RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600349
AGAINST JEFFREY AND TABITHA KRAFT FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Jeffrey and Tabitha Kraft, VI #0600349, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of February, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jeffrey and Tabitha Kraft were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Jeffrey and Tabitha Kraft to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

REMEDY

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

December 14, 2006 Re-sent letter to property owner indicating that the violation case was scheduled
before the Board of County Commissioners. Sent via regular US Postal Service
and via Certified mail.
January 8, 2007 Received original Violation Hearing notification returned as "Unclaimed".
January 9, 2007 The Board of County Commissioners continued this Violation Hearing to the
February 13, 2007 Violation Hearing per the applicants request.
January 10, 2007 Letter sent via regular mail to property owner indicating that the violation case
was re-scheduled before the Board of County Commissioners.

COMMENTS:
It is my understanding that the property is up for sale on January 28, 2007. I imagine that your property
will again own the property by then end of the month. If that is the situation, my violation case will be
updated to show the Bank as being the property owner. As I indicated during our phone conversation, the
violation is a result of the previous owner(Marvin Hanel)selling the property to the Kraft's with this mobile
home already on it. The problem being that Mr. Hanel was temporarily permitted to maintain and utilize
the mobile home there due to his health condition and those permits are non-transferable. There is also a
much smaller issue regarding the presence of a cargo container without first obtaining the necessary
building permits.

Dear Mr. & Mrs. Kraft:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on February 13,2007,at 10:00 a.m.,to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.8 "One (1) Single-Family Dwelling Unit and Auxiliary Quarters on a
parcel of land created under the provisions of Chapter 24, Article VIII of this Chapter."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "Mobile homes subject to the additional requirements of Article IV,
Division 3 of this Chapter."
Section 23-3-30.K "Cargo container as Accessory STRUCTURE. One (1) cargo
container as an Accessory STRUCTURE in the A (Agricultural) Zone District may be
permitted for storage of goods inside the unit. A cargo container used for storage shall
require the issuance of building permits. The following conditions shall apply:"
1. Electricity is the only utility which will be connected to the cargo container used for
storage.
2. The cargo container used for storage will not be used on any basis as a DWELLING
or as overnight or temporary housing for any person.
3. The property upon which the cargo container is to be located must be a LEGAL LOT.
4. The applicant shall not remove any structural component of the cargo container used
for storage making it unmovable.

5.A cargo container used for storage shall not be allowed to fall into a state of disrepair.
Such disrepair may include a cargo container that is partially or totally damaged by fire,
earthquake, wind or other natural causes, or is in a state of general dilapidation,
deterioration or decay resulting from a lack of maintenance,vandalism or infestation with
vermin or rodents. Any such cargo container used for storage shall be restored to, and
maintained in, the original condition it was in at the time it was placed on the site as
established by the original inspection by the Department of Building Inspection,or it shall
be removed from site.
6.A cargo container used for storage shall be removed from the property upon cessation
of the USE.
7. The cargo container may not be used in any manner to display a sign.
To bring the property into compliance:
As we have previously discussed, the mobile home shall be removed from the property.
Furthermore, a building permit application shall be completed and submitted for the
Cargo Container(which I have not previously noted) if it is intended to remain situated on
the property.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.
