The Project consists of rebuilding, operating, and maintaining an electric transmission line defined as a major facility of a public utility by the Weld County Land Use Code 21-3-20 and subject to Areas and Activities of State Interest regulations pursuant to Colorado Revised Statutes 29-20-108. The Project involves adding a 230-kV transmission line circuit to existing poles in Weld County from the existing Fort Saint Vrain Substation toward the Longs Peak Substation to a point west of Mead. The Project also includes constructing an underground segment of the same transmission line in unincorporated Weld County into Boulder County to the Fordham Substation near Clover Basin Drive and Fordham Street in Longmont, Colorado, through portions of Section 8, Section 17, Section 20, Section 29, and Section 30 in T3N R68W.The Project will increase the reliability of energy delivery to the city of Longmont and will strengthen the area transmission network. If a question does not pertain to your use, please respond with "not applicable"and provide an explanation as to why the question is not applicable. 1. Explain, in detail,the proposed use of the property. The actual use of the properties would not change. An easement from each property owner has been or would be obtained to construct, operate, and maintain a new 230-kilovolt (kV) electric transmission line. Three additional conductors and one shield wire would be installed on the existing poles between the Fort Saint Vrain Substation and a point just east of Longs Peak Substation (0.40 miles) north of Mead Reservoir. Four new poles would be installed between the Fort Saint Vrain Substation and Mead at locations within the existing right-of-way(ROW)where the existing transmission alignment changes direction. Additional new poles would be installed in the Fort Saint Vrain Substation switchyard. The new poles will be almost identical to the existing poles and be located within 15 to 20 feet of the existing poles. A transition pole as shown in Photograph 2 (page 11-2)would be located east of Longs Peak Substation in Section 8 T3N R68W. This transition pole would direct the new conductors from overhead to underground. The transition pole and existing poles would be the same height and color. The transition pole's diameter would be slightly larger. The alignment from this point into Boulder County would be entirely underground and within the new ROW in Section 8, Section 17, Section 20, a northern portion of Section 29, and Section 30 in T3N R68W. The alignment would continue in underground and overhead configurations for approximately 8 miles through unincorporated Boulder County and the city of Longmont using the existing transmission line ROW. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan). The comprehensive plans for Weld County and the towns of Mead and Longmont have been reviewed and the Project meets the applicable goals or supports the applicable policies of the following comprehensive plans: • Weld County Land Use—The Project would not affect land use. The existing ROW is currently being used as an electric transmission corridor, with agricultural uses continuing on the land within the ROW and the proposed ROW. Construction, operation, and maintenance of the Project would cause temporary disruptions to uses on the proposed ROW. There would be no loss of agricultural use under the overhead transmission lines or above the underground transmission line segments. The new ROW for the underground segment of the transmission line will not result in any long-term impacts to current land use as the transmission line will be located underground. • Weld County Policies—The Project is consistent with applicable policies and goals set forth in the Weld County Comprehensive Plan, as described below. Site-Specific Development Plan and I-1 Use by Special Review(USR)Questionnaire November 2006 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application • Weld County Comprehensive Plan—Sec 22-5-30.B W. Policy 2.1—The effect of the proposed development upon wildlife and habitat should be evaluated and the loss of critical habitat mitigated. Weld County maintains maps of known critical wildlife habitats. > Areas of known critical habitat were evaluated and considered as part of the siting study done for the Project. An active bald eagle nest site is located approximately 0.50 mile northwest of the Project area. The upgrade of this line would occur in an existing ROW and construction would occur outside of the breeding season. If for some unforeseeable circumstance, construction should occur during nesting season, the United States Fish and Wildlife Service (USFWS)would be contacted to ensure these activities would not disturb the nesting pair. USFWS has been contacted regarding potential impacts to federally listed species associated with the Project. A response from USFWS was still pending at the time the permit application was submitted. If mitigation is required, Platte River Power Authority(Platte River)will work with USFWS to minimize potential impacts to federally listed species and critical habitats. • Weld County Comprehensive Plan—Sec. 22-5-30.6 W. Policy 2.2 (sic)—Destruction of wetlands or riparian areas will be strongly discouraged and mitigation for loss of wetlands and riparian habitat will be encouraged. ➢ Platte River has initiated consultation with the U.S. Army Corps of Engineers (USACE) regarding potential drainage and wetland crossings within the Project area. Platte River will apply for a Nationwide Permit(NWP) 12 after receiving permit approval from Weld County and Boulder County. The Project would be constructed in accordance with applicable standards. No long-term impacts to wetlands or riparian areas are expected as a result of construction and operation of the proposed Project. Underground segments of the transmission line would be restored and revegetated once construction is complete. The overhead segments of the Project would span all wetland habitats. Riparian areas would be spanned to the greatest extent feasible. During construction, overhead lines that would span creeks and other drainages would be aligned in areas that would require a minimum amount of tree cutting for safety purposes. • Weld County Comprehensive Plan—Sec. 22-5-50.D O. Goal 4—Development improvements should minimize visual scarring from grading, road cuts, and other site disturbances and should integrate new landscaping with the existing natural landscape. > All disturbed land would be re-graded to preconstruction contours and revegetated with appropriate plant species. • Mead Comprehensive Plan—Sec. IV (E)—Because it would be expensive to bury transmission lines carrying more than 15,000 volts, these lines would remain on above-ground poles. The segment through Mead would be constructed on existing 1-2 Site-Specific Development Plan and Use by Special Review(USR)Questionnaire November 2006 Fort Saint Vrain to Fordham New 230-ky Transmission Circuit Weld County 1041 Permit Application transmission poles, with the exception of the relocation of two poles. The two poles will be relocated to minimize impacts to existing residences that have mature trees that would interfere significantly with the overhead conductor. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning)and the zone district in which it is located. Weld County Code, Chapter 23, is not applicable to the Project. Weld County Code Section 23-2-300 states that Chapter 23 regulations do not apply to major facilities of a public utility. The Project is a major facility of a public utility that is subject to the regulations regarding Areas and Activities of State Interest as described in Weld County Code Section 21-3-20. 4. What types of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. The predominant land use along the ROW, in unincorporated Weld County, is agriculture. Two residential subdivisions in Mead are adjacent to the existing ROW. Platter River currently owns, operates, and maintains an existing overhead 230-kV line within the proposed upgrade ROW for the overhead sections of the Project between the Fort Saint Vrain Power Substation and the transition to the underground segment east of Longs Peak Substation. The Project would therefore be consistent with surrounding land uses. This overhead segment of the transmission line has been in operation since 1979 and was constructed for double-circuit operation. The four new poles required for the Project would be placed within 15 to 20 feet of existing poles and within the existing ROW where the route changes direction between the Fort Saint Vrain Substation and Mead. The underground segments of the Project would be consistent with surrounding land uses because it would be constructed underground and would not result in long-term physical or visual disturbance to existing land uses. The underground section of the route would be placed at the edge of property boundaries in a 25-foot ROW along half-section lines and would have little impact if any on use of the property for future development. Underground vaults would be located along the route at 2,000-foot to 2,200-foot intervals to allow splicing of the underground cable. Only the manhole lids would be visible at grade level at the vault locations. Approximately 9 miles of the new 230-kV circuit will make use of the existing poles. 5. Describe, in detail,the following: a. How many people will use this site? The Project is an unmanned utility facility and is not designed for active use. There would be annual visits by Platte River to inspect the condition of the poles, conductor connections, and underground vault locations to check for vegetation clearances. How many employees are proposed to be employed at this site? Approximately 50 construction workers would be employed during the 1-year construction period. Approximately 25 construction workers would be employed during the peak construction period. No permanent on-site employees would result from the Project. c. What are the hours of operation? The Project is designed to operate continuously 24 hours a day, 7 days a week, to supply electricity to Platte River customers. d. What type and how many structures will be erected(built)on this site? Four new transmission poles and one new transition pole would be erected on existing ROW from the Fort Saint Vrain Substation to Mead. The poles would be similar in color, height, and diameter to the existing poles along the Fort Saint Vrain to Longs Peak 230-kV transmission line. e. What type and how many animals, if any,will be on this site? Animals will not be a part of the Project; the only animals that could be on the ROW would be wildlife. f. What kind (type,size,weight)of vehicles will access this site,and how often? All vehicles that access the site will be certified to operate on interstate highways. The exact number and types of vehicles will not be known until final engineering plans are complete. Typical vehicles that would be used during construction include an excavator, a wheeled and tracked backhoe, bulldozer, loaders, dump trucks, cement truck, and a truck-mounted drill rig. After construction is complete, pickup trucks would be used to perform maintenance inspections of the transmission poles, ROW, and at vault locations. g. Who will provide fire protection to the site? Mountain View Fire Protection District 14308 Mead Street Longmont, Colorado h. What is the water source on the property(both domestic and irrigation)? Water will not be needed for the proposed transmission line. i. What is the sewage disposal system on the property(existing and proposed)? Temporary sewage facilities would be placed in the Project area during the construction period for use by construction workers. Because the Project is unmanned, there will be no need for sewage disposal once the Project has been constructed. 1.4 Site-Specific Development Plan and Use by Special Review(USR)Questionnaire November 2006 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application j. If storage or warehousing is proposed,what type of Items will be stored? Storage and warehousing are not proposed. Platte River will use its Longs Peak Substation and/or Platte River's Northwest Substation as a temporary-storage location for construction materials that would be used during the installation of the Project. 6. Explain the proposed landscaping for the site.The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. Disturbed land would be re-graded to preconstruction contours and revegetated as appropriate per negotiations with landowners. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. The easements for the Project are in perpetuity once they have been granted. 8. Explain how the storm water drainage will be handled on the site. No additional stormwater runoff will result from the Project. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. It would take approximately 1 year to construct the Project. Construction would start in fall 2007 and be completed in fall 2008. Re-grading and revegetation would be coordinated with the affected landowners and would take place at disturbed locations as soon as construction on a segment has been completed. 10. Explain where storage and/or stockpile of wastes will occur on this site. Construction waste will be removed from the construction areas along the route. No waste would be produced after construction. Site-Specific Development Plan and 1.5 Use by Special Review(USR)Questionnaire November 2006 II. PROJECT DESCRIPTION Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Introduction Platte River Power Authority(Platte River) is proposing to locate and construct a new 22- mile-long 230-kilovolt (kV)transmission line between the Fort Saint Vrain Substation, located on the west side of the Fort Saint Vrain Power Plant in Weld County near Platteville, Colorado, and the Fordham Substation, located in Longmont, Colorado, near Clover Basin Drive and Fordham Street.Approximately 14 miles of the proposed transmission line would be constructed in Weld County. Platte River, headquartered in Fort Collins, is owned by and supplies electricity to the municipalities of Estes Park, Fort Collins, Longmont, and Loveland, Colorado. Platte River owns facilities located along the Front Range and the western slope of northern Colorado, and in Medicine Bow, Wyoming. Platte River also sells non-firm surplus electricity to other utilities in the western United States. This application, which requests approval of a permit to conduct an areas and activities of state interest, is authorized by Title 24, Section 65.1-501, of the Colorado Revised Statutes (C.R.S.), and Title 21, Article 2-10, of the Weld County Land Use Code. The areas and activities of state interest involves construction, operation, and maintenance of a major facility of a public utility, as defined by the Weld County Land Use Code 21-3-20. Platte River owns, operates, and maintains the existing Fort Saint Vrain to Longs Peak 230- kV transmission line between the Fort Saint Vrain Substation and Platte River's Longs Peak Substation, located approximately 1.5 miles west of Mead. The existing transmission line, energized in 1979, consists of poles that, although constructed for double-circuit operation, are currently configured for single-circuit operation on one side, with empty arms capable of supporting an additional 230-kV circuit on the other side (Photograph 1). An approximate 8- mile circuit consisting of three additional conductors would also be installed on the existing poles between the Fort Saint Vrain Substation and a point northeast of Longs Peak Substation. Four new poles would be required where the route changes direction between the Fort Saint Vrain Substation and Mead. The existing transmission poles at these locations were designed to carry only a single circuit because of the angle of the alignment. The new poles would be placed within 15 to 20 feet of the existing poles within the existing right-of-way (ROW). The new poles would be similar in color, height, and diameter to the existing poles. An overhead-to-underground transition pole would be located east of Longs Peak Substation near Mead and within the existing ROW (Photograph 2). The black wires on the side of the pole are the underground cables. Each cable is about 5 inches in diameter. From this transition pole to the Weld County/Boulder County line, the Project would be constructed entirely underground. The proposed line would continue in underground and overhead configurations for approximately 8 miles through the city of Longmont and unincorporated Boulder County using the existing transmission line ROW. Platte River has two existing poles along the northern side of Weld County Road (WCR) 34.5 that are very close to the back yards of several homes in the North Creek Subdivision in Mead. The new conductors that Platte River is proposing to add to the northern side of the poles in this area within the existing ROW would result in the conductors hanging over the backyards of these homes. In several cases, such existing trees would have to be significantly pruned or removed. Platte River is working with the town of Mead to get approval to relocate these two poles to the south side of WCR 34.5 to alleviate this problem. This relocation would place the two poles in a new park recently developed for the town of Mead. The Mead Parks Commission has voted to recommend approval of the relocation. The transmission pole relocation would also require that Platte River pay United Power to underground an older wood pole distribution line that is located along the south ROW of WCR 34.5. The underground distribution lines would be placed along the east-west length of the park property. Platte River will be working with Mead staff and the Town Council to create an easement for the relocated transmission poles. e^ Purpose and Need The purpose of the Project is to ensure that Platte River can continue to reliably supply electricity to the city of Longmont. The percentage of capacity at which the transmission system operates changes as electric loads change and with outages of other interconnected transmission lines. Platte River's studies indicate that had there been an outage of any one of two major transmission elements in Longmont during summer 2006, the transmission system would have been overloaded with high demand. The Project is needed to(1) enable Platte River to meet projected electric load growth resulting from commercial and residential development and existing customers using more electric appliances and devices at home and at work, and (2) provide system protection and reliability for non-interrupted service should an existing transmission circuit be out of service for any reason. The 2000 census identified 71,093 residents in Longmont. In December 2004, the population had risen to 81,169. The 2003 Longmont Area Comprehensive Plan projects a population of 85,000 in 2010, 92,000 in 2015, and 101,000 in 2025. November 2006 II-3 Fort Saint Vrain to Fordham 230kV Transmission Line Project Weld County 1041 Permit Application Location The Project would be located in southwestern Weld County and in northeastern Boulder County (Figure 1). The Project's alignment begins in Weld County and generally follows the ROW of the Fort Saint Vrain to Longs Peak 230-kV transmission line, Tri-State Meadow-Del Camino Tap transmission line, Northwest Meadow transmission line, and the Northwest- Fordham transmission line (Figure 2). The total length of the Project is approximately 22 miles. Table 1 shows the lengths in each jurisdiction. The Project area in Weld County is characterized by flat to rolling terrain and is dominated by agricultural land use. A few residential subdivisions and commercial uses are located at major transportation intersections. Linear facilities, such as roads, railroads, and existing utility lines that pass through industrial or agricultural land uses, were assessed as providing the best opportunities. Residential land uses and areas of critical habitat for wildlife and plants were assessed as areas to be avoided or excluded. Other criteria considered in the site selection process included transmission system planning, economics, environment, public involvement, permitting requirements, engineering, and acquisition of land rights. Transmission System Planning Platte River's transmission system planner continually evaluates the performance of the transmission system. Once a need for a system improvement has been identified, different ways of addressing that need are modeled and analyzed. The analysis of transmission system alternatives focuses on planning for adequate capacity to meet electric loads and high reliability, coordinating with any planned projects of other neighboring utilities, analyzing potential effects to other system components, and maintaining the ability to ensure continuity of service during construction. In some situations, excess capacity at one point in the transmission system may be used to address a need elsewhere in the system. Meeting overall increased demand, however, invariably involves new infrastructure. Economics Platte River has an obligation to its owners and to their customers to operate in a financially responsible manner. The relative cost of constructing, operating, and maintaining different alternatives is an important consideration when the need for new infrastructure has been identified. Also important is the long-term cost of infrastructure needs. For example, an inexpensive alternative that meets near-term needs might not be the most economical alternative if several other system upgrades are needed to meet long-term demand. The Project will provide reliable delivery of energy to Longmont and the surrounding area. Reliable energy delivery allows businesses to operate without interruption caused by brownouts during peak demand periods. It is expected that the Project will meet the electric demand forecast for the Longmont area in the next 10 or more years. The Project will benefit the surrounding area with support to the interconnected electric transmission system of the Western Area Power Administration and Tri-State Generation &Transmission Association, Inc. Environment Potential environmental effects of new transmission facilities are assessed as part of the siting process. The assessment includes collecting resource data and identifying the characteristics of the natural and human environment, identifying environmental opportunities and constraints, and assessing the relative environmental impact of different alternatives. November 2006 11.9 Fort Saint Vrain to Fordham 230kV Transmission Line Project Weld County 1041 Permit Application All environmental effects would be temporary. The Project will not adversely affect air quality, water quality, or habitat for threatened and endangered species. Any existing agricultural activities will not be disrupted along the overhead segment. Public Involvement Three public open houses were held regarding the Project. The first was held in the town of Mead on February 9, 2005, at the Mead Town Hall, 441 Third Street, from 5:30 p.m. until 7:30 p.m. The second was held in Longmont on February 16, 2005, at the Longmont Public Library, 409 Fourth Avenue, from 5:30 p.m. until 7:30 p.m. The third open house was also held in Longmont at the Longmont Public Library, on September 7, 2006, from 4:00 until 8:00 pm. Invitations were mailed on January 28, 2005, to owners of property within 0.50 mile of each alternative alignment in Mead and unincorporated Weld County and within 660 feet of each alternative alignment in the city of Longmont and unincorporated Boulder County. Invitations were mailed on August 2006 to property owners within 250 feet of the alignment from the Longs Peak Substation to the Fordham Substation. Approximately 50 people attended the public open house meetings and other people sent comments by e-mail or phone. Representatives from Platte River and its consultant, EDAW, were available to discuss the Project and answer questions. Handouts and large-format displays were available for attendees to review and discuss. The written comments that were received focused primarily on visual effects, effects of electric and magnetic fields, and the location of the underground sections in Longmont. Appendix A presents a complete list of the materials provided at the public open houses and the written comments that were received. Permitting Requirements Submittal requirements and permitting procedures are considered in the identification of opportunities and constraints. Permits from local, state, or federal government agencies may be required for the construction of new transmission facilities. Permitting requirements must be met to obtain approvals and to keep the Project on schedule by meeting in-service dates. Legal considerations are important in acquiring necessary land rights. It is preferable to avoid these areas when less damaging alternatives are equally or more practical. November 2006 11-13 Fort Saint Vrain to Fordham 230kV Transmission Line Project Weld County 1041 Permit Application Exclusion Exclusion areas have the highest level of sensitivity. Legislative constraints or extreme geophysical conditions are not compatible with transmission line construction, operation, or maintenance. A transmission line located in these areas results in more environmental effects, higher costs, and additional regulatory approvals. Resource data were categorized and mapped as opportunity, avoidance, or exclusion areas and then combined to provide visual representation of the Project area and to create an opportunities and constraints composite map for siting alternatives (Figure 3). The Alternatives Analysis Process The next phase of the alternative corridor analysis involved selecting potential corridors in opportunity areas. Corridors were selected by visually examining the composite opportunity and constraints map to identify corridors that would maximize the extent of opportunity areas crossed while minimizing the extent of avoidance areas crossed. The following section briefly describes the alternative corridors that were identified. Alternatives Considered Three alternatives, Alternative A, Alternative B, and Alternative C, were considered and eliminated from further studies. It was determined that they did not provide the benefits of the selected alternative and would have had greater adverse environmental effects and had significant topographic constraints. These alternatives are described below. Alternative A Alternative A used the Fort Saint Vrain to Longs Peak 230-kV transmission line between the Fort Saint Vrain Substation and Platte River's Longs Peak Substation. An overhead-to- underground transition pole would have been located near the intersection of the transmission line and the Great Western Railway near Mead. From this transition pole to the Weld County/Boulder County line, the Project would have been aligned within the existing ROW of the Great Western Railway. In Boulder County, the Project would have continued underground, generally following the Great Western Railway west to Third Avenue. The Project remained within Third Avenue until it veered southwest to enter the Rodgers Road ROW, near the intersection of Alpine Street. The Project followed Rodgers Road northwest until Lashley Street, at which point it headed due west until it approached Martin Street. The alignment, entirely overhead, then followed property lines south and west to WCR 950. Alternative B then followed WCR 950 south to the existing Tri-State Del Camino Tap to the Del Camino single-circuit 115-kV transmission line. Alignment B replaced the single-circuit poles with double-circuit poles to the Great Western Railway. At this point, Alternative B used the Great Western Railway ROW on poles into Boulder County. Alternative B transitioned to an underground alignment at County Line Road because of topographic constraints. Alternative C Alternative C used the Fort Saint Vrain to Longs Peak 230-kV transmission line ROW to a point due north of the Wyco Substation on WCR 32. The alignment, entirely overhead, then followed property lines south and west to WCR 950. Alternative C then followed WCR 950 south to the existing Tri-State Del Camino Tap to the Del Camino single-circuit 115-kV transmission line. Alignment B replaced the single-circuit poles with double-circuit poles to its intersection with 1-25. Alternative C followed 1-25 south to Weld CR 28. At this point, Alternative C traveled west along WCR 28 on new poles until its intersection with the Great Western Railway, where it used the Great Western Railway ROW on new poles into Boulder County. Alternative C transitioned to an underground alignment at County Line Road because of topographic constraints. Preferred Alternative Alternatives A, B, and C utilized the existing ROW for the Great Western Railway to varying extents. Although using an existing ROW is considered an opportunity, Alternatives A, B, and C were not preferred because of the physical constraints associated with the shared portion of the Great Western Railway ROW; they were consequently eliminated from further consideration. The rolling topography and numerous irrigation ditches increased the potential for adverse environmental impacts. Housing density in the vicinity of Mead also presented a conflict. A train trestle confined the width of space available for the construction of a buried transmission line. The preferred alternative recommended for permitting utilizes an existing ROW for a 230-kV transmission line for the majority of the Project and does not have the physical constraints that are associated with the Great Western Railway ROW. Public involvement and community values are important considerations in selecting a preferred alternative.After receiving input from the first two public open house meetings, the preferred alternative was brought before Platte River's Board of Directors. The Project presented in this application reflects the alignment authorized by the Platte River Board of Directors. The Project and its configuration are based on the ability to use existing ROWs, cost-effectiveness, reduced environmental impacts, and public input. r^ November 2006 II-17 r III. AREAS AND ACTIVITIES OF STATE INTEREST- APPLICATION REQUIREMENTS Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application 21-3-330 Application Submittal Requirements 21-3-330.A Applicability These submittal requirements are applicable for a development permit for a major facility of a public utility. 21-3-330.6 Requirements for a Major Facility of a Public Utility 21-3-330.8.1 Map Requirements All map requirements, including scale as approved by Boulder County, have been met. 21-3-330.B.2 Title Information 21-3-330.6.2.a Surface Property Owners The names and addresses of all owners of surface property within 500 feet of the centerline of the alignment are provided in Appendix B. 21-3-330.B.2.b Access to the Project Area Platte River has easements that include the right of access with property owners along the existing transmission line between Fort Saint Vrain and the Longs Peak Substation. These easements were signed in 1978. Platte River has met with the property owners along the new underground segment to discuss ROW acquisition and will make every effort to reach a negotiated settlement. The Planning Department, the Planning Commission, or the Board of County Commissioners has requested no other additional information. 21-3-330.8.5.a Present Use and Zoning The Project area is zoned agricultural, except for Section 30 (T3N R63W), which is zoned for residential use. Zoning is shown on Figure 6. Portions of this section are zoned R-1 (Low- Density Residential Development). 21-3-330.B.5.b-d Transmission Line Maps Figures 5a and 5b show all of the existing pipelines with a minimum 10-inch diameter and all transmission lines 115-kV or greater for a distance of 2 miles beyond the alternatives that were studied. Other major facilities of a public utility within 5 miles of the proposed electric transmission line are also shown in Figures 5a and 5b. Research was conducted to identify utility company facilities located or proposed to be located within the Project area. Each utility company was contacted via telephone and a second attempt was made via U.S. mail in attempt to obtain location information. Data gathered to date are shown on Figures 5a and 5b. A complete list of utilities contacted is included as Appendix D. The Utility Notification Center of Colorado will be contacted and a locale will be conducted prior to engineering design work and again within 30 days of construction to identify the exact location of underground utilities. Engineering input is vital to ensure that construction activities are safely performed and that operation is reliable and safe and regularly and effectively maintained. Engineering input is also important in minimizing adverse environmental effects, maintaining the schedule, and staying within the budget. Acquisition of Land Rights Siting new transmission facilities requires that necessary land rights for access, construction, operation, and maintenance are obtained. These land rights for linear facilities are generally e•-• easements; therefore, the fee ownership does not change. Platte River obtained an easement for the existing transmission line from Fort Saint Vrain to Longs Peak Substation in 1977/78. The new underground easements will be 25 feet wide (approximately 3 acres per mile of underground line)and an additional 30 feet of temporary construction easement will be acquired to enable the construction equipment to operate around the open trench. Platte River will meet with each landowner to discuss the value of the easement crossing the property. Negotiation will be based on the recent sale of other similar properties, the impacts on specific improvements on the property, and the amount of property needed for the easement and temporary construction access. Platte River will make every effort to reach a negotiated settlement. If an agreement cannot be reached, Platte River has the legal authority to acquire the required land rights by eminent domain (C.R.S. 38-5-105). Platte River has an existing easement for the improvements associated with the existing Fort Saint Vrain to Longs Peak overhead transmission line. A new easement will be required for the segment from the transition pole south to the Boulder-Weld County line. Methodology The method used to identify alternative locations for the Project began with delineating the Project area between the Fort Saint Vrain Substation in the northeast and the Fordham Substation in the southwest. Areas that presented obvious constraints were eliminated from further consideration. Data were acquired for the Project area to determine which areas offer the most opportunity for siting the transmission line and which sensitive areas should be avoided. Each resource in the November 2006 II-11 Fort Saint Vrain to Fordham 230kV Transmission Line Project Weld County 1041 Permit Application Project area was categorized as an opportunity, avoidance, or exclusion, based on how resources in those areas might be impacted by the Project. Data Acquisition Geographic data were obtained from the following sources: • U.S. Department of Agriculture, Natural Resource Conservation Service • U.S. Department of the Interior, Geological Survey • U.S. Department of Homeland Security, Federal Emergency Management Agency • Colorado Department of Higher Education, Office of Archaeology and Historic Preservation • Colorado Department of Natural Resources, Division of Wildlife • Colorado Department of Transportation • Weld County Planning Department • Boulder County Planning Department • City of Longmont Site Evaluation Generally, alternatives that maximize proximity to opportunities and minimize proximity to avoidance and exclusion areas were identified and evaluated. The general characteristics of opportunities, avoidances, and exclusions are defined below. Table 2 summarizes the resources that are known to exist within the Project area and the criteria that define them as an opportunity, avoidance, or exclusion. Specific locations of plant species, such as the Ute ladies'-tresses orchid, for example, are not mapped. Surveys for such resources are generally scheduled following issuance of a permit and are conducted immediately prior to construction. Opportunity Opportunity areas include existing ROWs for linear facilities, such as existing transmission lines, railroads, or major transportation corridors. Linear facilities that provide suitable access for construction and maintenance are compatible with the Project's character. Avoidance Avoidance areas include sensitive areas that would likely incur adverse environmental or land use effects if used by the Project. II-12 November 2006 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application 21-3-330.B.5.e Type of Facility 21-3-330.8.5.e.i Voltages and Lengths of Transmission Lines The length of the proposed transmission line through Weld County is approximately 14 miles. The entire distance consists of a 230-kV circuit. Approximately 5 miles of the 230-kV transmission line would be underground and approximately 9 miles of the transmission line would be overhead and utilize existing transmission line poles. 21-3-330.B.5.e.ii Power Source and Generating Capacity Construction of the Project would begin near Xcel Energy's Fort Saint Vrain Substation; however, the power source for the Project is Platte River's Rawhide Energy Station and its 230-kV connections at Ault Substation, approximately 12 miles north of Greeley. The Ault Substation receives a portion of its power from Platte River's Rawhide Energy Station in Larimer County, the Craig Station, and federal hydroelectric generation facilities. Approximately 325 megawatts (MW)of Platte River generation flows through the Ault Substation and then into Fort Collins and the Fort Saint Vrain Substation. 21-3-330.B.5.e.iii Function and Sizes of Substations No new substations are proposed in Weld County for this Project. Additional switching equipment will be added at the existing Fort Saint Vrain Substation to tie into the new 230-kV circuit. 21-3-330.8.5.e.iv Diameter and Lengths of Pipelines There are no pipelines included in the Project. 21-3-330.B.5.e.v Capacities of Storage Tanks No storage tanks are included in the Project. 21-3-330.B.5.e.vi Corridor Locations The corridor locations and segment lengths are described in detail in Section II of this application, Approach to Site Selection. A location map is shown on Figure 1. 21-3-330.8.5.e.vii Service Area The service area for the Project is Longmont, Colorado. However, because of the interconnected nature of electric transmission systems owned by other utility companies, improvements to any part of the transmission infrastructure would benefit the region through greater reliability in the delivery of energy. 21-3-330.B.5.e.viii Resource Area Although construction of the Project begins near Xcel Energy's Fort Saint Vrain Substation, the power for the Project is generated at Platte River's Rawhide Energy Station, located in Larimer County approximately 18 miles north of Fort Collins; the Craig Station, in Craig Colorado; and federal hydroelectric generation facilities in the western United States. The November 2006 111-13 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Rawhide Energy Station and Craig Station are powered by low-sulfur coal from the Powder River Basin coalfields in north-central Wyoming and mines in western Colorado near Craig. Platte River and Xcel Energy jointly own a 230-kV transmission line that connects to the Fort Saint Vrain Substation. 21-3-330.8.5.e.ix Support Facilities Temporary construction staging and parking facilities will be located at the Longs Peak Substation and/or Platte River's Northwest Substation in Longmont during construction . Staging facilities include a construction trailer, sanitation facilities, and drinking water as required by the Weld County Building Code. Materials used in the installation of the underground conduit system may be stored along the ROW and/or at Longs Peak Substation in the immediate area of construction activities. No long-term parking facilities will be necessary for the operation and maintenance of the Project. 21-3-330.B.5.f Projected Development Schedule 21-3-330.8.5.0 Number of Employees and Shifts No new permanent full-time or part-time on-site employees will result from the Project. Approximately 50 workers would be involved in the construction of the Project. It is expected that construction would take place during one shift per day during daylight hours and five or six workdays per week. The peak number of workers at any given time would be approximately 25, dispersed along the alignment. The Project would be constructed with standard overhead and underground transmission line construction vehicles and equipment. Table 3 provides a breakdown of personnel and equipment requirements by construction activity. Platte River may choose to alter the schedule of the job slightly. 21-3-330.B.5.f.ii Future Phases or Extensions There are no future phases or extensions associated with this Project in unincorporated Weld County envisioned at this time. 21-3-330.B.5.f.iii Timetable Platte River anticipates submitting applications for local permits to Weld County and Boulder County in fall 2006. Once all of the land use permits have been obtained, Platte River will submit in spring 2007 an application to CDPHE for a Construction Activities Permit, a Construction Dewatering Permit, and a general Construction Permit. Platte River will also submit in early 2007 an application to the USACE for a NWP 12. 21-3-330.B.5.f.iv Construction and Operation Timetable Construction would begin in late summer 2007. Construction, performed in phases, would take approximately 1 year to complete (Table 3). The Project is expected to be operational in fall 2008. 21-3-330.B.5.g Hazards and Emergency Procedures 21-3-330.B.5.g.i Hazards to Health, Safety, and Welfare of Public The greatest hazard from a transmission line is direct contact with the conductors, irrespective of voltage. However, physical contact between a grounded object and the high- voltage conductors is not necessary for electrical contact to be made. Arcing can occur across an air gap. Workers must use extreme caution when they operate tall machinery and equipment close to the transmission line ROW. The existing transmission lines will be taken out of service as needed to provide a safe work environment for construction activity. Numerous scientific studies have been conducted to better understand whether there is a connection between electromagnetic fields (EMF)and certain adverse health effects. In Health Effects from Exposure to Power-Line Frequency Electric and Magnetic Fields, the National Institute of Environmental Health Sciences (1999) concluded the following: "Virtually all of the laboratory evidence in animals and humans and most of the mechanistic work done in cells fail to support a causal relationship between exposure to ELF-EMF (Extremely Low Frequency Electric and Magnetic Fields)at environmental levels and changes in biological November 2006 III-15 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application function or disease status." Platte River remains sensitive to the EMF issue and responds to inquiries with currently available information promptly and accurately. Figures 7, 8, and 9 show expected levels of EMF for the existing overhead single circuit, proposed double overhead circuit, and proposed underground single-circuit transmission lines. 21-3-33O.8.5.g.ii Hazards of Environmental Damage and Contamination All construction, operation, and maintenance activities will comply with all applicable federal, state, and local laws and regulations and Platte River procedures regarding the use of hazardous substances. Platte River will hold a pre-construction meeting with the construction contractor to ensure that all applicable laws and Platte River's regulations will be followed. In addition, an on-site inspector will be present during construction to make sure that any hazardous materials are properly used and stored. Platte River's Standard Construction Mitigation Practices are attached as Appendix C. Hazardous materials will not be drained onto the ground or into streams or drainage areas. Completely enclosed containment will be provided for all trash. All construction waste, including trash and litter, garbage, other solid waste, petroleum products, and other potentially hazardous materials, will be removed to a disposal facility authorized to accept such materials. Any hazardous materials will be properly stored to prevent drainage or accidents when not in use. No explosive materials will be used for the purpose of excavation. Impacts to soil and vegetation could result from construction vehicle tires rolling across soil and vegetation, excavation activities related to installing the four new poles and burying the transmission line, and stresses related to the temporary placement of construction material on the ground within the construction ROW. Platte River will mitigate any construction-related damage by re-grading disturbed land to its pre-construction contours and by revegetating disturbed areas with appropriate plant species. 21-3-33O.8.5.g.iii Emergency Procedures Platte River operates a Power Dispatching Office in Fort Collins, Colorado, that is operational 24 hours a day, 7 days a week. All field operations are coordinated from this location. A list of all emergency numbers for police, fire, and medical services is maintained at the dispatching office. Should an accident occur to a citizen, a contractor, or a Platte River field crew member, and necessary response services are requested, the Power Dispatching Office will be used as the single point of contact until Weld County Paramedic Services' personnel can make visual contact with the field crew. The overhead segment of the Project would be entirely contained in the existing 110-acre Fort Saint Vrain to Longs Peak 230-kV transmission line ROW(100 feet wide, 9 miles long). 21-3-330.6.5.i Existing Land Use of the Right-of-Way The existing ROW is located in agricultural lands from the Fort Saint Vrain Substation to the overhead to underground transition pole east of Longs Peak Substation. The underground segment would also be located in agricultural areas, although the proposed line would be located in a rural residential area for 1 mile east of the county line. 21-3-330.B.5.m Existing Land Uses of All Properties Adjacent to Right- of-Way The land use adjacent to the Fort Saint Vrain to Longs Peak 230-kV transmission line is agricultural. It is characterized by large lots and low-density residential development. Land uses of properties adjacent to the ROW are shown on Figure 6. 21-3-330.B.5.n Present Zone and Overlay Zones Zoning is shown on Figure 6. Overlay flood zones are shown in Figure 10 and include the 100- r year floodplain as mapped by the Federal Emergency Management Agency. However, a list of surface property owners is included in Appendix B. 21-3-330.8.6 Natural and Socioeconomic Environmental Constraints An opportunity and constraints analysis was performed as part of the preliminary site selection to identify topographic and geographic features that would be compatible with construction, operation, and maintenance of the 230-kV transmission line. In general, areas of sensitive natural environments, including wetlands and riparian areas, water bodies, and potentially suitable habitat for threatened and endangered species (TES)or species of state concern, were avoided where possible. Socioeconomic constraints were limited to areas that are experiencing rapid development. For example, in 2004 the town of Mead received five applications for annexations of nearly 500 proposed residential units. The Project will avoid newly annexed residential areas. 21-3-330.8.7 Natural and Socioeconomic Environment Impacts to Vegetation, including Wetlands and Riparian Areas Short-term, temporary impacts to vegetation would be mitigated by Platte River through re- grading disturbed land to pre-construction contours and revegetating disturbed areas with appropriate plant species. Impacts to the natural environment will be greatly minimized by using the previously disturbed Fort Saint Vrain to Longs Peak 230-kV transmission line poles and ROW. Existing overhead electric transmission poles would be used for an approximate 9-mile segment, or 76 percent of the Project. There would be minimal disturbance to agricultural activity. The underground segment of the Project would allow agricultural uses to continue within the ROW. Construction activity would be limited to the transmission line ROWs. Several waterway crossings in Weld County are associated with the overhead rebuild. These water features and associated wetland and riparian vegetation are currently spanned and would continue to be spanned by the transmission line. Three waterway crossings and associated wetlands and riparian areas are located along the underground segment of the Project in unincorporated Weld County. Surface waters and corresponding wetlands and riparian areas are shown on Figure 11. Platte River will work with the appropriate ditch companies to help ensure necessary flows are maintained in the ditches. Platte River would obtain a NWP 12 from the USAGE prior to construction. This permit covers temporary impacts to waterways and any wetlands that may exist in the Project area. Platte River would pump any groundwater that it encounters out of the underground trench and subsequently filter it through a dewatering structure.A dewatering permit would be obtained from CDPHE. Four new poles would be installed between the Fort Saint Vrain Substation and Mead at locations within an existing ROW where the existing transmission alignment changes direction. Care would be taken to prevent the excavated soil from spilling into waterways. Platte River will mitigate any construction-related damage by re-grading disturbed land to its pre-construction contours and by revegetating disturbed areas with appropriate plant species. Wildlife and Wildlife Habitat The following is a summary of potential impacts to wildlife from construction and operation of the 230-kV transmission line. In general, impacts to wildlife would include temporary disturbance from construction-related activities that would likely cause temporary avoidance of the area by some species. Long-term impacts to wildlife habitat would be limited to the tower footings. Terrestrial wildlife likely to occur within the proposed transmission line corridor include mule deer(Odocoileus hemionus), coyote(Canis latrans), red fox(Vulpes vulpes), striped skunk (Mephitis mephitis), American badger(Taxidea taxus), cottontail rabbit(Sylvilagus audubonii and Sylvilagus floridanus), various rodents, and a number of avian species. Impacts to terrestrial wildlife from construction and operation of the transmission line are expected to be minimal and would primarily result in temporary disturbance or displacement during construction activities. Because the Project would occur in an existing ROW, it is expected that wildlife have become habituated to the presence of a transmission line in the area. The potential for avian collision is the primary wildlife impact related to the overhead segment of the proposed transmission line. Areas where the transmission line would span surface waters are of particular concern, because they act as foraging concentration areas and migration corridors. Collision impacts are mitigated in part through construction of the line within an existing transmission ROW. The transmission line will also be constructed using Avian Power Line Interaction Committee (APLIC)guidelines. The proposed 230-kV circuit, comprised of three conductors, is designed with adequate conductor spacing (18 to 20 feet)to preclude electrocution of even the largest birds, such as golden and bald eagles,that can have wingspans of more than 7 feet. Aquatic habitats for fish and amphibian species occur within and in proximity to the proposed ROW. Most of the surface waters would be spanned by the overhead transmission line rebuild.The Project may result in inadvertent mortality to less mobile amphibian species in the ROW along the underground segments; the Project would not result in adverse effects, however, to amphibian populations in the area. Mitigation practices, such as using erosion controls and conducting construction activities during low flow, would help to minimize impacts to aquatic species (Appendix C). November 2006 11129 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Raptors such as the ferruginous hawk(Buteo Regalis), red-tail hawk(Buteo Jamaicensis), Swainson's hawk(Buteo Swainsoni), and bald (Haliaeetus Leucoccephalus)and golden (Aquila Chrysaetos)eagle may occur within the proposed corridor. Raptors may be found foraging throughout the Project area. There are no known active raptor nests within the proposed ROW. Other avian species that may be present within the Project area include sparrows(Spizella spp.), red-winged blackbirds (Agelaius phoeniceus), mourning doves (Zenaida macroura), western meadowlarks (Stumella neglecta), and black-billed magpies (Pica pica)among others. Waterfowl that may occur near surface waters in the vicinity of the Project area include various species of ducks (Anas spp.), Canadian geese(Brenta Canadensis), American white pelicans(Pelecanus erythrorhynchos), great blue herons (Ardea Herodias), and long-billed curlews (Numenius americanus)among others. Colorado Department of Wildlife (CDOW)data show that the entire extent of Saint Vrain Creek in the Project area is foraging habitat for the great blue heron. Great blue heron nest sites are located adjacent to Ish Reservoir, 2 miles north of the Project area, and along Saint Vrain Creek, 2 miles south of the Project area. Neither of these nest sites would be directly affected by the Project. Special Status Plant and Wildlife USFWS was contacted to obtain information on federally listed species of concern within the proposed ROW. Data from the CDOW and the Natural Diversity Information Source (NDIS) were used to determine those species of concern that could potentially occur within the vicinity of the proposed transmission line corridor. Federally listed species with potential to occur in the area include the federally threatened bald eagle (Haliaeetus leucocephalus), Preble's meadow jumping mouse(Zapus hudsonius preblei), Ute ladies'-tresses orchid (Spiranthes diluvialis), and Colorado butterfly plant(Guara neomexicana coloradensis). Additional state-listed species with the potential to occur in the Project area include the state-threatened western burrowing owl (Athene cunicularia)and the state-sensitive black-tailed prairie dog (Cynomys ludovicianus). The federally threatened bald eagle is known to nest and roost along the Saint Vrain River (Figure 12). The nearest known nest location is approximately 0.50 mile from the proposed ROW. The nest is currently surrounded by three existing transmission lines, the Fort Saint Vrain Substation, the Fort Saint Vrain power plant, and the Great Western Railway. The proposed transmission upgrade in this area would occur within an existing ROW, so potential adverse effects to bald eagle nesting habitat is expected to be minimal. All practicable attempts would be made to avoid construction within 0.50 mile of an active eagle nest during nesting season. If construction were to occur during the nesting season, written approval by USFWS would be obtained prior to construction and the appropriate mitigation measures would be implemented. The Project would span potential roosting habitat in the southwestern corner of the Project area along Saint Vrain Creek. Platte River would select a route over the creek that would require minimum removal of riparian tree species to avoid permanent effects to potential roosting habitat. I Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Temporary impacts to roosting and foraging bald eagles in the Project area include disturbance and displacement during construction activities. The primary potential risk to bald eagles foraging in the Project area is the risk of collision with the transmission lines. Bald eagles are not typically at such risk because they have keen eyesight, but a low increased risk of collision is acknowledged. As an aid in compliance with the Migratory Bird Treaty Act(MBTA), surveys may be conducted prior to construction to identify new roosting and nesting sites that may occur within the proposed ROW. If a new nest or roost site is found, USFWS would be contacted prior to construction to avoid impacts to bald eagles. The Preble's meadow jumping mouse (PMJM) is listed as a federally threatened species. According to USFWS (http://mountain-prairie.fws.qov/preble/), this species is able to live and reproduce in and near riparian areas located within grassland, shrubland, forest, and mixed vegetation types where dense herbaceous or woody vegetation occurs near the ground level, where available open water exists during their active season, and where there are ample upland habitats of sufficient width and quality for foraging, hibernation, and where there is refuge from catastrophic flooding events. The Project area is not in the vicinity of and does not contain any USWFS-designated critical PMJM habitat(USFWS 2006). The Project area contains perennial water sources, but lacks the shrubby understory and adjacent uplands that the PMJM requires. Results of field investigations show that there is neither suitable habitat nor known occupied range for PMJM. It is therefore unlikely that PMJM occurs in the Project area (USFWS 2006). When the Ute ladies'-tresses orchid was listed as federally threatened in 1992, it was known to exist in moist meadows associated with perennial stream terraces, floodplains, and oxbows at elevations between 4,300 and 5,550 feet(http://www.natureserve.org/explorer). Most sites were reported from openings where vegetation cover was not overly dense or heavily grazed. According to Rangewide Status Review of the Ute Ladies-Tresses Orchid, surveys since 1992 have expanded the number of vegetation and hydrology types occupied by Ute ladies'-tresses orchid to include seasonally flooded river terraces, subimigated or spring-fed abandoned stream channels and valleys, and lakeshores (Walter Fertig, Rick Black, and Paige Walken 2005). In addition, 26 populations have been discovered along irrigation canals, berms, levees, irrigated meadows, excavated gravel pits, roadside barrow pits, reservoirs, and other human- modified wetlands (Walter Fertig, Rick Black, and Paige Walken 2005). In 1992, a population of the Ute ladies'-tresses orchid was recorded in Boulder County along Saint Vrain Creek. The Project area contains various surface water features that may potentially provide habitat for the Ute ladies'-tresses orchid.The portions of the transmission line that are overhead would span potential habitat and no adverse impacts to these species are expected. On the underground portions of the line, trenching would occur through potential habitat. In these areas, surveys would be conducted by knowledgeable specialists for the Ute ladies'-tresses orchid prior to construction and according to USFWS guidelines to avoid impacts to this species. Areas where the transmission line would be buried and trenched would be restored and revegetated once construction has been completed. Standard construction practices include r November 2006 III-33 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application weed management within the ROW. No long-term impacts to wetland habitat, therefore, would occur as the result of the Project. The Colorado butterfly plant was listed in 2000 as a federally threatened species. It occurs on subirrigated, alluvial soils on level or slightly sloping floodplains and drainage bottoms at elevations of 5,000-6,400 feet. Colonies are often found in low depressions or along bends in wide, meandering stream channels, a short distance upslope of the actual channel. According to USFWS, field studies suggest that the Colorado butterfly plant has been extirpated from its historical range in Larimer and the surrounding counties(http://mountain- prairie.fws.gov/species/plants/cobutterfly/)and is therefore unlikely to occur within the Project area. However, the project would cross several surface waters, including Saint Vrain Creek. USFWS would be contacted prior to construction to determine whether surveys are required. If surveys are required, they would be conducted by knowledgeable specialists and according to USFWS guidelines. Areas where the transmission line would be buried and trenched would be restored and revegetated once construction has been completed. Standard construction practices include weed management with the ROW. No long-term impacts to wetland habitat, therefore, would occur as the result of the Project. Socioeconomic Environment Construction activities would have minimal effect on the socioeconomic environment. The town of Mead has the only retail establishments along the alignment in Weld County, and it is likely that these retail establishments and local restaurants will benefit from increased business by construction workers. The total number of construction workers will reach approximately 50,with a maximum number of 25 working at any one time over a 1-year period. Potential adverse effects resulting from the transmission line's proximity to residences would be minimized or negated by designing the line in accordance with the National Electrical Safety Code. Portions of the Project would be placed underground which will mitigate visual impacts. Unique Areas of Geologic, Historic, or Archaeological Importance A Class I archaeological survey has been completed. Consultation with the Colorado Office of Archaeology and Historic Preservation has been conducted to asses and avoid potential impacts to historic and archaeological sites of importance. Should any previously unknown historic/prehistoric sites or artifacts be encountered during construction, all land altering activities at that location will be immediately suspended and the discovery left intact until such time that Platte River notifies the consulting archaeologist or the State Historical Society and appropriate measures taken to assure compliance with the National Historic Preservation Act and enabling legislation. III.34 November 2006 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application 21-3-330.B.8 Long-Term Effects upon Physical and Socioeconomic Development The Project will not cause adverse long-term effects on physical development. In terms of socioeconomic development, the Project will provide reliable delivery of energy to Longmont and the surrounding area. Reliable energy delivery allows businesses to operate without interruption caused by brownouts during peak demand periods. The Project will also meet the demand forecast for the Longmont area. The Project will benefit the surrounding area with support to the interconnected electric transmission system. However, the Project by itself will not add to economic development. 21-3-330.6.9 Mitigation of Adverse Impacts and Maximization of Positive Impacts Positive impacts of the Project will result from upgrading the transmission network in Longmont, Weld and Boulder counties. Because of the interconnected nature of electric transmission systems owned by separate utility companies, improvements to any part of the transmission infrastructure would provide benefits to the region through greater reliability in the delivery of energy. All practicable efforts would be made to restore any disturbed land to its original contour and to restore natural drainage patterns along the ROW. All practical efforts would be made to re- establish native vegetation in the disturbed area, if appropriate. The total construction period will be approximately 1 year. Platte River's Standard Construction Mitigation Practices, included as Appendix C, address site reclamation of disturbed areas. All applicable fire laws and regulations, as provided by C.R.S. 31-16-601, will be observed during the construction period. Platte River will advise construction personnel of their responsibilities under the applicable fire laws and regulations, including taking practical measures to report and suppress fires. 21-3-330.8.10 Non-Structural Alternatives Two non-structural alternatives for the Project exist, including a No Action alternative and Demand-Side Management(DSM). Under the No Action alternative, no transmission line would be constructed or upgraded in the Project area. Because the line would not be constructed, no Project-related disturbances would occur. The purpose of the Project is to ensure that Platte River can continue to reliably supply electricity to Longmont. The need for the Project is to meet projections of electric load growth as a result of commercial and residential development, existing customers using more electric appliances and devices in their homes and at work and to enhance reliability of the Longmont transmission system. The No Action alternative would eventually result in failures of the transmission system during periods of peak demand. DSM consists of planning, implementing, and monitoring activities of electric utilities that are designed to encourage consumers to modify their level and November 2006 III-35 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application pattern of electricity usage. DSM programs do not address the issue of increasing reliability in the transmission delivery system or increased demand associated with the population growth that is expected to occur through 2016. This alternative would therefore neither fulfill the purpose of Platte River nor its obligations to serve its customers. 21-3-330.B.11 Structural Alternatives The rapidly changing character of the area to a higher density, multi-use urban/suburban setting from a largely rural, agricultural setting created a variety of constraints regarding the siting of the 230-kV transmission line. Each alternative brought its own set of issues and concerns that had to be incorporated into the site selection process. The approach to site selection, therefore, was to consider all feasible alignments and ultimately select a preferred alignment that was economically sound, environmentally compatible with land use, existing environmental conditions, and future plans. Section II, Approach to Site Selection, describes the alternatives that were considered. 21-3-330.8.12 Air and Water Pollution Impacts Air Quality During construction, fugitive dust may be generated during periods of dry weather in areas where soil has been disturbed for installation of new poles or construction of the underground segment. Dust suppression would be performed by applying water to the area of disturbance, where necessary. After construction is completed, but before vegetation has been re-established, some minor amount of additional dust could occur. Dust-suppression activities would be monitored by Platte River and appropriate action taken to control the dust and ensure that potential wind erosion is minimized. The U.S. Environmental Protection Agency(EPA)designated Longmont a maintenance area for carbon monoxide in 1999. The projected carbon monoxide emissions in 2006 are less than budgeted, so maintenance of federal carbon monoxide National Ambient Air Quality Standards would be demonstrated in accordance with CDPHE's Revised Carbon Monoxide Maintenance Plan for the Longmont Attainment/Maintenance Area(2003). Longmont is within the Denver Metropolitan PM10 (particulate matter less than 10 microns in diameter)Attainment/Maintenance Area, which was re-designated to attainment status from non-attainment status for PM10 in 2001. CDPHE's PM10 Redesignation Request and Maintenance Plan for the Denver Metropolitan Area (2001)includes PM10 emission estimates for construction activities in general. Weld County is an attainment area for all measured pollutants, including PM10. No long-term adverse air quality effects would occur from the Project. Water Quality A bored casing for conduit and cable may be installed under irrigation ditches and/or creeks where necessary. Otherwise, trenching would occur during low-flow periods. This method would not require water diversion. Methods of construction will be determined during the engineering III-36 November 2006 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application phase. All temporary, construction-related impacts to waterways would be in conformance with USAGE procedures for obtaining an NWP 12. No new or upgraded municipal services would be needed to serve the 230-kV transmission line. 21-3-330.8.13 Design Alternatives—Access, Landscaping, and Architecture Access to the Project would be provided by existing public roads and the existing Fort Saint Vrain to Longs Peak ROW and along the easements to be acquired for the Project. Specific access through existing gates or through new locations would be agreed upon by Platte River and each property owner. The access points would not require architectural or landscape treatments beyond restoring any disturbed land to its pre-construction condition. 21-3-330.6.14 New or Upgraded Services No new or upgraded municipal services would be needed to serve the 230-kV transmission line. 21-3-330.8.15 Hydrologic, Atmospheric, Geologic, Pedologic, Biotic, Visual, and Noise Impacts Hydrologic The overhead segment of the Project crosses several waterways in unincorporated Weld County. The waterways would be spanned by the overhead transmission line, so there will be no impacts to surface waters along these segments. Existing access routes, where possible, would be used by construction vehicles during construction. Four new poles would be installed between the Fort Saint Vrain Substation and the town of Mead at locations within the existing ROW where the existing transmission alignment changes direction. The new poles would be placed within 15 to 20 feet of existing poles, so excavation for the foundations will not adversely affect hydrologic conditions. Three waterway crossings are located along the underground segment of the Project in unincorporated Weld County. Platte River would obtain a NWP 12 from USAGE prior to construction. This permit covers temporary impacts to waterways and any wetlands that may exist. Platte River would pump any groundwater that it encounters out of the underground trench and subsequently filter it through a dewatering structure.A dewatering permit would be obtained from CDPHE. Care will be taken to minimize necessary operation of construction vehicles and equipment in and near the waterways. Erosion and sedimentation control measures set forth in Platte River's Standard Construction Mitigation Practices(Appendix C)would reduce the potential for increased stream turbidity. Platte River would restore any wetlands that are disturbed during construction. Construction of the Project and temporary impact to wetlands will require that an NWP 12 be obtained from USAGE. The application process for the NWP 12 will begin once the Weld County 1041 permit application has been approved. No long-term impacts to wetlands would occur. November 2006 III.37 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Platte River would consult with the Weld County Planning Department and the Weld County Public Works Department regarding any floodplain hazards if construction occurs within the 100-year floodplain area between the Fort Saint Vrain Substation and Lake Thomas. Platte River would design the Project to withstand any potential flooding that may be experienced along the Saint Vrain Creek and the unnamed tributary floodplains. Platte River plans to install the additional poles and conductor to the existing transmission line during fall and winter 2007/08. Atmospheric The Project will have no long-term impact on air quality. During construction,fugitive dust may be generated during periods of dry weather in areas where soil has been disturbed for installation of new poles or construction of the underground transmission line. After construction is completed, but before vegetation has been re-established, some minor amount of additional dust could be generated. Dust-suppression activities will be monitored by Platte River and appropriate action taken to control the dust and ensure that potential wind erosion is minimized. Geologic No hazardous geologic conditions exist within the proposed ROW. No adverse geologic effects would occur as a result of the Project. Pedologic Soil shrink/swell potential and erodibility are shown in Figures 13 and 14. The proposed transmission corridor includes the Wiley-Colby-Weld and Aquolls-Aquents-Bankard soil complexes: Wiley-Colby-Weld The soils in this unit are deep, nearly level to moderately sloping,well-drained loamy and looms formed in calcareous eolian deposits. Erodibility:The measure of erodibility is based on the soil's K factor, which indicates the susceptibility of a soil to sheet and rill erosion by water. Wiley and Colby soils have a high erodibility factor.Weld soils have a moderate erodibility factor. Shrink/Swell Potential: Weld soils have a high shrink/swell potential. Colby soils have a low shrink/swell potential. Wiley soils have a moderate shrink/swell potential. Aquolls-Aquents-Bankard The soils in this unit are deep, level and nearly level, poorly drained and somewhat excessively drained loamy soils and sandy loamy formed in alluvium. Erodibility:Data were not available or estimated for Aquolls or Aquents soils. Bankard soils have a low erodibility factor. Long-term effects would be minimized through adherence to Standard Mitigation Practices(Appendix C), in addition to the following mitigation procedures: • Movement of construction vehicles and equipment will be limited to the temporary construction ROW and permanent ROW, existing Weld County roads, and other access routes that may need to be negotiated with landowners. • Following completion of work, compacted soils will be loosened and leveled by scarifying, harrowing, disking, or other approved methods. • All disturbed areas will be re-graded and,where appropriate, revegetated to provide proper drainage, stabilize soils, and reduce erosion • Construction-phase sediment and erosion control measures will be implemented as appropriate. Biotic Biotic impacts are described above in Section 21-3-330.B.7. Visual The project would not result in significant visual impacts. The overhead segment would add four new poles that would be installed between the Fort Saint Vrain Substation and the town of Mead at locations within the existing ROW where the existing transmission alignment changes direction. The new poles would be similar in height and diameter to the existing poles. The new poles would be placed within 15 to 20 feet of the existing poles. The overhead to underground transition pole would be erected at a point east of Longs Peak Substation. This pole would be similar in height to the existing poles, but it would have a slightly larger diameter. The underground segment will not be visible. Noise No significant noise level will be generated by the Project. Audible noise from an overhead transmission line is produced by a phenomenon called corona. Corona is caused by the ionization of the air at the surface of the energized conductor and suspension hardware as a result of very high electric field strength. Corona is a function of voltage,the diameter of the conductor, and the condition of the conductor and suspension hardware. The electric field around an energized conductor is directly related to the line voltage and is greatest at the surface. The proposed 230-kV conductors for the Project would use a conductor of sufficient diameter to control corona effects. With 230-kV overhead construction, standard conductor attachment hardware is typically adequate to control corona. Higher voltages require special low-corona hardware. Environmental noise, including transmission line noise, is usually measured in decibels on the audible scale(dBA),which models the sound to correspond to human perception. Table 4 Ambient Noise Levels shows typical decibel levels for various settings. The background ambient noise level varies with wind, rain, traffic, or other human activity. However, measurements taken by the Bonneville Power Administration in Washington State identified median noise levels of about 44 dBA at the edge of existing ROWs for its 230-kV transmission lines(Bonneville Power Administration, Kangley-Echo Lake Transmission Line Project Supplemental Draft Environmental Impact Statement, January 2003). There are generally few complaints about transmission line noise for levels below 50 dBA (Electric Power Research Institute 1987). Construction would take place during one shift per day during daylight hours and five or six workdays per week. Table 5 shows typical equipment that would likely be used during construction of the overhead and underground segments and their associated noise levels. In Weld County, there are three surface water crossings where the underground segment of the line may be trenched through the water feature then buried. The trenching and placement of the cabling would be performed during the seasonal low flow period. This action would likely result in minimal, short-term impacts to water resources. There would be no long-term alteration in the pattern or intensity of surface drainage as a result of operation of the proposed transmission line. The new poles would have an approximate diameter of 6-8 feet. The underground segment would typically be placed at a depth of approximately 3 feet. There would be no direct impacts to subsurface drainage patterns as a result of the proposed Project. The surface would be re-graded and revegetated with an appropriate plant species. A range of measures to ensure that the Project would not impact surface and subsurface drainages is listed in Appendix C. 21-3-330.B.17 Any Other Information Required The Planning Director has requested no other information. November 2006 III-45 Appendix A Public Open House Materials Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application Standard Construction Mitigation Practices 1. Platte River Power Authority(Platte River)shall limit the movement of crews and equipment to existing roads,the existing right-of-way, and the construction easement, including access routes. Platte River shall limit movement in the right-of-way or construction easement to minimize damage to residential yards, grazing land, crops, orchards, and property, and shall avoid marring the lands. Platte River shall coordinate with the landowners to avoid impacting the normal function of irrigation devices during Project construction and operation. 2. When weather and ground conditions permit, Platte River shall obliterate all construction- caused deep ruts that are hazardous to farming operations and to the movement of equipment. Such ruts shall be leveled,filled and graded, or otherwise eliminated in an approved manner. Ruts, scars and compacted soils in hay meadow, alfalfa fields, pasture, and cultivated productive lands shall have the soil loosened and leveled by scarifying, harrowing, discing, or other approved methods. Damage to ditches, tile drains, terraces, roads, and other features of the land shall be corrected.At the end of each construction season and before final acceptance of the work in these agricultural areas, all ruts shall be obliterated, and all trails and areas that are hard-packed as a result of construction operations shall be loosened and leveled. The land and facilities shall be restored as nearly as practicable to the original condition. 3. Water runoff bars of small terraces shall be constructed across all right-of-way trails on hillsides to prevent water erosion and to facilitate natural re-vegetation on the trails. 4. Platte River shall comply with all federal, state, and local environmental laws, orders and regulations. Prior to construction, all supervisory construction personnel will be instructed on the protection of cultural and ecological resources. 5. Platte River shall exercise care to preserve the natural landscape and shall conduct its construction operations so as to prevent any unnecessary destruction, scarring or defacing of the natural surroundings in the vicinity of the work. Except where clearing is required from permanent works, approved construction roads, or excavation operations, vegetation shall be preserved and shall be protected from damage by Platte River's construction operations and equipment. 6. On completion of the work, all work areas except access trails shall be scarified or left in a condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. All destruction, scarring, damage, or defacing of the landscape resulting from Platte River's operations shall be repaired by Platte River. 7. Construction trails not required for maintenance access shall be restored to the original contour. The surfaces of such construction trails shall be scarified as needed to provide a C-1 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit -� Weld County 1041 Permit Application condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. 8. Construction staging areas shall be located and arranged in a manner to preserve trees and vegetation to the maximum practicable extent. On abandonment, all storage and construction materials and debris shall be removed from the site. The area shall be re- graded, as required, so that all surfaces drain naturally, blend with the natural terrain, and are left in a condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. If the staging area was previously used for storage or staging activities and does not require revegetation, the area will be cleaned of construction debris. 9. Construction activities shall be performed by methods that prevent entrance or accidental spillage of solid matter, contaminants, debris, and other objectionable pollutants and wastes into flowing streams or dry water courses, lakes, and underground water sources. Such pollutants and wastes include, but are not restricted to refuse, garbage, cement, sanitary waste, industrial waste, radioactive substances, oil and other petroleum products, aggregate processing tailings, mineral salts, and thermal pollution. 10. Dewatering work for transmission line trenching, structure foundations, or earthwork operations adjacent to, or encroaching on, streams or watercourses will not be performed without prior approval from appropriate state or federal agencies. 11. Excavated material or other construction materials shall not be stockpiled or deposited near or on stream banks, lake shorelines, or other water course perimeters where they can be washed away by high water or storm runoff or can in any way encroach upon the actual shore itself. 12. Waste waters from construction operations shall be handled in accordance with Corps of Engineers Nationwide Permit 12 and Colorado Department of Public Health and Environment Water Quality Control Division permit discharge requirements. 13. Platte River shall utilize such practicable methods and devices as are reasonably available to control, prevent, and otherwise minimize atmospheric emissions or discharges of air contaminants. This will include dust control measures such as the application of water to disturbed areas, as needed. 14. Burning or burying of waste materials on the right-of-way or at the construction site will not be allowed. Platte River shall remove all waste materials from the construction area. All materials resulting from Platte River clearing operations shall be removed from the right-of-way. Platte River shall make all necessary provisions in conformance with safety requirements for maintaining the flow of public traffic and shall conduct its construction operations so as to offer the least possible obstruction and inconvenience to the public traffic. 16. Platte River will apply necessary mitigation to eliminate problems of induced currents and voltages onto conductive objects sharing a right-of-way,to the mutual satisfaction of the parties involved. Platte River will install fence grounds on all fences that cross or are parallel to the proposed line. 17. Equipment and vehicles will avoid riparian areas on the right-of-way during construction and operation activities where possible and minimize impacts by using existing accesses. Existing bridges or fords will be used to access the right-of-way on either side of riparian areas. Concrete Washout Policy Applicable law does not allow dumping waste concrete or washout water into any stormwater drainage system. The concrete or wash water cannot be dumped where it can run into the drainage system. Waste concrete or wash water cannot be dumped into any river, creek, stream, irrigation canal, ditch or any other area where it can be transported into the drainage system. An area is considered acceptable to wash out or rinse off a concrete truck if the following conditions are met: 1 The area does not drain or otherwise convey material into any State waters such as, a ditch, storm sewer, creek, lake, river, wetlands, culvert, roadway, ravine, etc. 2 The area is not on private property. If the area is on private property you must have consent from the property owner that washing out in the designated area is permitted. 3 The contractor agrees that cleanup of the wash out/rinse off area will be the contractor's responsibility. 4 The area is not in a park, open space area, or a pristine environmental habitat. If at any time you question the contractor's judgment of a wash out area or feel the contractor will not follow through on cleanup procedures of an area, contact management immediately. This policy and guidelines are to prevent concrete or wash water from entering State and navigable waters. If a contractor directs an employee to disobey this policy,the employee is to explain The Company's position on the interpretation of the law(s)to the contractor, and notify a Company Management Representative and wait for further directions. Failure to comply with this policy will be subject to disciplinary action up to and including termination pending results of an investigation of the reported violation. Transmission lines transport electricity at high voltages, 69 kilovolts (kV) to 765kV, from power plants to distribution substations and between substations. Distribution tines carry the electricity at lower voltages, typically 13kV to 25kV, from substations to homes and businesses, where a small transformer reduces the voltage to 110 volts and 220 volts. The transmission network serving Longmont is comprised of high voltage transmission lines. Upgrades to this infrastructure are required in order to ensure that Platte River can continue to provide reliable electric service to Longmont and its customers and to accommodate increasing electric demand. PLATTE RIVER t I _ - POWER AUTHORITY -r�, ENGINEERING & CONSTRUCTION Transmission Line Design A 230kV transmission line exists between Fort Saint Vrain Power Plant and Platte River's Longs Peak Substation near Mead. Platte River plans to add , another 230kV transmission line to the empty circuit on this line. The existing o poles were designed to accommodate this proposed expansion. The proposed new 230kV transmission line will consist of single column steel oles that will have an approximate range in height of 85 feet to 120 feet depending on the span between poles and the local topography. The span between poles will have an approximate range of 700 feet to 900 feet. The single column steel poles will have a self-weathering finish that is a rusty brown or wood color. Land Use Land use in the Project Area is mostly agricultural with scattered residential subdivisions. The section of the Project Area in Longmont and unincorporated Boulder County is a densely developed mix of residential and business uses. Several residential subdivisions are planned in the Project Area south of Mead. Alternative routes have been identified to avoid residential areas where possible. • .:. ' " 4. , ii Agriculture Prime farmland, available land that has the best combination of physical characteristics for producing food, feed, forage, fiber, and oil seed crops, is r ! pervasive throughout the Project Area. The proposed new transmission line will = be placed along the edges of agricultural land uses or along property lines to minimize impacting the use of farmland. Environmental Resource Maps Water Resources and Floodplains Numerous perennial and intermittent streams, irrigation ditches, reservoirs, and wetlands in the Project Area are used for irrigation, household and industrial purposes, recreation, and wildlife habitat. One-hundred-year floodplains occur along Saint Vrain Creek and an unnamed tributary to Saint Vrain Creek. Other 100-year floodplains surround Mulligan and Foster reservoirs and Calkins Lake. The Project will avoid crossing water bodies and minimize impacts to floodplains, wetlands and other water resources. If the Project is not able to avoid these resources, the transmission line poles will be placed at appropriate locations to span them or mitigate any adverse impacts. Threatened, Endangered, and Special Status Species Platte River evaluated six species of federal or state concern to determine if they occur within the Project Area: • Bald eagle. No bald eagle nesting sites exist within the Project Area, however the entire Project Area is within bald eagle winter range. • Great blue heron. A nesting site is located in the south central part of the Project Area in Barbour Ponds State Park. Foraging areas are found near surface water within the Project Area. • Preble's meadow jumping mouse. Suitable habitat does not exist in the Project Area. This plant has the potential to occur within the Project Area. , Platte River will work with the U.S. Fish and Wildlife Service and Colorado Division of Wildlife to determine potential impact to species of federal or state concern or their habitat once a preferred route is selected. Species of federal or state concern that are discovered in the Project Area will be avoided and impacts to their habitat will be either avoided or mitigated according to appropriate regulations. I �, r i N :°tea + LAND RIGHTS Platte River Power Authority (Platte River) proposes to construct the Fort Saint Vrain to Terry 230 kilovolt (kV) Transmission Line Project (the Project) in Weld and Boulder counties. The Project consists of adding conductors to the empty circuit on the existing Fort Saint Vrain to Longs Peak 230kV transmission line and constructing a new 230kV transmission line from a point near the Town of Mead to Platte River's Terry Substation in Longmont. Platte River will acquire the necessary land rights for construction, operation and maintenance of the Project. After determining the transmission line route, Platte River will meet with landowners and begin easement acquisition. Project Land Requirements Platte River will acquire easements for the new transmission line. An easement, also known as a right-of-way, is a right given to a person or entity to use _ another's land for a specified purpose. Platte River requires easements for transmission lines and will pay the landowner for the easements. The easement acquisition process will commence after permits have been obtained from the n \, respective jurisdictions. \ - The width of an easement, generally 75 feet to 100 feet, depends on several factors, including voltage and topographic features. The exact widths needed for this Project will not be known until detailed design is completed later in 2005. The typical easements required for this Project are described below: • New conductor on existing structure - No new right-of-way required 75'•100 Right-of-Way --I • New transmission line - Typically 75 feet to 100 feet wide Example of new transmission line on • Upgrade of existing transmission line - Typically no new right-of-way single steel pole and associated tight- required, depending on existing easement and design of new transmission of-way requirement line • New transmission line in railroad right-of-way - Transmission line is a minimum of twelve feet from tracks, additional right-of-way depends on width of railroad right-of-way Normally, the landowner is not restricted from accessing the easement, and activities such as parking, storage, and agriculture can occur without constraints. Activities that typically are not permitted in transmission tine easements are those that reduce the ground-to-line clearance or jeopardize the integrity of the support structures. Landowners need to exercise caution when operating tall equipment, moving irrigation pipes, fueling vehicles, and w� conducting other activities within the easement to prevent electrical shocks. Appraisals Platte River will either order a basic data appraisal report from an independent fee appraiser or use market data from recent sales of similar properties to determine fair and appropriate compensation. Since part of the line is already indicated as underground, it would only be fair to treat all parties involved to the same, so everyone has a clear view to the west of the mountains of Colorado. 2) At the point were the line heads northeast on Weld County Road 5 the line needs to be on the West side of the railroad track to avoid the poles or power line being in the water from rain storms that occur sometimes. There used to be a natural lake on the East side of the track and sometimes the rain water that accumulates takes 3 or 4 days to empty from this area. My family has owns some of this ground to the East and west of the track on road 5 and my father drained the lake in the late 1950s. We are also going to put the lake back due to the value and need for more water in the front range of Colorado. The Longs Peaks water district was going to do the same thing for their water line but after knowing what is east of the railroad track they put the water line on the west side of Road 5 instead. In addition to that all of the farm ground west of Road 5 for 1.5 miles north of Weld County Road 26 is and always will be open space therefore it would make much more sense to place the line on that side of Road 5. 3) Do you also know about the proposed Liberty reservoir that the City of Longmont has a 1575 acre foot decree for? This proposed long range planned reservoir is on road 28 between roads 5 and 7 on the creek at about the half mile mark. The water would back up more than one-half mile north of road 28 so the proposed east west line at the half mile north of road 28 would end up the in the Liberty reservoir. Option 1) would be fair to all and following the county roads on the mile lines would eliminate potential issues that come along with 2) and 3) . Just a start, but changes need to be made to adjust for other issues that are already in place before the power line is installed as it is outlined in the letter that we received. Platte River Power Authority(Platte River)shall limit the movement of crews and equipment to existing roads,the existing right-of-way, and the construction easement, including access routes. Platte River shall limit movement in the right-of-way or construction easement to minimize damage to residential yards, grazing land, crops, orchards, and property, and shall avoid marring the lands. Platte River shall coordinate with the landowners to avoid impacting the normal function of irrigation devices during Project construction and operation. 2. When weather and ground conditions permit, Platte River shall obliterate all construction- caused deep ruts that are hazardous to farming operations and to the movement of equipment. Such ruts shall be leveled,filled and graded, or otherwise eliminated in an approved manner. Ruts, scars and compacted soils in hay meadow, alfalfa fields, pasture, and cultivated productive lands shall have the soil loosened and leveled by scarifying, harrowing, discing, or other approved methods. Damage to ditches, tile drains, terraces, roads, and other features of the land shall be corrected. At the end of each construction season and before final acceptance of the work in these agricultural areas, all ruts shall be obliterated, and all trails and areas that are hard-packed as a result of construction operations shall be loosened and leveled. The land and facilities shall be restored as nearly as practicable to the original condition. 3. Water runoff bars of small terraces shall be constructed across all right-of-way trails on hillsides to prevent water erosion and to facilitate natural re-vegetation on the trails. 4. Platte River shall comply with all federal, state, and local environmental laws, orders and regulations. Prior to construction, all supervisory construction personnel will be instructed on the protection of cultural and ecological resources. 5. Platte River shall exercise care to preserve the natural landscape and shall conduct its construction operations so as to prevent any unnecessary destruction, scarring or defacing of the natural surroundings in the vicinity of the work. Except where clearing is required from permanent works, approved construction roads, or excavation operations, vegetation shall be preserved and shall be protected from damage by Platte River's construction operations and equipment. 6. On completion of the work, all work areas except access trails shall be scarified or left in a condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. All destruction, scarring, damage, or defacing of the landscape resulting from Platte River's operations shall be repaired by Platte River. 7. Construction trails not required for maintenance access shall be restored to the original contour. The surfaces of such construction trails shall be scarified as needed to provide a C-1 Fort Saint Vrain to Fordham New 230-kV Transmission Circuit Weld County 1041 Permit Application condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. 8. Construction staging areas shall be located and arranged in a manner to preserve trees and vegetation to the maximum practicable extent. On abandonment, all storage and construction materials and debris shall be removed from the site.The area shall be re- graded, as required, so that all surfaces drain naturally, blend with the natural terrain, and are left in a condition that will facilitate natural re-vegetation, provide for proper drainage, and prevent erosion. If the staging area was previously used for storage or staging activities and does not require revegetation, the area will be cleaned of construction debris. 9. Construction activities shall be performed by methods that prevent entrance or accidental spillage of solid matter, contaminants, debris, and other objectionable pollutants and wastes into flowing streams or dry water courses, lakes, and underground water sources. Such pollutants and wastes include, but are not restricted to refuse, garbage, cement, sanitary waste, industrial waste, radioactive substances, oil and other petroleum products, aggregate processing tailings, mineral salts, and thermal pollution. 10. Dewatering work for transmission line trenching, structure foundations, or earthwork operations adjacent to, or encroaching on, streams or watercourses will not be performed without prior approval from appropriate state or federal agencies. 11. Excavated material or other construction materials shall not be stockpiled or deposited near or on stream banks, lake shorelines, or other water course perimeters where they can be washed away by high water or storm runoff or can in any way encroach upon the actual shore itself. 12. Waste waters from construction operations shall be handled in accordance with Corps of Engineers Nationwide Permit 12 and Colorado Department of Public Health and Environment Water Quality Control Division permit discharge requirements. 13. Platte River shall utilize such practicable methods and devices as are reasonably available to control, prevent, and otherwise minimize atmospheric emissions or discharges of air contaminants. This will include dust control measures such as the application of water to disturbed areas, as needed. 14. Burning or burying of waste materials on the right-of-way or at the construction site will not be allowed. Platte River shall remove all waste materials from the construction area. All materials resulting from Platte River clearing operations shall be removed from the right-of-way. Platte River shall make all necessary provisions in conformance with safety requirements for maintaining the flow of public traffic and shall conduct its construction operations so as to offer the least possible obstruction and inconvenience to the public traffic. 16. Platte River will apply necessary mitigation to eliminate problems of induced currents and voltages onto conductive objects sharing a right-of-way, to the mutual satisfaction of the parties involved. Platte River will install fence grounds on all fences that cross or are parallel to the proposed line. 17. Equipment and vehicles will avoid riparian areas on the right-of-way during construction and operation activities where possible and minimize impacts by using existing accesses. Existing bridges or fords will be used to access the right-of-way on either side of riparian areas. Concrete Washout Policy Applicable law does not allow dumping waste concrete or washout water into any stormwater drainage system. The concrete or wash water cannot be dumped where it can run into the drainage system. Waste concrete or wash water cannot be dumped into any river, creek, stream, irrigation canal, ditch or any other area where it can be transported into the drainage system. An area is considered acceptable to wash out or rinse off a concrete truck if the following conditions are met: 1 The area does not drain or otherwise convey material into any State waters such as, a ditch, storm sewer, creek, lake, river, wetlands, culvert, roadway, ravine, etc. 2 The area is not on private property. If the area is on private property you must have consent from the property owner that washing out in the designated area is permitted. 3 The contractor agrees that cleanup of the wash out/rinse off area will be the contractor's responsibility. 4 The area is not in a park, open space area, or a pristine environmental habitat. If at any time you question the contractor's judgment of a wash out area or feel the contractor will not follow through on cleanup procedures of an area, contact management immediately. This policy and guidelines are to prevent concrete or wash water from entering State and navigable waters. If a contractor directs an employee to disobey this policy,the employee is to explain The Company's position on the interpretation of the law(s)to the contractor, and notify a Company Management Representative and wait for further directions. Failure to comply with this policy will be subject to disciplinary action up to and including termination pending results of an investigation of the reported violation. C-3 Hello
