Based on information provided the following Building Code comments are offered for AMUSR-1002.
Building and structures associated with the site development are required to meet all building code
requirements for there intended usage for each new structures that will be part of the on going activities
permitted with the USR. The following life,safety, health and public welfare building code concerns must
be addressed:
1 Individual building permits are required for the following:
a Any structure, mechanical, plumbing or electrical work that does not meet the exceptions
to Section 105 of the 2003 IBC is required to have a building permit for its intended use.
2 Occupancy usage will be granted for any new structures based on the intended nature and
character of use for the structures that will be part of the planned site development granted
through the USR. It appears that the modular office building will be a B usage Non building
structures and enclosed areas will potentially be a U usage in accordance with 312 or a general
mechanical permit with no assigned usage. Actual occupancy usage for buildings and non
building structures will be determined at the time a permit is granted in accordance with Section
302 of the IBC. Additionally, construction type shall be limited subject to proposed building size,
building height, location on property and intended usage. Construction type limitations will be
determined at time of permitting and plan review.
2 Building permits applications shall include two complete set of plans—to include a site plan
specifically indicating proposed building, structures and development.. The site plan is to indicate
location on property, distances between building and structures and intended usage for each
building. Additionally all new structures shall include structural, architectural, mechanical,
plumbing & electrical plans.
3 Bathrooms facilities are required in accordance Chapter 29 of the BC and Chapter 4 of the IPC-
por-ta-lets due not meet this requirement.
4 Proposed modular building (class room) and site facility access is required to meet all
accessibility requirements of chapter 11 the IBC. This is to include parking, sanitary facilities

and a barrier free environment to the building, as well as within.
5 Subject to submitted plans, intended usage and building size, the means of egress shall meet
exiting requirements of chapter 10 of the IBC.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23.
Our comments and requirements are as follows:
COMMENTS:
Weld County Strategic Roadway: WCR 22 is classified by the County is a Strategic Roadway, which
requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24,
27, 37, 49 and 74)
Section Line Access: (right-of-way) (WCR 31)
kur most recent ADT count reflects 930 vehicles taken at this location between U. S. Highway 85 and WCR
31.
REQUIREMENTS:
Access: The applicant is indicating that there are two existing access locations, the west gate and the truck
entrance. Utilize both existing locations for the operation of the facility.
The applicant needs to identify on the plat drawing the appropriate location for the parking lot. The applicant is
indicating approximately 25 employees with a future growth up to 75. Numbers of apartment spaces shall be
determined by Planning Services.
The parking lots with a two-way drives will be provided with sufficient turning lane widths to allow two vehicles
to pass. The off-street parking including the access drive shall be surfaced with gravel, asphalt, concrete or
the equivalent and shall be graded to prevent drainage problems, 23,-4,r30
Each space shall be equipped with wheel guards or curb stops where needed to prevent vehicles from
extending beyond the boundaries of the spaces and from coming into spaces and from coming into contact
with other vehicles, walls, fences, or plantings, Section 23-4-30.
Truck Circulation and Loading: Each off-street loading space shall be at least 35 feet in length and 10 feet
in width. The off-street loading spaces shall be surfaced with gravel, asphalt, or concrete and shall be graded
so as to prevent drainage problems, Section 23-4-50.
etback: Pursuant to the definition of setback in the Weld County zoning (23-1-90) The required setback is
measured from the future right-of-way line. On those structures being proposed, should be aware of the
setback requirement 70 feet from center of WCR 22 (section line) to future right-of-way plus 20 feet setback in

the agricultural zone to future structures. The status of the existing structures within the future right-of-way is
considered of Nonconforming Use. Check with your planner for definitions.
Storm Water Drainage: The applicant is required to comply with all Colorado Department of Health and
Environmental (CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on
site.
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
Control Division regulations regarding storm water quality permitting and protection and construction storm
water discharges.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for a natural gas processing,
treating compression and fractionation facility and an office for training and meeting
purposes. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
-- 1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The applicant shall provide current evidence that the facility has an adequate
water supply. A Permit to Construct a Well, Permit # 171038, has been
submitted with the application. It is not known at this time if this well has been
constructed.
4. The applicant shall submit an odor abatement plan for the natural gas odorization
facility for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1 . The applicant shall install an engineer designed septic system for
office/meeting building to handle the hydraulic load for a maximum of 75
people. The system design shall comply with all County and State Laws,
Regulations and Policies. In the event the septic system(s) requires a design
capacity of over 2,000 gallons of sewage per day the applicants shall provide
evidence that all requirements of the Water Quality Control Division of the
Colorado Department of Public Health and Environment (specifically Policies
WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall
be provided to the Weld County Department of Public Health and
Environment.
2. The applicant shall submit evidence of an Underground Injection Control
(UIC) Class V Injection Well permit from the Environmental Protection Agency
(EPA) for any large-capacity septic system (a septic system with the capacity
to serve 20 or more persons per day). Alternately, the applicant can provide
evidence from the EPA that they are not subject to the EPA Class V
requirements.
3. The water system (well) shall comply with the Colorado Primary Drinking
Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld
County Department of Public Health and Environment that the system
complies with the Regulations.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. Two septic permits for up to
15 persons each septic system have been issued, Septic Permit # G19930221
and SP9700527. A new septic system shall be installed for the office/meeting
building.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.The water system shall comply with the requirements for a community water
system as defined in the Primary Drinking Water Regulations (5 CCR 1003-1), if
applicable.

11.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Landscape Referral
The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code. In addition to these requirements, the plat scale shall be 1" = 200 feet,
with a detailed Site Plat delineated at a scale of 1" = 50 feet. The Vicinity Map shall be
delineated at a scale of 1" = 2000 feet.
This application shall be in compliance with Section 23-3-350 A. and B and is address in the
following comments, as applicable.
Section 23-3-350 addresses the Design Standards applicable to this proposed facility.
Section 23-3-350.A addresses storm water management. The Department of Public Works
reviews this standard who will make recommendations on the handling of stormwater and
release at a historic rate.
Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street parking
areas. All parking and loading areas shall be screened from adjacent properties and road
rights-of-way. Further, all areas associated with outdoor storage shall be screened from
adjacent properties and public rights-of-way. The applicant shall delineate an opaque visual
screen on all sides of the property to mitigate the potential negative impact and aesthetic
concerns on surrounding properties.
The application materials state that there will be 25 employees working regular business hours
and five employees working evening and night hours utilizing the site. Appendix 23-B of the
Weld County Code, addresses the number of off-street parking spaces required. For this
situation, the parking requirements are one space for each employee, minimum 30 parking
spaces, including one space that is van accessible to meet the requirements of the American
with Disabilities Act.
The applicant shall delineate curb stops for the parking spaces shown on the USR plat. One
curb stop for each space is the standard. However, one curb stop centered over two parking
spaces is acceptable. Contact this office with any questions.
The applicant shall delineate curb cuts and ramps for the handicapped and general parking
spaces shown on the USR plat. There is presently no evidence that the non-ambulatory
parking space has a safe and secure access to the administration building.
Section 23-3-350.C addresses Loading Areas. A designated loading area is not delineated on
the plat. Such an area shall be delineated on the plat.
Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Coordination with the Department of Public Works shall be on-
going, specific to the results of the traffic study for all improvements to the County road system
for all improvements from the County road network.
Section 23-3-350.E addresses acceleration and deceleration lanes. If required, the Department
of Public Works and /or CDOT Shall address this issue.
Section 23-3-350.F addresses the setback and offsets for structures from the future right-of-
way line. For this case, the setback is twenty (20) feet from the County Road and the offset is
one foot for every three feet of building height or five feet whichever is greater.
Section 23-3-350.G addresses the Required Landscape areas. Section 23-3-350.G.1 states
"No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Further, Section 23-3-350.G.1 states "That portion of a Lot which abuts a public or private street
right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from
the Lot line towards the interior of the Lot. Driveways may pass through the required
landscaped areas."
The USR Plat has not identified areas for landscape treatment. Staff requests, that at a
minimum, the applicant submit a plant material list that delineates the proposed and existing
plant material and other landscape treatment areas for review and approval with the
Landscape and Screening Plan prior to recording the USR Plat.
Living landscape materials as indicated on the approved Landscape and Screening Plan shall
be maintained at all times. Dead or diseased plant materials shall be replaced with materials of
similar quantity and quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well tap is able to provide irrigation water for this site. Evidence of
such shall be submitted to this office prior to recording the USR plat.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash. This structure shall be delineated on the USR Plat.
Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the
site. The application materials state water is to be provided by a commercial well and disposal
of household wastes will be via an engineered ISDS system. The applicant shall provide
evidence of water. The Department of Public Health and Environment will address additional
requirements as warranted.
Section 23-3-360 addresses operation standards. The applicant shall address the issue of
noise, air quality, water quality, radiation and radioactive material, heat light, and property
maintenance.
Section 23-3-360.A addresses noise. The Department of Public Health and Environment will
regulate the maximum permissible noise levels allowed for this facility. Further, the application
materials propose that the hours of operation be twenty-four hours per day, seven days per
week each calendar year.
Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if
applicable, this section.states "any lighting ... shall be designed, located and operated in such a
manner as to meet the following standards: sources of light shall be shielded so that beams or
rays of light will not shine directly onto adjacent properties...." Staff shall require a Lighting Plan
be submitted for review and approval prior to recording the USR Plat.
Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the
property or become established as a result of the proposed development the applicant/
landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code.

The applicant shall delineate all on-site signs. The signs shall adhere to Article IV, Division 2 of
the Weld County Code. Further, the location of the signs shall be delineated on the Landscape
/ Site Plat. All structures, including signs, on site must obtain the appropriate building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

Dear Ms. Hatch:
This referral does not appear to qualify as a"subdivision"as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit,or the physical availability of water.
According to the submitted information, an existing well will be used to meet the water
requirements at the site. The records available in the State Engineer's Office show that the applicant
has a well which can be operated under permit no. 190585. That well is permitted for drinking and
sanitary use for a commercial business and is limited to a maximum annual withdrawal of 108,600
gallons and a pumping rate of 15 gallons per minute. The well can be used to serve the proposed
operation if it is operated under the conditions of approval of the well permit. Information provided in
the referral did not specify the estimated water requirement for the operation, therefore, adequate
information is not available to determine if the average annual withdrawal limitation of 108,600 gallons
will be exceeded due to the expanded use at the site. The State Engineer's Office recommends
that the County obtain information from the applicant that demonstrates that the annual
withdrawal limitation will not be exceeded prior to approval of the proposal.

To Whom It May Concern:
I have talked with representatives from Encana to discuss smoke
detectors for the new modular. At this time, there are no smoke detectors.
All smoke detectors should be hard wired together and monitored. Any
other new buildings in the future will need to have smoke detectors installed
before they can be occupied for business. All smoke detectors shall be
installed according to current building codes.
No further requirements from the fire district at this time. If there are
any questions or concerns please call me at the above number.
