This includes all issues pertaining to dedication of future public rights of way for either County or development related roads, utilities and associated encumbrances. This action was achieved via the Change of Zone and Final Plats associated with this land use application. Further, all requirements specific to Public Sites and Open Space have been addressed as no school sites and open space areas were dedicated to Weld County government or the school district. My examination of title has uncovered the existence of three agreements that were executed in 1989 between Del Canino Center Partnership and Weld County. The agreements are described as follows: • Road Improvements and Maintenance Agreement(#890819),recorded on August 7, 1989 at Book No. 1240,Reception No.02187557 • Improvements Agreement According Policy Regarding Collateral for Improvements(#890821), recorded on August 7,1989 at Book No. 1240,Reception No.02187558 • Improvements Agreement According Policy Regarding Collateral for Improvements(#890820), recorded on August 15, 1989 at Book No. 1241,Reception No.02188568 All of the obligations and improvements required by the above-described agreements have been satisfied and completed. In addition,the letters of credit,which served as collateral for the improvement projects described in Agreements 890821 and 890820,have been released by resolution of the Board of County Commissioners. Accordingly,please release all three of the above-described agreements. For your review,I have attached copies of the above-described agreements and resolutions of the Board of County Commissioners.
