RE: APPROVE ADDENDUM TO AGREEMENT TO PURCHASE RESIDENTIAL CHILD CARE
FACILITY SERVICES AND AUTHORIZE CHAIR TO SIGN-LILAC GARDEN RCCS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Addendum to the Agreement to
Purchase Residential Child Care Facility Services between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Social Services, and Lilac Garden RCCS, LLC, commencing November 13, 2006, and ending
June 30, 2007, with further terms and conditions being as stated in said agreement, and
WHEREAS,after review, the Board deems it advisable to approve said addendum, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Board of Social Services, that the Addendum to the Agreement to
Purchase Residential Child Care Facility Services between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Social Services, and Lilac Garden RCCS, LLC, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said addendum.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 5th day of February, A.D., 2007, nunc pro tunc November 13, 2006.

RE: Addendum to Agreement to Purchase Residential Child Care Facilities(RCCF)—
Lilac Garden RCCS, LLC
Enclosed for Board approval is an Addendum to Agreement to Purchase RCCF Services between
the Weld County Department of Social Services (Department)and Lilac Garden RCCS, LLC.
The Addendum was reviewed at the Board's Work Session held on January 29, 2007. The
Addendums are with providers for reimbursement during SFY2006-2007 (July 1, 2006 through
June 30, 2007).
The rate is based on care and services set by the Colorado Department of Human Services. If the
child is eligible for the Child Residential Habitation Program (CHRP), the Department agrees to
pay the federal SSI rate.

WELD COUNTY ADDENDUM
To that certain Agreement to Purchase Residential Child Care Facility
Services (the "Agreement") between Lilac Garden RCCS, LLC and Weld
County Department of Social Services for the period from
November 13, 2006 through June 30,2007.
The following provisions, made this lo day of L , 2006, are added to the referenced
Agreement. Except as modified hereby, all terms of the Agreement remain unchanged.
1. County agrees to purchase and Contractor, identified as Provider ID#1536983, agrees to
provide:
A. Child Maintenance, Administrative Maintenance and Services, will be negotiated
on a child by child basis, dependant on the child's disability, level of supervision
and need for services. The total rate may vary based on the above mentioned but
may not exceed $150.00 per day for children placed within the Residential Child
Care Facility.
These services will be for children who have been deemed eligible for social services
under the statutes, rules and regulations of the State of Colorado.
2. Section I, Paragraph 2. All bed hold payments for a child's temporary absence from a
facility, including hospitalization, need to have prior written authorization from both the
caseworker and his or her supervisor before payment will be released.
3. Add Paragraph 6 to Section I. The services purchased under this Agreement as Child
Maintenance, Administrative Maintenance and Services for Residential Child Care
Facilities include, but are not limited to: Food, shelter, clothing,personal needs and
allowance, administration, administrative overhead, support staff, support overhead,
sleep-over staff, direct child care, transportation, therapeutic recreation, service delivery
staff, parent training for teens, independent living training, mentor/advocate, supervised
visitation and all other services as outlined in the Contractor's scope of service attached
as Exhibit A or the Child Specific Addendum. The anticipated minimum percentage for
each item is as follows and will be subject to County monitoring as outlined in Section VI
of this contract:
A. Food, including meals and snacks (25%);
B. Clothing (3%);
C. Shelter, including utilities and use of household furnishing and equipment and
daily supervision, including those activities that a parent would normally carry out
to assure protection, emotional support and care of the child (30%);
D. Personal items and grooming care for the child, such as toothpaste, toothbrushes,
soap, combs, haircuts, and other essentials (2%);
E. Other/miscellaneous items considered usual in the care and supervision of the
child, include, but are not limited to, transportation, recreation and overhead
(40%)
4. Add Paragraph 8 to Section I. A minimum of one polygraph test per Colorado fiscal
year, if needed by the child, will be furnished under this contract for facilities that
provide sex offender treatment.

5. Add Paragraph 9 to Section I. Any additional costs for specialized services, which
include, but are not limited to; polygraph tests, plethysmographs, and urinalysis screens,
that is not provided within the vendor rate or attached Scope of Service, will need be
negotiated and authorized, in writing by the County, prior to the service being performed.
Any payment for specialized services not authorized in writing will be denied.
6. Add Paragraph 5 to Section II. Contact by the Contractor with the County regarding
emergency medical, surgical or dental care will be made in person-to-person
communication, not through phone mail messages. During regular work hours, the
Contractor will make every effort to notify the assigned caseworker, supervisor, or intake
screener of any emergency medical, surgical or dental issues prior to granting
authorization. During non-regular work hours, weekends and holidays, the Contractor
will contact the Emergency Duty Worker at the pager number(970) 304-2749.
7. Add Paragraph 13 to Section IV. Agree to cooperate with any vendors hired by Weld
County Department of Social Services to shorten the duration of placement.
8. Add Paragraph 14 to Section IV. Agree to schedule physical examinations within 14
days after placement, dental examinations within 60 days after placement and forward all
appropriate information to the County.
9. Add Paragraph 15 to Section IV. A full evaluation of an Individualized Educational Plan
(IEP) for youth designated as a Special Education Student will be conducted every 3
years and reviewed every year. If the IEP is due while the child is in placement, the
Contractor will complete or obtain a completed IEP. A copy will then be forwarded to
the County.
10. Add Paragraph 16 to Section IV. Assure and certify that it and its principals:
A. Are not presently debarred, suspended, proposed for debarment, and declared
ineligible or voluntarily excluded from covered transactions by a federal
department or agency.
B. Have not, within a three-year period of preceding this Agreement, been convicted
of or had a civil judgment rendered against them for commission of fraud or a
criminal offense in connection with obtaining, attempting to obtain, or performing
a public (federal, state, or local) transaction or contract under a public transaction;
violation of federal or state antitrust statutes or commission of embezzlement,
theft, forgery, bribery, falsification or destruction of records, making false
statements, or receiving stolen property;
C. Are not presently indicted for or otherwise criminally or civilly charged by a
government entity (federal, state, or local) with commission of any of the offenses
enumerated in paragraph (B) above.
D. Have not within a three-year period preceding this Agreement, had one or more
public transactions (federal, state, and local)terminated for cause or default.
11. Section V, Paragraph 5. Children in Therapeutic Residential Child Care Facilities,
Residential Child Care Facilities and Child Placement Agencies are not eligible to receive
clothing allowances as outlined in the Weld County Department of Social Services Policy
and Procedure Manual.

12. Add Paragraph 7 to Section VI. It is expressly understood and agreed that the
enforcement of the terms and conditions of this Agreement, and all rights of action
relating to such enforcement, shall be strictly reserved to the undersigned parties or their
assignees, and nothing contained in this Agreement shall give or allow any claim or right
of action whatsoever by any other person not included in this Agreement. It is the
express intention of the undersigned parties that any entity other than the undersigned
parties or their assignees receiving services or benefits under this Agreement shall be an
incidental beneficiary only.
13. Add Paragraph 8 to Section VI. No portion of this Agreement shall be deemed to
constitute a waiver of any immunity the parties or their officers or employees may
posses, nor shall any portion of this Agreement be deemed to have created a duty of care
that did not previously exist with respect to any person not a party to this Agreement.
The parties hereto acknowledge and agree that no part of this Agreement is intended to
circumvent or replace such immunities.
14. Add Paragraph 9 to Section VI. The Director of Social Services or designee may
exercise the following remedial actions should s/he find the Contractor substantially
failed to satisfy the scope of work found in this Agreement. Substantial failure to satisfy
the scope of work shall be defined to mean incorrect or improper activities or inaction by
the Contractor. These remedial actions are as follows:
A. Withhold payment to the Contractor until the necessary services or corrections in
performance are satisfactorily completed;
B. Deny payment or recover reimbursement for those services or deliverables which
have not been performed and which due to circumstances caused by the
Contractor cannot be performed or if performed would be of no value to the
Social Services. Denial of the amount of payment shall be reasonably related to
the amount of work or deliverables lost to Social Services;
C. Recover from the Contractor any incorrect payment to the Contractor due to
omission, error, fraud, and/or defalcation by deducting from subsequent payments
under this Agreement or other agreements between Social Services and the
Contractor, or by Social Services as a debt to Social Services or otherwise as
provided by law.
15. Add Paragraph 10 to Section VI. The contractor shall promptly notify Social Services in
the event in which it is a party defendant or respondent in a case, which involves services
provided under the agreement. The Contractor, within five (5) calendar days after being
served with a summons, complaint, or other pleading which has been filed in any federal
or state court or administrative agency, shall deliver copies of such document(s)to the
Social Services' Director. The term "litigation" includes an assignment for the benefit of
creditors, and filings in bankruptcy, reorganizations and/or foreclosure.

SERVICES, A BEAUTIFUL PLACE TO LIVES
Lilac Garden RCCS offers intensive 24-hour residential services for 5 boys with
developmental disabilities,mental delay,and behavioral problems. We accept children
form the age 8-18 with mild and moderate disability. Our program provides a home-like
environment along with a high level of staff supervision. We accept and provide services
for children placed by Colorado Department of Social Services as well as private
placements.
The house itself is a gorgeous European style home with 5 bedrooms,each with private
bathrooms, custom-designed kitchen,beautiful dinning room, and special room for study.
In our warm, loving atmosphere caring staff members support the healthy development,
active curiosity of the child. Gently assisting, encouraging, supporting imaginative way
of playing, creative art,quiet reading,we provide the child the opportunity to explore the
world. Each day will be filled with songs, games,fun-filled activities.
Our guiding principle is to help your child master the skills needed to succeed in school
and in life.
Children can play on our large lot under supervision of specialists and they can also enjoy
community pool,public library, as well as nearby walk and bike paths.
In Lilac Garden you will find real people with the caring touch, experience, and LOVE.
We offer a variety of services:

GUIDELINES FOR THE LILAC GARDEN RCCS CHILDREN'S PROGRAM
Children's program is developed as a habilitaion service for individuals who require 24-
Hour care and who do not reside with their families.
Administrative officer/Program director has overall responsibility for the development,
Implementaion, and coordination of the program. Staffing pattern is designed to meet
The needs of the particular individuals and include awake night staff.
Assessment/evaluation of the child shall be done at the time of admission and within
30 calendar days following completion of the assessment,the director of program shall
develop an individual child's care plan: We provide an opportunity for the following
persons to participate in the planning/evaluation process:
- the primary caregiver for the child
- the child, unless contraindicated
- his/her parent(s) or guardian(s),unless contraindicated
- representatives of the placing agency
- school personnel
- other persons significant in the child's life, such as a GAL, attorney,religious
advisor,therapist.
When any of the above persons do not participate or the involvement of them is
Contraindicated by the agency or individual holding legal custody of the child,the
Reasons for contraindication will be documented by any of the team member.
We shall obtain the parent(s)or guardian(s)consent for the plan.
Service plan is created for each child and is based on medical reports, assessments,
Psychological and psychiatric evaluation. Individualized service plan shall be
Quarterly reviewed to evaluate the progress. In the event of achievement of goals or
Ineffectiveness of treatment the service plan will be revised and, if necessary
Procedures will be stopped by attending doctors/specialists.
Staff shall document any unusual occurrences or changes in"Chronological Notes",
Address the problem to doctors/specialists immediately and inform Program director.
Every second week of the month facility will have an in-service meeting with the staff.
Parent(s)or guardian(s)will be invited for this meeting as well.
Therapy is an important component of the program designed to help children improve
Their social skills,their fine and gross motor skills, and to learn how to manage their
Behavior and emotions. Children are assigned to a group with the same licensed
therapist and will have a therapeutic session once a month. The therapist also meets
with each child once a week individually for issued that need to be addressed outside
the group. The therapist will have regular communication with the parent(s) or guardian(s)
to determine behavioral patterns of the child.
Following therapist recommendations qualified and trained staff members offer
One-on-one services to children whose needs go beyond a monthly therapy session.
Any issues arise through one-on-one service should be written in a chronological
Notes and should be revised by the therapist and specialists.
When child is attending any in-home treatment group session or individual therapy
This is staff responsibility to monitor the safety of children.

Lilac Garden RCCS prohibits all cruel and aversive treatment or therapy including,
But not limited to,the following:
- Any intervention designed to or likely to cause a child physical pain.
- Releasing noxious, toxic,or unpleasant sprays, mists; or substances
In proximity to the child face.
- Any intervention that denies a child sleep, food, water, shelter, access
To bathroom facilities, adequate bedding, or appropriate physical comfort.
- Any intervention or type of treatment that subjects a child to verbal abuse,
Ridicule, humiliation, or that can be expected to cause excessive emotional
Trauma.
- Interventions that use a device,material, or object that is designed to
Simultaneously immobilize all four of the child's extremities.
- Any treatment intervention that deprives a child of the use of his/her
Senses, including sight, hearing,touch,taste, or smell.
- The use of mechanical restraints, including but not limited to,the use of
Handcuffs, shackles, straight jackets,vests, ankle and wrist restraints, Craig
Beds,and chest restraints.
- Physical restraint and locked seclusion.

Diet prescribed by physician.
> Daily light housekeeping services in the resident's room,

> Weekly light housekeeping services in the resident's room,
Vacuuming,dusting,cleaning bathroom, changing bed linen.
> A wellness visits conducted at the regular basis by a licensed
Specialists.
> Regularly scheduled social,educational,religious,recreational
And wellness programs.
> An emergency call response system in every room. A staff
Member available at all the times and can request emergency medical
Assistance from emergency services (such 911, or private ambulance)
Available in the area.
The resident or responsible party authorized the LG RCCS to obtain
Emergency health care services for the resident at the resident's
Expense,whenever such emergency services are deemed necessary
(in our sole discretion). We shall notify any responsible party as soon
as possible after such emergence where health care services have
been provided.
TRANSFER TO THE FACILITY
PROVIDING HIGHER LEVEL OF CARE
If the resident needs care beyond what can be provided in the LG RCCS,

MEALS
Mealtime will be conducted in a family atmosphere. All children who are eating the meal
