RE: ACCEPT OFFER OF THE TOWN OF PLATTEVILLE TO RENT OLD GRADER
SHED LOCATED IN PLATTEVILLE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Weld County owns a grader shed located in the Town
of Platteville, and
WHEREAS, the Town of Platteville has offered to rent said
shed with an option to purchase, said rental rate being $20. 00
per month plus the payment of utilities, and
WHEREAS, the Weld County Engineer has informed the Board
of County Commissioners that the grader shed is not currently
being used by the County, and
WHEREAS, the Weld County Engineer recommends that an apprai-
sal be obtained on said shed before any decision is made concerning
the selling of the building and that the offer of the Town of
Platteville to rent the shed at the rate of $20 . 00 per month plus
the payment of utilities be accepted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the offer of the Town
of Platteville to rent the grader shed located in Platteville
at the rate of $20. 00 per month plus the payment of utilities be,
and hereby is, accepted until an appraisal can be made and until
and determination can be made as to the selling of said shed.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
June, A.D. , 1980.

GRADER SHED LEASE AGREEMENT
THIS AGREEMENT, made and entered into this 1st day of
July , 1980, by and between the COUNTY OF WELD,
hereinafter referred to as Lessor and the TOWN OF PLATTEVILLE,
hereinafter referred to as Lessee.
WITNESSETH:
That for and in consideration of the rental herein agreed
to be paid by Lessee to Lessor, and the convenants and agreements
herein agreed to be kept and performed, Lessor hereby leases to
Lessee for the term hereinafter designated, the following described
property:
Lot Ten (10) , in Block Seven (7 ) , in
the Town of Platteville, according to
the recorded map or plat thereof.
Section 1 - Term.
The term of this Lease shall be from the date first set out
above in this Agreement, to and until the 1st day of January, 1981.
Section 2 - Rental.
Lessee agrees to pay as rental for said property and improve-
ments thereon during the term of this Lease the sum of Twenty
Dollars ($20 . 00) per month, for each and every month this Lease
Agreement is in effect. The monthly payment shall be paid in
advance without notice on the first day of each and every month.
Section 3 - Security Deposit.
Lessee will deposit with Lessor the sum of $100. 00, which
sum shall be retained by Lessor as security for payment of rent
and for the faithful performance of all terms , conditions and
covenants of the Agreement including, but not limited to, pay-
ment of utilities. If, at any time during the term of this
Agreement, Lessee is in default in the performance of any pro-
vision of this Lease, Lessor shall have the right to use the
security deposit, or so much thereof, as is necessary, for the
payment of any rental in default, for payment of any damages
incurred by Lessor by reason of Lessee 's breach of this Agreement,
or for any other reason permitted by law.
Section 4 - Notices.
All notices required to be given to Lessor hereunder shall
be in writing and sent by certified mail to : Weld County Engineer,
Weld County Centennial Center, 915 10th Street, Greeley, Colorado
80631 . All notices required to be given to Lessee hereunder shall
be in writing and sent by certified mail, addressed to: Town
of Platteville, Town Hall, Platteville, Colorado 80651; pro-
vided that the parties, or either of them, may designate in
writing from time to time, subsequent or supplementary persons
or addresses in connection with said notices. The effective
day of service of any such notice shall be the date such notice
is mailed to Lessee or Lessor.
Section 5 - Insurance.
During the term of this Lease, Lessor shall obtain and main-
tain appropriate insurance coverage on the building. Lessee
shall obtain and maintain appropriate insurance on all property
owned by him, and sufficient liability insurance.
Section 6 - Non-Liability.
Lessor shall not be liable for loss or damage to any pro-
perty of Lessee or of Lessee' s agents , employees or guests at
any time located in the leased premises or on or in the lands
and buildings constituting the same, whether due to theft or
suffered by reason of fire, water, rain, hail, lightning, explo-
sion or any other cause. Further, Lessor shall not be liable
for any injury to Lessee or other persons, from any cause re-
lating to the leased premises.
Section 7 - Utilities.
All utilities supplied to the demised premises shall be
paid for by Lessee.
Section 8 - Use of Premises.
Lessee agrees to use the premises solely for municipal
storage purposes.

Section 9 - Maintenance of Premises.
Lessee shall, at his sole expense, keep and maintain the
leased premises and appurtenances in good and sanitary condition
and repair during the term of this Lease.
Section 10 - Indemnification.
Lessee covenants and agrees that it will indemnify and save
harmless, Lessor from all demands, claims, costs , cause of action
or judgments and from all expenses that may be incurred in inves-
tigating or resisting the same, arising from or growing out of
any act or neglect of Lessee, its contractors, agents, employees,
invitees, servants, sub-tenants , successors or assigns in con-
nection with its occupancy, or their occupancy or any portion
of the leased premises.
Section 11 - Waivers.
No waiver or default by Lessor of any of the terms , covenants
or conditions hereof to be performed, kept and observed by Lessee,
shall be construed as or operate as a waiver by Lessor of any
subsequent default of any of the terms, covenants or conditions
herein contained to be performed, kept and observed by Lessee.
Section 12 - Default.
Should Lesse fail, refuse, or neglect to pay the rent as
herein provided, or should Lessee breach any of the terms and
conditions of this Lease Agreement, Lessor shall become entitled
to repossess the demised premises upon giving Lesse notice of
such breach in writing at least three (3) days in advance. If
at the end of such three (3) day period, following the service
of said notice, such breach has not been remedied and Lessee
should refuse to vacate the premises, Lessor may use such remedy
as it may deem fit under the circumstances to reposses the same,
with or without process of law.
Further, if Lessee abandons the leased premises, Lessor
may, at its option, cancel and terminate this Lease Agreement
or may without terminating the Lease Agreement, enter upon and
take possession of the leased premises with or without process
of law, without liability for trespass.

IN WITNESS WHEREOF, the parties hereto have caused this
Lease Agreemet to be executed as of the day and year first
above written.

Dear Mayor Hiatt:
By resolution, the Board of Weld County Commissioners has authorized the
Chairman to sign the enclosed Lease Agreement covering our Platteville
grader shed until a determination is made on the possible sale to the
town of Platteville. You are requested to sign both copies, and return
one copy to this office.
In the meantime, an appraisal on the property is being made by the County
for purposes of negotiating a fair and equitable sale price. It is recom-
mended that Platteville do the same.
You may contact Mr. Dave Becker, Maintenance Section Head, at 356-4000,
extension 777 for arranging access to and a joint inspection of the property
with your representative. .
