The applicant for USR-1591, Gib Smith has addressed the following items prior to scheduling a Board of
County Commissioners hearing:
I. The applicant has not delineated any on-site sign(s). If on-site sign(s) are
desired the Department of Planning Services shall be notified in writing. If the
applicant does not notify the Department of Planning Services, the sign shall
adhere to Section 23-4-90.A and .B of the Weld County Code. Furthermore, the
location of the sign, if applicable, shall be delineated on the USR plat. The
applicant has indicated in a letter dated 4/4/07 that no signs will be on the
property. hex . b-E)
II. The applicant shall either submit a copy of an agreement with the property's
mineral owner/operators stipulating that the oil and gas activities have been
adequately incorporated into the design of the site or show evidence that an
adequate attempt has been made to mitigate the concerns of the mineral
owner/operators. Drill envelopes can be delineated on the plat in accordance
with the State requirements as an attempt to mitigate concerns. The plat shall be
amended to include any possible future drilling sites. Daniel Casper a Senior
Staff Landman with KerrMcGee stated in a letter dated 3/2/07 that Kerr-
McGee wishes to withdraw the protest that it filed to the application. The
applicant has also obtained a letter from the mineral owner Rolland,
Johnson dated 1/19/07 that he has no concerns with the proposal. (Et. it-G.')
III. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use. Evidence of such shall be
submitted to the Weld County Department of Planning Services. The applicant
has obtained a commercial well permit number 65302-F. (Et. ( -A)
IV. The applicant shall submit a Landscaping/Screening Plan to the Weld County
Department of Planning Services for review. The plan shall include a list of
landscaping materials and their size. The applicant has proposed a 6'privacy
fence with 29 gage 3' tuff rib panels. (Et. L- H)
V. The applicant shall address the remaining conditions for RE-4015 and record the
plat. The plat for RE-4015 was recorded on 3/22/07.
