RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST GLAZE INDUSTRIAL PROPERTIES, LLC, FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Glaze Industrial Properties, LLC, ZCV#0701080, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michael Glaze, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until December 9, 2007, to allow adequate time for the property owner to submit a
Change of Zone application to bring the subject property into compliance, and to waive the
Department of Planning Service's investigation fees during the sixty(60) day time limit to submit
the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701080 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Glaze Industrial Properties, LLC,to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until December 9, 2007, to allow adequate time
for the property owner to submit the Change of Zone application to bring the subject property into
compliance, and to waive the Department of Planning Service's investigation fees.

REMEDY
As we discussed, the operation of a commercial business of this size requires additional Weld County
Permits. Whether you choose to go through the Change of Zone (COZ) and Site Plan Review(SPR)
process or to go through the Use by Special
Review(USR) process. Either application if approved and once recorded would bring the property into
compliance.
**Also, as I indicated in my voice mail (on 09/24/07), if we receive a complete application before
October 9th, this Violation Hearing will be cancelled.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

07/19/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: several commercial vehicles all labeled
with "Discount Plumbing Services". A small amount of
outdoor storage. No pictures were taken during this
inspection.
07/23/2007 Phone Call Michael Glaze (303-981-8999) called. He said he received
a letter this weekend and wasn"t sure what it was about. I
explained that I had noted several commercial vehicles
and the operation of a plumbing business without a Use
by Special Review. He said he was unaware that they
needed any permits. I explained that was actually very
common. I advised him that I would send him a USR
application along with a 60 day letter. I briefly outlined the
Planner On-Call hours. He said okay.

APPLICATION REQUIREMENTS:
One (1)original application form plus 19 copies-(additional copies may be required, on request of the
Department of Planning Services)
Twenty(20) copies of the Special Review plat map (24"X36"- See attached page 6 for Map requirements ).
One 8-1/2"x 11" reduced copy of the (24"X36")Special Review plat
8-1/2"x11" Photo Mechanical Transfer(PMT) if required, or electronic copy of map.
One (1)original Special Review Use questionnaire plus 19 copies.
One (1)original Weld County Road Access Information Sheet plus nineteen (19) copies.
_ Two (2)copies of document showing evidence of adequate water supply (e.g. well permit or letter from water
district).
Two (2) copies of document showing evidence of adequate sewage disposal (e.g. septic permit or letter from the
sanitary sewer district).
One (1) copy of deed or legal instrument identifying applicant's interest in the property.
One (1)original Certificate of Conveyances form and any attachments, completed within thirty(30) days of the
application submission date.
Two (2)copies of Soils Report. Soils Reports are available from local Soil Conservation Service Offices.
One (1) copy of affidavit and certified list of the names, addresses and the corresponding parcel identification
number assigned by the Weld County Assessor of the owners' of property (the surface estate)within 500 feet of
property being considered. This list shall he compiled from the records of the Weld County Assessor, the Weld
County Website,www.co.weld.co.us, or a person qualified to do the task, and shall be current as of a date no
more than thirty (30)days prior to the date the application is submitted to the Department of Planning Services.
One (1)copy of affidavit and certified list of the names and addresses of all mineral owners and lessees of
mineral owners on or under the parcel of land being considered. The list shall be prepared from the real
property records by a person qualified to do the task, and shall be current as of a date more than thirty (30)days
prior to the date the application is submitted to the Department of Planning Services. Note: Mineral Notification is
in addition to that required by C.R.S. 24-65.5-102 through 104.
One (1)original Emergency Information Sheet(for Commercial only)
Notice of Inquiry if located within an Intergovernmental Agreement(IGA) boundary.
Application fee.
Investigation fee, if required (50% of permit fee).
Special Review plat recording fee ($11.00 first page + $10.00 each additional page).
Packets shall be bound with either paper clips or binder clips (no substitutes) in the order listed below. Applications
bound in any other fashion may be returned to the applicant without review.
Packet 1 will contain - 1 original of the all of the above.
Packet 2 will contain - 1 copy of the following: application, questionnaire, map, 1 copy of water district letter or
well permit, 1 copy sanitary sewer district letter or septic permit.
