Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or the physical availability of water.
According to the submitted information, the site will be served by a proposed well.
The applicant filed a well permit application on February 2, 2007 to construct a well for
commercial purposes. That well permit application has not yet been evaluated by the State
Engineer's Office, therefore, it is unknown if there will be any issues with the applicant
obtaining a permit to construct the proposed well.

1. A building permit shall be obtained prior to the construction of buildings or structures including the office building.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of
a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently
the following has been adopted by Weld County:2003 International Building Code;2003 International Mechanical Code;
2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2005 National Electrical Code and
Chapter 29 of the Weld County Code.
4. The office will require an engineered foundation based on a site-specific geotechnical report or an open hole
inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado
registered engineer.
5.The buildin will probably be classified as B(Office)occupancy.The office and bathrooms will need to be accessible to
persons with disabilities. Fire resistance of walls and openings, construction requirements, maximum building height
and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the
Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured
in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback
requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the
farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior
to the first site inspection.
7. Provide letter of approval from Platteville Fire protection District prior to placing of any structure.
8. There are no historical building permits on record for this parcel.

The Sheriffs Office recommends the following improvements for this business:
1. Mail distribution for the business should be limited to as few locations as possible with a central
drop off location within the property. It should be developed so that employees do not have to
cross a county road to obtain their mail.
2. A permanent sign should be placed at the entrance to the property that meets the planning and
zoning standards and is approved by the county commissioners, detailing the name of the
business, address, and a graphical presentation of the roadways within the property. There
should be a plan developed to maintain this sign.
3. A plan should be developed to maintain roadways on the property, especially during
inclement weather conditions for emergency vehicles.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Thank you for the opportunity to comment on this project. Our goal at the Colorado Division of Wildlife(CDOW)
is to provide complete,consistent and timely information to all entities who request comment on matters within our
statutory authority and our mission-which is to protect, preserve,enhance and manage wildlife and their
environment for the use, benefit,and enjoyment of the people of Colorado and its visitors.
District Wildlife Manager Chris Mettenbrink recently visited the project site located at S2 SE4 of Section 30, T3N,
R65W of the 6th P.M., Weld County, Colorado. The site is comprised of high quality wildlife habitat composed of
native grasses and shrubs that are utilized by many species of wildlife. The wildlife that would be expected to use
this site on a regular basis includes songbirds, small mammals,mule deer,and various species of raptors. Wildlife
utilize native grasses and shrubs for cover,forage, and as movement corridors across the landscape.
The two main impacts from the development of this oil and gas support facility include the permanent loss of
wildlife habitat and fragmentation. The addition of the oil tanks,buildings,and the road to the facility all contribute
to habitat loss and fragmentation.
Fragmentation of wildlife habitat has been shown to impede the movement of wildlife across the landscape. The
areas of wildlife habitat which most closely border human development show heavier impacts than do areas on the
interior of the open space. However, when open space areas are smaller in size,the overall impact of the
fragmentation is greater(Odell and Knight, 2001). By keeping open space areas contiguous and of larger size,the
overall quality of the wildlife habitat will increase dramatically.
The CDOW recommends that the oil tanks and buildings be clustered around the existing oil well that is located in
the northwestern portion of the property. We also recommend that the developer use an existing access road that
runs along the fence on the north side of the property. This road or trail can be accessed through an existing gate in
the northeastern portion of the property from Weld County Road 39.

The clustering of the oil tanks and buildings around the existing oil pad will reduce habitat fragmentation on the
landscape and reduce disturbances to wildlife. The goal of the CDOW is to maintain large contiguous areas of open
space to preserve habitat to allow sensitive species to reside in these areas and allow unimpeded movements of
wildlife through the area.
The spread and control of noxious weeds on the site is also a concern for wildlife. The Colorado Division of
Wildlife recommends that consideration be given to using principles of an integrated weed management plan which
Weld County may already have in place. Invasive plants endanger the ecosystem by disturbing natural processes
and jeopardizing the survival of native plants and the wildlife that depend on them. The threat is so severe in the
United States that scientists now agree that the spread of invasive species is one of the greatest risks to biodiversity.

Environmental Health Services has reviewed this proposal for an Amended Site Specific
Development Plan and Special Review Permit for an Oil and Gas Support Facility
(Brinewater Disposal) in the A (Agricultural) Zone District. We have no objections to the
proposal; however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. All required Air Emissions Permits must be obtained from the Air Pollution
Control Division, Colorado Department of Public Health and Environment.
2. A Ground Water Monitoring Plan shall be submitted to the Weld County
Health Department of Public Health and Environment for review and approval.
3. If appropriate, a Storm Water Discharge Plan shall be submitted to the Weld
County Department of Public Health and Environment and Colorado
Department of Public Health and Environment for review and approval.
We recommend that the following requirement be met prior to receiving final approval of
building permits:
1. A concrete secondary containment structure (floor and walls) surrounding
each tank or battery of tanks shall be constructed. The volume retained by
the structure shall be 150% greater than the volume of the largest tank inside
the structure. A registered professional engineer shall design the structure.
The structure shall prevent any release from the tank system from reaching
land or waters outside of the containment area. The operator shall provide
evidence from the engineer to the Weld County Department of Public Health
and Environment and Planning Services that the structure has been
constructed to meet this criterion.

2. A detailed design of the "concrete unloading pad" shall be submitted to the
Weld County Department of Public Health & Environment shall be submitted
for review and approval. The design shall demonstrate how all spilled waste,
stormwater, and wash down water will be contained within the receiving area
and concrete sump. The design shall also include the method in which
seams will be sealed to prevent leakage through the pad. The "concrete
unloading pad" shall be constructed and operated in accordance with the
approved design.
3. The applicant shall submit evidence to the Weld County Departments of
Public Health and Environment and Planning Services and the Colorado Oil
and Gas Conservation Commission that the facility was constructed in
accordance with the application materials.
4. A copy of the drilling log shall be submitted to the Weld County Department of
Public Health and Environment.
5. A permitted individual sewage disposal system shall be installed to serve the
facility. In accordance with the Weld County ISDS Regulations, the system
must be designed by a registered professional engineer. The design must be
submitted to the Weld County Department of Public Health and Environment
for review and approval prior to installation.
6. Solids and sediment will accumulate in the storage tanks. The facility shall
submit a detailed plan that describes the method those solids will be
removed, including all on-site handling procedures. The plan shall provide a
commitment to notify the Department of Public Health and Environment, in
writing, in the event the plan is amended. The plan shall be reviewed and
approved by the Department of Public Health and Environment.
7. A detailed closure plan shall be submitted to the Department of Public Health
and Environment and the Colorado Oil and Gas Conservation Commission.
The closure plan shall include a description of the manner in which the well
will be plugged and abandoned, as well as specific details regarding
reclamation of the property. No structures or equipment associated with the
facility shall remain on the property following closure.
8. The facility shall post financial assurance with the Colorado Oil and Gas
Conservation Commission (COGCC). The financial assurance shall be
adequate to cover a third-party closure of the facility, including the plugging
and abandonment of the well, in accordance with industry standards, and the
removal of all structure (including concrete) on the facility. The site shall be
returned to its original grade. In the event the COGCC does not have the
authority to require financial assurance for the entire cost required for third-

party closure, the facility shall post the remainder of the financial assurance
with Weld County. The facility shall submit evidence to the Weld County
Departments of Public Health and Environment and Planning Services that
the appropriate financial assurance has been obtained.
9. Provide evidence to the Weld County Department of Public Health &
Environment that a well has been appropriately permitted and dug to provide
for sanitary use for the facility.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. The facility shall be constructed and operated to ensure that contamination of
soil and groundwater does not occur.
2. A manager, knowledgeable in operating an injection well, shall be on site
when the facility is receiving waste.
3. An adequate sewage disposal system shall be available on the facility
premises.
4. A safe and adequate fresh water supply shall be available on the facility
premises.
5. No disposal of waste other than Class II, as defined by the Environmental
Protection Agency, is permitted. Any changes from the approved Class II use
would require an amendment to this Special Review permit.
6. Any wastes generated on the facility shall be disposed in accordance with the
Colorado solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate
rule, regulation, or law.
7. The maximum permissible noise level shall not exceed the industrial limit of
70 dB(A), as measured according to Section 25-12-102, CRS.
8. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
9. All chemicals stored on-site must be in locked buildings, on an impervious
surface, provided manufacturer recommendations for safe storage and
handling are in accord. In any event, manufacturer recommendations will
take precedence.
10. The facility shall comply with any required air emissions permit from the Air
Pollution Control Division, Colorado Department of Public Health and
Environment.

11. All liquid wastes received at the facility shall be unloaded on the unloading
pad. The concrete unloading pad shall be cleaned at a frequency that
prevents oils and other wastes from building up on the pad. At a minimum,
the pad shall be washed daily, with a jet hose to remove any waste build-up.
During winter months, the facility shall maintain the unloading pad free of ice.
12. Any analysis of waste shall be forwarded to the Weld County Health
Department, Environmental Health Services Division. The Division reserves
the right to require additional, more extensive monitoring at a later date.
13. The facility must comply with the laws, standards, rules and regulations of the
Air Quality Control Commission, the Water Quality Control Commission, the
Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas
Conservation Commission, any other applicable agency, and all applicable
Weld County zoning laws and ordinances.
14. Any liquid or solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
15. Any petroleum-contaminated soils on the facility shall be removed, treated or
disposed in accordance with all applicable rules and regulations.
16. The property owner or operator shall be responsible for complying with all of
the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.
17. The facility shall comply with the approved groundwater monitoring plan.
18. All storm water, which has come into contact with waste materials on the site,
shall be confined on the site. In the event that storm water is not adequately
controlled on the site, upon written notification from the Weld County
Department of Public Health and Environment or the Colorado Department of
Public Health and Environment, a comprehensive site-wide storm water plan
shall be developed and implemented. The plan must be approved, in writing
prior to implementation by the Weld County Department of Public Health and
Environment and the Colorado Department of Public Health and Environment.
19. All contaminated soils shall be stored on an impervious surface where any
stormwater that comes into contact with the soils would be contained.

The Weld County Public Works Department has reviewed this proposal. Our comments
and requirements are as follows:
COMMENTS and REQUIREMENTS:
A Recorded Exemption application for this property is currently in house for review (RE-
4612). The applicant is proposing to split the 80-acre lot into two lots. Lot A (the subject
of this USR) comprises the eastern 34.5 acres while Lot B is proposed as the remaining
45.5 acres (approximately). Both lots are proposed to have Ag/Oil & Gas use.
Weld County Public Works Department is requiring additional detail as follows:
• Entrance detail showing acceleration/deceleration lanes and left-turn lane, if
required, along WCR 39.
• Circulation and parking plan.
Weld County Road Classification Plan (FHU):
External Roads: WCR 39 borders the site on the east and is a collector road. It
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. This road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from
the future right-of-way line.
The applicant shall verify the existing rights-of-way and the documents creating the
rights-of-way shall be noted on the plot plan map. Other utility easements must be
shown on the map. The proposed improvements should be located in a manner as to not
encroach or limit the use of these easements or rights-of-way.
Internal Roads and Parking: The proposed access and internal roads must be built to
accommodate the amount and weight of trucks using the site.
Off-street parking spaces including the access drive shall be surfaced with gravel,
asphalt, concrete or the equivalent and shall be graded to prevent drainage problems.

All parking for this site must be off street and internal and delineated on the plot plan
map. Each parking space shall be equipped with wheel guards or curb blocks to prevent
vehicles from corning into contact with walls or other structures.
Rights-of-way/Easements: The applicant shall dedicate an additional 10-foot right-of-
way parallel to the WCR 39 right-of-way for future build-out.
There is presently 30 feet of right-of-way along the south edge of section 30, T3N,
R65W. No right-of-way exists along the north edge of section 31, T3N, R65W.
The applicant is proposing a 40-foot easement across Lot A for the benefit of Lot B on
case RE-4612. This easement shall be granted by plat. Section line accesses are
considered private lanes with no county maintenance.
Access: The proposed access drive to WCR 39 shall be paved for a distance of 50 feet
from the existing edge of pavement to minimize damage to the road.
The proposed access shall be placed in such a location to have adequate sight distance
in both directions and not below the crest of a hill or where physical obstructions are
present.
A minimum radius of 40 feet is required for all access points to the public right-of-way
(Chapter 8, Appendix 8-B of the Weld County Code).
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's
minimum size requirement. If the applicant chooses to place a larger culvert, please
contact the Public Works Department to adequately size your culvert.
Storm Water Drainage: The historical flow patterns and run-off amounts will be
maintained on site in such a manner that it will reasonably preserve the natural character
of the area and prevent property damage of the type generally attributed to run-off rate
and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide
accordingly for best management practices.
The applicant is required to comply with all Colorado Oil and Gas Conservation
Commission (COGCC) rules and regulations including drill pad construction, storm water
controls, and reclamation.
General Requirements: Pursuant to Chapter 15, Articles I and II of the Weld County
Code, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds.

Kim,
After a site assessment and review of the comments Public Works would like to see the following
changes/requirements for staff comments:
Please make the following changes to summary sheet and development standards:
1. Prior to recording the plat C.4: Based on background traffic and future use of the site the applicant will be
required to add acceleration/deceleration lanes and a left turn lane to WCR 39. A detail of the entrance and
with the improvements shall be delineated on the plat. —We can make a suggest to the applicant to use a
similar design to the one provided for USR-1522
2. Prior to recording the plat C.7: change to: The applicant shall delineate the proposed access drive to WCR
39. The internal drive shall be paved and provide adequate access to the parking for the office building.
3. Development standard 23: Access to the site shall be from WCR 39. The designated haul route shall be
on WCR with the agreement 1 mile north on WCR 39 and extending 1 mile east on WCR 28. Transport
trucks weighing up to 40 tons will visit the site approximately 60-70 times daily and less on weekends.
Please add the following comment where appropriate: The proposed entrance design to the site causes safety
issues regarding vehicle staging and sight distance. The applicant shall submit a new design with the entrance
having the approach at a 90°angle to WCR 39 for a minimum distance of three (3) truck lengths.
All the other comments look appropriate.
