Case Number: USR-1594 for a Site Specific Development Plan and a Special Review
Permit for an Agricultural Service establishment primarily engaged in
performing agricultural, animal husbandry or horticultural services on a fee
or contract basis, including: Animal waste recycling or processing facilities
(Waste Water Treatment Facility) in the A (Agricultural) Zone District
Legal: Part of the SW4 of Section 31, T6N, R64W of the 6th P.M., Weld County,
Colorado.
Dear John,
This letter is a reply to the inquiry presented electronically to the Clerk to the Board's office and
copied to the Department of Planning Services on June 6, 2007. In this electronic mail two
questions were raised:
What is the procedure for vacating the USR that already existed on this parcel?
Why was Swift required to get a USR for this property when one already existed?
In response to the first inquiry, a vacation of an existing permit, if appropriate, can be completed
via the receipt of a written request by the current property owner to partially or fully vacate the
existing Site Specific Development Plan and Special Use Permit. Research by this department
and the Clerk to the Boards office has determined that the vacation of a land use permit is not
applicable in this instance. This determination is based on the following findings:
By Resolution, dated July 9, 1970, the Board of County Commissioners, granted permission to
the City of Greeley the ability to install the new City industrial waste and sewage treatment
facility on lands located in the unincorporated part of the County having a zoning designation of
Agriculture, specified subject to meeting criteria.
Prior to this Resolution by the Weld County Commissioners, the City Manager for the City of
Greeley provided an application to the State of Colorado Department of Public Health, Water
Pollution Control Division for a regional sewage disposal site, per an application dated July 8,

1970. The Weld County Planning Commission Resolution of recommendation in support of this
application was approved July 10, 1970, and listed as SUP-45.
Recent property and case file research, however, indicates this number [SUP-45] to be
erroneous as there was not a land use case associated with the proposal, and secondly, a
Resolution of acknowledgment to proceed with the municipal water treatment facility was an
administrative action. It is important to note that case numbers are granted for all land use
cases for which a case file of documents is created for processing. Staff did not locate a case
file for the subject City industrial waste and sewage treatment facility.
Even if there had been an existing permit for this facility, an amendment to the existing permit
would be required, as waste water technology, State and County Health regulations, County
permitting and building regulations have changed in the course of the last thirty plus years.
That being said, it is the opinion of this department and the County Attorney's office that there is
not an existing land use application that requires vacation as discussed in this letter. Given this
determination, the Department of Planning Services requests that the applicant prepare the
appropriate documentation for review and approval for the existing USR-1594 prior to
submitting final documents for recording. Should additional information be required, please
contact this office for clarification and direction as required.
