ORDINANCE NO. 89-C
IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS, OF
SECTION 74 . 2 OF ORDINANCE NO. 89 , WELD COUNTY ZONING ORDINANCE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD
COUNTY, COLORADO:
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the power and
authority under the Weld County Home Rule Charter and Article 28
of Title 30 , CRS 1973 , to adopt zoning regulations for the
unincorporated areas of the County of Weld, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has adopted Ordinance No. 89 , the Weld County Zoning

Ordinance, with subsequent amendments, establishing a compre-
hensive revision of the zoning regulations and zoning maps for
lan• j the unincorporated areas of Weld County, and
WHEREAS , revisions to Section 74 . 2 are found to be necessary

in order to allow persons with existing structures, which are not
now in compliance with the setback requirements of the Weld
t z County Zoning Ordinance, to add to such structures in such a way
so as not to further diminish the setback so long as the
-- E. expansion or enlargement of such structure does not take place
within a right-of-way which is currently in use. This change

v, _ will allow a better balance between the rights of the individual
property owner and the public ' s right to use rights-of-way.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Weld County, Colorado, that Section 74 .2 of the
Weld County Zoning Ordinance is repealed and re-enacted to read
as follows:
"Expansion or enlargement. No such non-
conforming STRUCTURE or nonconforming portion
of a STRUCTURE may be expanded, enlarged, or
altered in a way which increases its non-con-
formity, except that those STRUCTURE (S) that
are nonconforming by reason of noncompliance
with existing SETBACK requirements may be

expanded or enlarged so long as such
expansion or enlargement does not further
diminish the nonconforming SETBACK. No
expansion or enlargement of STRUCTURE (S)
shall be allowed within an existing
right-of-way. "
The above and foregoing Ordinance was, on motion duly made
and seconded, adopted by the following vote on the 2Rth day of
March , A.D. , 1983 .

A public hearing was conducted on February 23 , 1983 at 2:00 P. M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 17, 1983,
duly published January 20th, 1983 and February 10th, 1983 in the LaSalle
Leader, a public hearing was held on the request of the Weld County
Planning Commission for a repeal and reenactment, with amendments, of
Section 74.2 of the Weld County Zoning Ordinance #89. There were no
contents in favor or in objection to the amendments as presented.
Mr. Morrison read Ordinance #89 C into the record. Mr. Morrison
added that the notice of publication contained a clerical error.
In the amendment there should have been a comma rather than a period
after the word'honconformity' and the next word%%xcept should not
be capitalized. Mr. Allison asked that Ordinance #89 C be corrected
in the amendment to read'honconforminq instead of'bonforminli; and
the words "structures" and"setback' be capitalized After discussion,
Camnissioner N. Carlson moved to approve the first reading as corrected
and directed the Clerk to the Board to publish same. Commissioner
Martin seconded the motion and it carried unanimously.
