Kerr-McGee Oil & Gas Onshore LP is the owner of valid oil and gas leases
underlying all or part of Sections 25, Township 2 North, Range 67 West, for which LG
Everist, Inc. is seeking approval of an Application for Resubdivision.
Kerr-McGee and LG Everist, Inc. have executed a Surface Use Agreement, the
terms of which govern the parties' simultaneous use of the subject property. Kerr-McGee
does not object to LG Everist Inc.'s Application for Resubdivision approval providing it
conforms to the previously executed agreement.
