RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600519
AGAINST BRUCE GILLMORE AND KEN KREAGER FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Bruce Gillmore and Ken Kreager,VI#0600519, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of January, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Bruce Gillmore and Ken Kreager were not present or represented at said
hearing, although all parties were notified of said hearing by the Department of Planning Services
staff, and
WHEREAS,the Board of County Commissioners deems it advisable to dismiss said matter
due to their interpretation of the Weld County Code regarding public election signs,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0600519 against Bruce Gillmore and Ken Kreager be, and hereby is,
dismissed.

REMEDY
To bring the property into compliance the temporary political sign shall be removed from the property.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

Dear Mr. Gillmore and Mr. Kreager:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on January 9,2007,at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article IV(4), Div 2 "Signs"
Section 23-4-60 "Purpose and applicability."
Section 23-4-70 "General provisions."
Appendix 23-C "Permitted Signs by Type and Zone District."
Appendix 23-D "Number and Dimensions of individual signs by Zone District and
Type."
TEMPORARY SIGN:Signs relating to public elections,construction signs which identify
the contractors working on a project on the site and"for sale"or"for rent"signs indicating
that the property or residence is for sale or rent. Construction signs, "for sale" and "for
rent"signs must be removed upon completion of the project or when the property is sold
or rented. In no case shall the signs be allowed to stay longer than one (1) year.
To bring the property into compliance:
Due to the type of sign and length of time it has been situated on the property, the only
option I can present is removal of the sign.

This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

November 30, 2006, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

I got a call from a few minutes ago. She wants to know if we can do anything about a big
political sign that a neighbor has on his property. At first I thought that she was talking about a current sign and it
would be removed after the November 7th election, like all others. She says, however, that it is one that the guy
put up in 2004 and it has been there ever since. We probably should check it out. It is on WCR 34, east of 1-25
about 11/4 mile, at a place called something like, "Coyote Tree Farm."
