RE: Lease of Railroad Property by Darrell Felton in Platteville, Weld County, Colorado
To Whom It May Concern::
It has come to my attention that Weld County is requiring the above Lessee to go through a
rezoning procedure as Weld County has determined the current use is in violation of existing
zoning. The Union Pacific Railroad Company ("Railroad") is willing to review this request for
rezoning or the granting of a Use By Special Review, whichever is required by the County.
However, please be advised that I will need toj be the point of contact for the Railroad, as we can
not authorize Mr. Felton to act on the Railroad's behalf. You may, however, copy Mr. Felton on
all correspondence regarding this matter.
This letter also advises Weld County that Union Pacific Railroad Company is not the owner of
the mineral rights on this property. Title to the property was received by the Railroad by virtue of
an 1862 Congressional Grant; however,the minerals were excepted from this Grant.

REVIEW (USR) QUESTIONNAIRE
The following questions are to be answered and submitted as part of the USR application. If a question does not
pertain to your use, please respond with "not applicable", with an explanation as to why the question is not
applicable.
L Explain, in detail the proposed use of the property.
This property is being used for the purpose of a vehicle retail sales lot,for the sale of new horse
trailers, new flat trailers, used pickups and cars.
2. Explain how this proposal is consistent with the intent of the Weld County Code,chapter 22
(Comprehensive Plan.)
This existing use,lies within an established area of Urban commercial uses,and meets the need for
the requested continuance of use. The continued use helps provide compatibility with the
surrounding established land uses.
3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning)
and the zone district in which it is located.
This existing commercial use, lies within an established Commercial Zone District as shown on the
Official Zoning Map. The ATM Sales provides the activity `. . .where goods, products or services
are bought, sold or transferred in ownership on a fee, contract. . .', as specifically defined by
Section 23-1-90 of the Charter and Code of the County of Weld, Colorado, adopted in 2001.
4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with
surrounding land uses.
This property sits between Hwy 85 and the Union Pacific Railroad. The property adjacent and to
the south is a used car lot and auto repair business. Vacant railroad property is adjacent to the
north. The past uses of this property have been for a trucking company, a car sales lot for two
separate companies and by us for the past 3 years.
5. Describe, in detail,the following
a. How many people will use this site?
Between 3 and 10 customers will use this site.
b. How many employees are proposed to be employed at this site?
There are currently 3 to 5 employees.
c. What are the hours of operation?
The hours of operation are 9 am to 6 pm. Monday through Saturday.
d. What type and how many structures will be erected (built) on this site?
No new structures are proposed on this site. Currently the site contains a 10-foot by 12-
foot shed, a 14-foot by 53-foot brick building used as the sales office, and a l0-foot by 16-
foot metal shed.
e. What type and how many animals, if any, will be on this site?

Passenger cars,light trucks, horse trailers, small equipment trailers.

Platteville/Gilcrest FPD currently provides fire protection to the site.
h. What is the water source on the property? (Both domestic and irrigation).
The existing water well on the site is the current water source. This existing well permit is
for a commercial use and a copy of this permit is being submitted for your reference.
i. What is the sewage disposal system on the property? (Existing and proposed).
The current sewage disposal system on the property is a septic system. The Weld County
permit number for the existing septic system is SP-9600314 and a copy of an engineer's
approval letter for this system is being included for your review.
j. If storage or warehousing is proposed, what type of items will be stored?
N/A
6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a
landscape plan map as part of the application submittal.
No landscaping is being proposed for the existing business.
7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity
occurs.
Given the current use of this property, no proposed reclamation procedures will be required at
the termination of this business activity.
8. Explain how the storm water drainage will be handled on the site.
The site historically slopes toward the State maintained ditches adjacent to Hwy 85. As no
improvements are proposed for this site,the historic drainage pattern will be maintained.
9. Explain how long it will take to construct this site and when construction and landscaping is scheduled
to begin.

Storage of waste for the business will occur in a trash container which is emptied weekly by

Mickey,
I've reviewed our files and could not find any evidence of an "actual" permit. Based upon our conversation and my
familiarity of the site, it would be CDOT's position that the access to the site is "grandfathered". Provided no use
increasing traffic to the site is proposed, CDOT would not have the warrant necessary to re-evaluate the access.
However, if traffic does increase, CDOT would have the authority to require reconstruction, limit movements or possibly
close.

Gloria,
This email is per our conversation this morning regarding ATM Sales in Platteville. My clients are Darrell and Christina
Felton and they currently have a 20 year lease with Union Pacific Railroad Company to operate a business on the
property located at 16302 US HWY 85. I am currently in the process of putting together an application for a Use By
Special Review Plat for this property. My clients received a notice from the County stating they were in violation of
operating a business on a property not zoned commercial and this is the reason for the application. As I stated this
morning, my application to the County was not excepted because they needed additional information. One item they
requested was a copy of the existing CDOT access permit at this location. As you mentioned this morning, this
property more than likely does not have a access permit, but is grandfathered in. I would like to request a response
back from you stating if this is the correct assumption. Thank you so much for your time and I look forward to hearing
