THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-370 of
the Weld County Code.
2. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 23-2-400 of the Weld County Code as follows:
A. Section 23-2-400.A. --Reasonable efforts have been made to avoid irrigated crop land or to
minimize the impacts on such lands in those cases where avoidance is impractical. The
subject site is designated as floodplain on the FIRM Community Panel Maps. The facility is
existing and is currently undergoing substantial modernization and upgrades as required by
the State of Colorado Department of Public Health and Environment,Water Quality Control
Division.
B. Section 23-2-400.B. -- The facility will not have an undue adverse effect on existing and
future development of the surrounding area as set forth in applicable Master Plans. The
subject property lies within the three-mile referral area of the City of Greeley and the Town
of Kersey. The City of Greeley in their referral dated January 2, 2007 stated that they had
no conflicts with the request. No response has been received from the Town of Kersey.

C. Section 23-2-400.C. -- The design of the proposed facility mitigates negative impacts on the
surrounding area to the greatest extent feasible. The proposed facility will be compatible with
surrounding land uses. To the West and South are Confined Animal Feeding Operations,
permitted for Cervi Enterprises Inc., via land use case number REC-32 and SUP-170 and
North Front Range Feedlots, case number SUP-163 and to the East and North Agricultural
lands; the proposed Conditions of Approval and Development Standards will minimize
negative impacts on the surrounding area.
D. Section 23-2-400.D. -- The site shall be maintained in such a manner so as to control soil
erosion,dust,and the growth of noxious weeds.The Conditions of Approval and Development
Standards will ensure that there is no fugitive dust or erosion and will ensure the control of
noxious weeds.
E. Section 23-2-400.E. -- The applicant has agreed to implement any reasonable measures
deemed necessary by the Planning Commission to ensure that the health,safety,and welfare
of the inhabitants of Weld County will be protected and to mitigate or minimize any potential
adverse impacts from the proposed facility.
F. Section 23-2-400.F. -- All reasonable steps have been taken by the applicant to minimize
negative impacts on agricultural uses and lands. As previously stated, this existing facility is
being upgraded. Wastewater is received from the Swift Company Beef Plant, treated, and
discharged into Lone Tree Creek in accordance with the Discharge Permit issued by the State
of Colorado. The property has been utilized as a treatment facility for 34 years, and the area
of the footprint of the facility is not being expanded. The facility utilizes water from North Weld
County Water District with no irrigation water utilized in the plant operation. The facility will be
manned with up to three employees twelve hours each day. The treatment plant operates on
a 24 hour a day, 7 day a week schedule. It is important to state that the facility was originally
constructed by the City of Greeley for their sanitation needs and then sold to Swift&Company.
The Conditions of Approval and Development Standards minimize negative impacts on the
existing agricultural uses and lands of the area.
G. Section 23-2-400.G. -- All reasonable alternatives to the proposal have been adequately
assessed. The proposed action is consistent with the best interests of the people of Weld
County and represents a balanced use of resources in the affected area. The upgraded
facility will continue to service the Swift Beef Plant in Greeley.
H. Section 23-2-400.H. -- This application will create limited, if any, demand for additional
government services.
Section 23-2-400.1. --The Conditions of Approval and Development Standards will
ensure that the operation of the facility will meet Colorado Department of Health and Weld
County air quality standards.
J. Section 23-2-400.J. —Adequate electric, gas, telephone, water, sewage, and other utilities
exist to service the site.
K. Section 23-2-400.K. -- The nature and location or expansion of the facility will not
unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any
endangered wildlife species,unique natural resource,historic landmark or archaeological sites
within the affected area.There will be no significant impact on wildlife habitat. The application
materials state that migratory birds currently utilize the property, including water fowl,coastal
birds and bald eagles.The Division of Wildlife did not return a referral indicating a conflict with
their interests.

L. Section 23-2-400.L. --The proposed use will not significantly impact drainage of residential
property, crop land or other land. The Department of Public Works in their referral dated
December 28, 2007 states"The development lies in a Special Flood Hazard Area defined by
the Federal Emergency Management Administration(FEMA)on their Flood Insurance Rating
Map (FIRM)."
The Special Flood Hazard areas of the County are subject to periodic inundation which results
in health and safety hazards, loss of life and property, disruption of commerce and
governmental services, extraordinary public expenditures for flood protection and relief, and
impairment of the tax base all of which adversely effect the public life, safety and general
welfare of the residents of Weld County. These floods are caused by the cumulative effects
of obstructions in flood hazard areas which increase flood heights and velocities and damage
uses in other areas. Uses that are inadequately elevated,flood proofed,or otherwise protected
from flood damage also contribute to flood damage and losses.
FEMA regulations(44 CFR Section 60)require that the local communities manage floodplain
development in order to participate in the National Flood Insurance Program (NFIP).
Application for a Weld County FHDP does not guarantee that a building permit will be issued.
Some areas are unsafe for building.
The FHDP documentation must include certification by the applicant's registered professional
engineer that the proposed development will be reasonably safe from flood damage and that
the proposed development, including structures, roads, and fill, will not impede flood flows.
The Department of Public Works will not be requiring a FHDP for USR-1594 at this time as
stated in an electronic mail dated January 26, 2007. The application states that no new
structures will be needed. Public Works put the generic FHDP comments and information
in the memorandum dated December 28, 2006 in the event any new building may occur to
have the treatment plant come into compliance. If any new structures will be needed for
this compliance to be met, then the applicant will be required to follow the FHDP process.
M. Section 23-2-400.M—The proposed use has no associated housing requirements.
N. Section 23-2-400.N—The proposed site does not lie within a Municipality IGA boundary.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the following:
1. Prior to recording the plat:
A. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS)from
the Water Quality Control Division of the Colorado Department of Health and Environment
for any proposed discharge into State Waterways. Evidence of approval shall be
submitted to the Department of Planning Services. (Department of Public Health and

B. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the
Weld County Department of Planning Services. (Department of Planning Services)
C. The plat shall be amended to delineate the following:
1. All Sheets of the plat shall be labeled USR-1594 (Department of Planning
Services)
2. The attached Development Standards. (Department of Planning Services)
3. The applicant has not delineated any on-site sign(s). If any on-site sign(s) are
desired, the signs shall adhere to Section 23-4-90.A and .B of the Weld County
Code. One identification sign per principal use shall be allowed, provided that the
sign does not exceed sixteen (16) square feet in area per face. All structures,
including signs, on site must obtain the appropriate building permits. (Department

4. The applicant shall delineate on the plat the security fence, including man gates
and points of ingress and egress. (Department of Planning Services)
5. The plat shall meet all the requirements of Section 23-2-380 of the Weld County
Code. (Department of Planning Services)
6. County Road 62.5 is classified as a local roadway with 60-feet of right-of-way at
full build out. The applicant shall verify the existing right-of-way and the documents
creating the right-of-way. If the right-of-way can not be verified, it shall be identified
as future right-of-way. The plat shall delineate the existing right-of-way and the
documents which created it along with any additional future right-of-way required.

7. The applicant shall delineate on the plat the location of employee parking, loading
and unloading areas for delivery vehicles and general on-site circulation. The
number of parking spaces associated with this facility is eight(8) parking spaces.

8. The applicant shall delineate on the plat the location of the two points of ingress -

2. Prior to Construction:
A. The applicant shall contact the Department of Building Inspection to determine appropriate
Building permits that may be required for all future construction associated with this facility.

3. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of
the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be
prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code.
The Mylar plat and additional requirements shall be submitted within thirty (30) days from the date
of the Board of County Commissioners resolution. The applicant shall be responsible for paying the

4. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, ArcInfo Coverages and Arclnfo Export files format
type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This

5. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County

6. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required sixty(30) days from the date the Board of County
Commissioners resolution was signed a $50.00 recording continuance charge may be added for

1. A Site Specific Development Plan and a Special Review Permit for an Agricultural Service
establishment primarily engaged in performing agricultural,animal husbandry or horticultural services
on a fee or contract basis, including: Animal waste recycling or processing facilities (Waste Water
Treatment Facility)in the A(Agricultural)Zone District,as indicated in the application materials on file
and subject to the Development Standards stated hereon. (Department of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. Fire Protection will be provided by the Union Colony Fire Rescue Authority. (Union Colony Fire Rescue

4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-
100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination. (Department of Public Health and Environment)
5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S, as amended. (Department of Public Health and Environment)
6. Waste materials shall be handled,stored,and disposed in a manner that controls fugitive dust,blowing
debris, and other potential nuisance conditions. (Department of Public Health and Environment)
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of Public

8. The applicant shall comply with all applicable rules of the Air Pollution Control Division, Colorado

9. The facility shall not emit odors that constitute a nuisance. Odors detected off site shall not equal or
exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the
Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request
of the Weld County Department of Public Health and Environment in the event odor levels detected
off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgement
of the Weld County Health Officer, there exists an odor condition requiring abatement. (Department

10. The facility shall be operated in a manner to control flies. (Department of Public Health and

11. The applicant shall comply with the discharge permit from the Colorado Department of Public Health
& Environment, Water Quality Control Division. (Department of Public Health and Environment)
12. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as
delineated in 25-12-103 C.R.S., as amended. (Department of Public Health and Environment)
13. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility.

14. Sewage disposal for the facility shall be treated by the waste water treatment facility on site.

16. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with
product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's)and

17. The operation shall comply with all applicable rules and regulations of the State and Federal agencies
and the Weld County Code. (Department of Public Health and Environment)
18. The access shall be graded and drained road to provide an all-weather access. (Department of Public

19. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant
to Chapter 15, Articles I and II of the Weld County Code. (Department of Public Works)
20. A Flood Hazard Development Permit shall be obtained prior to start of construction of any new

21. A building permit shall be obtained prior to start of construction of any new structure. (Department

22. A plan review is required for each building for which a building permit is required. Plans shall include
a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis Data
sheet provided by the Weld County Building Department with each building permit application.Building
plans shall also be submitted to Union Colony Fire and Rescue Authority for their approval.

23. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 International Building
Code;2003 International Mechanical Code;2003 International Plumbing Code;2003 International Fuel
Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code.

24. The building will probably be classified as follows: B (Laboratory/Blower). All buildings used by the
public,including the bathrooms shall be accessible to persons with disabilities. Fire resistance of walls
and openings, construction requirements, maximum building height and allowable areas will be
reviewed at the plan review. Set back and offset distances shall be determined by the Weld County

25. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld
County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County
Code in order to determine compliance with offset and setback requirements. When measuring
buildings to determine offset and setback requirements, buildings are measured to the farthest
projection from the building. Property lines shall be clearly identified and all property pins shall be

26. Provide letter of approval from the Union Colony Fire and Rescue Authority prior to new construction.

27. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to
the fee structure of the County Road Impact Program. (Ordinance 2002-11)
28. Effective August 1, 2005, Building Permits issued on the proposed lots will be required to adhere to
the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee.

29. The property owner or operator shall be responsible for complying with the Design Standards of
Section 23-2-240, Weld County Code.
30. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 23-2-250, Weld County Code.
31. Weld County Government Personnel shall be granted access onto the property at any reasonable time
in order to ensure the activities carried out on the property comply with the Development Standards
stated herein and all applicable Weld County regulations.
32. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or

Development Standards are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
33. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may be
reason for revocation of the Permit by the Board of County Commissioners.

Dear Applicant:
Your application and related materials for the request described above are being processed. I have scheduled
a meeting with the Weld County Planning Commission for March 6,2007, at 1:30 p.m. This meeting will take
place in the Hearing Room, Weld County Planning Department, 918 10`" Street, Greeley, Colorado. It is
recommended that you and/or a representative be in attendance to answer any questions the Planning
Commission members may have.
It is the applicant's responsibility to comply with state statutes regarding notice to mineral estate owners.
Colorado Revised Statute, C.R.S.24-65.5-103 (adopted as part of H.B.01-1088) requires notification of all
mineral estate owners 30 days prior to any public hearing. The applicant shall provide the Weld County
Planning Department with written certification indicating the above requirements have been met.
It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the
property or if the property is located within the comprehensive planning area of a town or municipality.
Therefore, our office has forwarded a copy of the submitted materials to the Greeley and Kersey Planning
Commission for their review and comments. Please call Greeley at 970-350-9780 and Kersey at 970-353-
1681 for further details regarding the date,time,and place of this meeting. It is recommended that you and/or
a representative be in attendance at the Greeley and Kersey Planning Commission meeting to answer any
questions the Commission members may have with respect to your application.
A representative from the Department of Planning Services will be out to the property a minimum of ten days
prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which
identifies the hearing time,date,and location. In the event the property is not adjacent to a publicly maintained
road right-of-way, one sign will be posted in the most prominent place on the property and a second sign
posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. This recommendation will be available twenty-four(24)hours before the
scheduled hearing. It is the responsibility of the applicant to call the Department of Planning Services'office
before the Planning Commission hearing to make arrangements to obtain the recommendation.

COMMENTS:
Facility is enclosed within a chain link fence, a wood fence and a three strand barb wire on posts,
depending on location of property to County Road. The entire facility appears to be a construction zone
with numerous pieces of construction equipment operating on site. Primary access is from CR 62.5 a two
lane all-weather road. CR 51 is a two lane paved road adjacent to facility to the east. There is a single
family residential structure located immediately adjacent to the access drive. Overhead power is on the
west side of CR 51 and south side of CR 62.5.
