RE: APPROVE PARTIAL CANCELLATION AND RELEASEOF COLLATERALFOR SHILOH
ESTATES,AMENDED PLANNED UNIT DEVELOPMENT FINAL PLAN, AMPF#354 -
JAMES AND CHERI SCOTT
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated May 10,2006,the Board approved the application of James
and Cheri Scott, 35236 Cornerstone Way, Windsor, Colorado 80550, to subdivide Lot 7, Shiloh
Estates, into 4(four) lots, fora parcel of land located on the following described real estate, to wit:
Part of Section 4,Township 6 North, Range 67 West
of the 6th P.M., Weld County, Colorado, and
WHEREAS,on November 6, 2006, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements(Private Road Maintenance), between the County of Weld,State of Colorado, by and
through the Board of County Commissioners of Weld County, and James and Cheri Scott with
terms and conditions being as stated in said agreement, and accepted check#1734, from Shiloh,
Inc., in the amount of$119,629.00, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and recommend partial release of said collateral, in
the amount of$26,195.30.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a portion of the collateral being held, in the amount of$26,195.30 be, and
hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Dear Mr. Muller,
This letter is to request the partial release of collateral for the waterline and fire
hydrants installation. As per our improvements agreement with the County the value of
these items are $30,818.00. Also as per our agreement 15% ($4,622.70) of the
collateral will be keep by the county as warranty collateral. Leaving $26,195.30 which
we do hereby ask be released to us. The form of our collateral was a cash deposit with
the county.

The Department of Planning Services has received a request for partial release of collateral for
Shiloh Estates PUD, 151 Amendment (File No. AmPF-354) in the amount of $26,195.30. This
request is being made after completion of the waterline and fire hydrants. Please see the attached.
Planning Services and Public Works have reviewed this request and support this partial release.

If you have written approval of installation from fire department and company for the water mains then Public
Works would support the release of collateral.
Let me know if you have any questions or concerns, and sorry for the late reply, I was on vacation last week and
forgot to notify the planning department. Whoops!

I have a written request from James Scott to release $26,195.30 of the collateral associated with Shiloh Estates,
1st Amd. (AmPF-354). The collateral is in the form of a cash deposit.
The release would be for the fire hydrants and the water mains ($30,818), less 15%. We received written
information from the fire department saying they are fine with the release.
If you give a positive response, I will schedule this request before the Board.

Re: Conditional Acceptance Shiloh Estates Lot 7 PUD
Dear Mr. Scott:
North Weld Water District hereby acknowledges that, as a result of visual inspection, receipt of
engineering documentation, construction, and installation of the water line at Shiloh Estates Lot
7 PUD, all requirements have now been met for conditional acceptance of water system
improvements as constructed for the Shiloh Estates Lot 7 PUD project located in the SE ''A of
Section 4, Township 6 North, Range 67 West.
As of the date of this letter, a two-year warranty period shall commence on the subject water line
improvements. The improvements are now also approved for service upon completion of a tap
application and payment of all fees, costs and expenses and/or dedication of water, if required.
During the two-year warranty period, any repair or maintenance of the improvements shall be the
responsibility of the developer. Please note that this approval is for water line improvements
only, which includes all delivery lines and lines up to the meters. Individual water service from
meters to each individual residence is not the responsibility of the District. Furthermore, please
note that such conditional acceptance does not extend to any associated soils compaction. Final
approval, dedication and acceptance of these improvements are then projected for February 20,
2009.

Re: Fire flow test at Shiloh Estates.
Man please be advised that the Windsor-Severance Fire Protection District performed a fire flow test on
the hydrant at approximately 35298 Cornerstone Way. Seth from your office and Jim Scott both
witnessed this test. The following results are from the test.
Static Pressure= 120psi
Flow Pressure= 78psi
Residual Pressure= 107psi
Flow= 1335 GPM
