SVCC. FENWC agrees to provide quarterly progress reports to SVCC on referrals and actions with SVCC fatherhood program participants. Term The term of this agreement between SVCC and FENWC shall be for the period beginning April 1, 2007 through September 30, 2007. G3AI3G3M Et 4) V 81 MI 1001 S2i3NOISSr NO3 A1Nil0O 013M 2007-1474 MEMORANDUM OF UNDERSTANDING BETWEEN SUMMITVIEW COMMUNITY CHURCH AND FAMILY EDUCATIONAL NETWORK OF WELD COUNTY BUILDING HEALTHY MARRIAGES PROJECT 171 This Agreement is made and entered into this o?3 day of illt 2007, between Summitview Community Church , hereinafter referred to ag SVCC, and the Family Educational Network of Weld County as the lead agency for the Department of Social Service's Building Healthy Marriages Project, hereinafter referred to as FENWC. WITNESSETH: WHEREAS, SVCC is the recipient of funding to provide the administration and delivery of a Promoting Responsible Fatherhood Grant; and WHEREAS, SVCC, as a requirement of the Promoting Responsible Fatherhood Grant, must conduct intake and assessment activities with potential participants and provide information to the University of Northern Colorado for the purposes of tracking and evaluation of the grant; and WHEREAS, FENWC, as the lead agency of the Department of Social Services' Building Healthy Marriages Project, is conducting intake and assessment activities with potential BHM participants; and WHEREAS, SVCC and FENWC wish to establish collaboration between Promoting Responsible Fatherhood and Building Healthy Marriages in the provision of services to the citizens of Weld County; and WHEREAS, SVCC, wishes to and is able to provide a referral source to FENWC for Building Healthy Marriages; and WHEREAS, SVCC and FENWC agree that Building Healthy Marriages staff have the expertise to conduct intake and assessment activities for Fatherhood Grant candidates and is willing to provide that information to SVCC; NOW,THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1. Term: The term of this Agreement between SVCC and FENWC shall be for the period beginning April 1, 2007 through September 30, 2007. 2. Geographic Areas To Be Served: Intake and Assessment services shall be provided to residents of Weld County, Colorado. 3. SVCC Responsibilities: a. SVCC will confer with Building Healthy Marriages staff regarding intake and assessment questions to assure that the questions meet the criteria of the SVCC Fatherhood program, b. SVCC will provide to FENWC Building Healthy Marriages any additional intake and assessment questions to meet the criteria of the SVCC Fatherhood program, c. SVCC will work with FENWC Building Healthy Marriages to develop any forms or protocols that BHM intake/assessment staff may need to use for the SVCC Fatherhood program, d. SVCC will refer candidates for the SVCC Promoting Responsible Fatherhood program to Building Healthy Marriages staff, e. SVCC will provide facilities to FENWC in which to conduct intake/assessment activities for the SVCC Fatherhood program, f. SVCC will recruit and refer couples to FENWC for the Building Healthy Marriages program, g. SVCC will meet with FENWC quarterly to review progress on referrals and actions. 4. FENWC Responsibilities: a. FENWC Building Healthy Marriages will conduct intake and assessment for approximately 25 potential SVCC Fatherhood program participants, b. FENWC Building Healthy Marriages will provide intake and assessment results on approximately 25 SVCC Fatherhood program participants who have signed a confidentiality waiver to SVCC, c. FENWC staff will provide quarterly progress reports to SVCC on referrals and actions with SVCC Fatherhood program participants. 5. Compensation: Both parties agree that FENWC will not charge SVCC for intake and assessment services provided for the SVCC Fatherhood program. The services will constitute an inkind contribution from FENWC to SVCC. 6. Modification of Agreement: All modifications to this Agreement shall be in writing and signed by both parties. 7. Assignment: This Agreement shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Neither party may assign any of its rights/obligations hereunder without the prior written consent of the other party. 8. Resolution of Disagreements: If a problem/disagreement should occur, the FENWC Director and SVCC Director should be notified immediately. If the problem/disagreement still can not be resolved, it will be taken to a higher authority in both agencies. 9. Applicable Law: FENWC and SVCC agree to follow policies and procedures in accordance with Federal and State regulations and other applicable laws and regulations. 10. Termination: This Agreement may be terminated at any time by either party giving thirty (30) days written notice and is subject to the availability of funding. 11. Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and may not be changed or modified. 12. Waiver or Immunities/Third-Party Liability: No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any position of this Agreement be deemed to have created a duty of care with respect to any persons not a party to this Agreement. 13. Non-appropriation: No portion of this Agreement shall be deemed to create an obligation on the part of FENWC, the County of Weld, State of Colorado, to expend funds not otherwise appropriated in each succeeding year. 14. Severability: If any section, subsection, paragraph, sentence, clause or phrase of the Agreement is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions. The parties hereto declare that they would have entered into this Agreement and each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared unconstitutional or invalid. 15. Assurances: a. SVCC agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. b. FENWC, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of SVCC, or its employees, while performing this Agreement. c. SVCC, its officers, and employees, shall not be held liable for injuries or damages caused by any negligent acts, or omissions of FENWC, or its employees, while performing functions as described in this Agreement. d. SVCC shall provide adequate liability and worker's compensation insurance for all of its employees, engaged in the performance of this Agreement, as required by the Colorado Worker's Compensation Act. Likewise, FENWC, by and through the Board of Weld County Commissioners, shall provide adequate Liability and Worker's Compensation Insurance for all employees of FENWC engaged in the performance of this Agreement. e. No officer, member, or employee of SVCC and no member or their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. f. SVCC understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Division of Human Services and the results provided to the Weld County Board of Commissioners. g. SVCC and FENWC assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, handicap, or nation origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement.
