RE: ACTION OF THE BOARD CONCERNING CHANGE OF ZONE, PZ #1131, FROM
A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT)
ZONE DISTRICT FOR NINE (9) RESIDENTIAL LOTS WITH E (ESTATE) ZONE USES,
WITH 9.94 ACRES OF OPEN SPACE REFERRED TO AS "TRACT 1"AND "TRACT 2",
AND A FIVE (5) ACRE NON-BUILDABLE OUTLOT FOR OIL AND GAS ACTIVITIES -
ROBERT BUDERUS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,a public hearing was held on the 15th day of August,2007,at 10:00 a.m. in the
Chambers of the Board for the purpose of hearing the application of Robert Buderus, 2932 East
Vine Drive, Fort Collins, Colorado 80524, requesting a Change of Zone from the A (Agricultural)
Zone District to the PUD(Planned Unit Development)Zone District for nine(9)residential lots with
E(Estate)Zone uses,with 9.94 acres of open space referred to as"tract 1"and"tract 2",and a five
(5)acre non-buildable outlot for oil and gas activities, for a parcel of land located on the following
described real estate, to-wit:
Lot B of Recorded Exemption #3684; being part of
the SW1/4 and SE1/4 of Section 5, Township 7
North, Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing on August 15, 2007, at the request of the applicant, the Board
deemed it advisable to continue the matter to September 5, 2007, at 10:00 a.m., and
WHEREAS, at said hearing on September 5, 2007, staff informed the Board that the
applicant's representative had requested an indefinite continuance of the matter, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant, and having been fully informed, finds that
this request shall be referred back to the Department of Planning Services to address the concerns
of the property's mineral owners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the application of Robert Buderus,for Change of Zone, PZ#1131,from the
A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for nine (9)
residential lots with E(Estate)Zone uses,with 9.94 acres of open space referred to as"tract 1"and
"tract 2", and a five(5)acre non-buildable outlot for oil and gas activities, on the above referenced
parcel of land be, and hereby is, referred back to the Department of Planning Services.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by

SUBJECT: Serenity View Estates PUD (PZ-1131)
Jeff Couch, representative for Serenity View Estates PUD (PZ-1131 has asked for an
indefinite continuance to address the mineral agreements and open space requirements for
Serenity View Estates (PZ-1131).
The Department of Planning Services is in support of this request.

Roger:
By this e-mail and with the support of the landowner for Serenity View Estates P.U.D. , we
are asking for an indefinite continuance for PZ-1131 at this time so that we can continue
our negotiations with Anadarko. We believe that based on recent meetings and input from
our legal team that we are very close to working out a solution for this project which
will be very acceptable to Weld County.
Roger, thank you for your assistance with this issue and we will be back in touch in the
very near future.
