WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 1st day of June, 1981 at the hour of 9: 30 o' clock a.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Art' s Fertilizer Company, 5601 York Street, Commerce City, Colorado 80022 for the granting of a Special Use Permit for an open cut mine/borrow pit on the property described below, and Part of the SE4 of the SW41 Section 1, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado. WHEREAS, the petitioner was present, and WHEREAS, the petitioner presented evidence in support of the grant of the Special Use Permit on the above described real estate, and WHEREAS, Section 3. 3.E. (2) of the Weld County Zoning Resolution authorizes such a use in the Agricultural District subject to the additional requirements of Section 6. 1 (3) of the Weld County Zoning Resolution and upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studdied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for an open cut mine/borrow pit permit on the above described real estate conforms to the purposes of Section 3. 3.E. of the Weld County Zoning Resolution and the requirements 810209 . p of Section 6. 1 (3) of said Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for an open cut mine/borrow pit permit on the above described parcel of land, be and hereby is granted, subject to the Development Standards read into the record June 1, 1981. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated April 7, 1981, be and hereby are, incorporated into this Resolution as the findings of fact and conclusions of law of the Board of County Commissioners in this matter. The uses permitted on this site shall include the extraction of sand as described in the application materials and all other uses permitted by right in the Agricultural Zone District. 2. No excavation or processing of materials shall be permitted nearer than ten (10) feet tot he boundary of adjacent property, easement or 'irrigation ditch or right-of-way, nor nearer than 125 feet to any existing residence, . unless by written agreement to the owner of owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance. 3. All extraction operations shall be conducted during the hours of daylight, except incases of public or private emergency, or to make necessary repairs to equipment. This restriction shall not apply to the operation of admin- istrative and executive offices or repair facilities if located on the property. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 5. Existing trees and ground cover along public road frontage and drainage- ways shall be preserved, maintianed and supplemented if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust and erosion. 6. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100,000.00 against liability for any negligent act or omission by the operator from the operation, maintenance, extraction, and/or production of the sand and shall include all activities connected with or incidental thereto. 7. All phases of the operation shall comply with all applicable County, State and Federal Health Standards and Regulations and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 8. No stockpiling shall be allowed on the Special Use Permit area which would cause damage to adjacent properties or county road right-of-way by altering the historic drainage pattern. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operations Standards stated above and all applicable Weld County Regulations. Additionally, our office would like to know if Mr. Suppi has ever contacted the State Mined Land Reclamation Board concerning his soil moving activities for it's determination as to whether or not Mr. Suppi is conducting a "mining" operation as defined in 34-32-103, C.R.S. 1973, as amended. Members wer resen : Alan Sandberg , Chairman , Jesse Cretto , Larry McCor e , John Struck , and Loren Willie . Therewere no absences . On a motion by Jesse Cretto , second by John Struck , minutes were approved as read with the correction that Larry McCorkle was not present at the meeting of the 24th. A report was given on the status of Colo . Landfill Inc. John Davis , adjacent property owner requested that he be informed as to when it would come before the commissioners . A Weld Co . referral that requested a Special Use Permit for an oper pit cut mine was reviewed. Applicant was not present Loren Willie voiced concerns over the condition of Road 35 . Others noted 52 was in bad condition . Rd . 35 is narrow , heavily traveled and in extreamly poor condition . The heavy weights and number of vehicles g nerated by the project would further accelerate the deteriation of the road and pose safety hazards . Alan Sandberg made a motion that the proposed method o- removing the sand is fine but that Weld Co . should be informed that the narrow , poorly maintained roads are inadequate and that the proposed use , and the heavy weight trucks , would increase the deteriation of the roads , thus creating safety hazards . Therefore , provisions should be stipulated that would alleviate this situation . Jesse Cretto seconded the motion and it was unamiously passed. I-iformation was given on the Pre-Retirement Program . Jesse Cretto and Loren Willie will approach individuals within the bJsiness community for support on this workshop . The decision to charge for the buffet will be dependent upon their success . A presentation on the Sakata zoning request was given . The hearing was to rezone the land from Weld Co . agricultural to industrial . Jesse Cretto made a motion to recommend that the City Council approve the Sakato request to rezone the land to 1-2 "industrial , as submitted . The subsoil is a brown to light yellowish brown fine sandy loam about 20 inches thick. The substratum, to a depth of 60 411 inches, is a sandy loam or loamy sand. Permeability is moderately rapid. Available water capacity is mod— erate. - Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. This soil is suited to limited cropping; intensive cropping is hazardous because of wind erosion. The cropping system should be limited to close grown crops such as alfalfa, wheat and barley. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch- grass, sideoats grama and western wheatgrass are also prominent. Po- tential production ranges from 2200 pounds per acre in favorable years 41 �.. to 1800 pounds per acre in unfavorable years. When range condition , deteriorates, sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase . Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass, switch- grass, sideoats grama, blue grama, pubescent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean, firm, sorghum stubble-prepared seedbed and grass drill should be used. Wildlife is an important secondary use, with these soils best suited for openland and rangeland wildlife.
