HomeMy WebLinkAbout20070136.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 10, 2007 TAPE #2007-01 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 10, 2007, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner David E. Long, Chair Commissioner William H. Jerke, Pro-Tern Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Jenny Luna Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Rademacher moved to approve the minutes of the Board of County Commissioners meeting of January 8,2007,as printed. Commissioner Masden seconded the motion,and it carried unanimously. AMENDMENTS TO AGENDA: PUBLIC INPUT: Chris Eikenberg, Town of Pierce resident, stated she needs justice for her current situation with the Town of Pierce. She stated the Town does not practice inclusionary practices for people with disabilities, and she has digital photographs proving that the Town is discriminating against her family. She stated she has had ant poison thrown over her fence, some of her artwork has been set on fire, two sets of tires on her vehicles have been tampered with,and she has been threatened while on her property by the Town of Pierce Police Department. She further stated her animals have been tortured and she feels she would not be able to receive emergency services within the County,if needed,due to the problems she has encountered with law enforcement. Ms. Eikenberg stated she has photographs proving that the Town has discriminated against her by not removing the snow in front of her home, while the snow has been cleared in front of the rest of the houses on her residential street. She stated the snow makes it difficult to enter and leave her driveway,and her accessibility concerns have not been addressed by the Town. She further stated she will place all her photographs on a website she is developing,to prove she is not receiving the help she is requesting. She stated she is a victim of harassment from the Town, which qualifies as a hate crime since the Town is being spiteful towards her family. Ms. Eikenberg stated she has requested several other residents to come before the Commissioners and speak on her behalf about the hate crime situation because she wants to be taken seriously. She stated her family has been terrorized recently by 2007-0136 BC0016 a bullet hole through the bedroom window,which was brought to the attention of the Town of Pierce Police Department; however, no action has been taken. She further stated Weld County needs to create a definition for a hate crime and enforce actions against it. CONSENT AGENDA: Commissioner Jerke moved to approve the consent agenda as printed. Commissioner Masden seconded the motion, and it carried unanimously. COMMISSIONER COORDINATORREPORTS: Commissioner Masden stated the Department of Public Works is preparing for the next round of snowstorms, and staff is doing a great job. Chair Long concurred that the Department of Public Works staff are working hard and he expressed his appreciation for the staff as they are doing the best they can with snow removal. Commissioner Rademacher stated he met with Dr. Mark Wallace, Director of Public Health and Environment, and a work session has been scheduled for the Board. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $840,495.02 Commissioner Rademacher moved to approve the warrants as presented by Mr.Warden. Commissioner Masden seconded the motion, which carried unanimously. BIDS: PRESENT BIDS: Pat Persichino, Director of Public Works, stated there were no bids to present. APPROVE STACKABLE CONVEYORS (36X60) BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Power Equipment Company, in the amount of $69,450.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE PORTABLE STACKER CONVEYORS(36X80) BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Municipal and Contractors Equipment, in the amount of$28,397.00. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Masden, the motion carried unanimously. APPROVE MOTORGRADERS BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the low bid submitted by B and G Equipment did not meet specifications;therefore, staff recommends acceptance of the second low bid from Power Equipment Company,in the total amount of$318,944.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE AGRICULTURAL TRACTORS BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the low bid submitted by B and G Equipment did not meet specifications; therefore, staff recommends acceptance of the second low bid from G and M Implements, Inc., in the amount of $105,900.00. Commissioner Jerke moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Masden, the motion carried unanimously. APPROVE 20 TON SINGLE DRUM VIBRATORY ROLLER BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff has determined that Option B is necessary, and he recommended the acceptance of the low bid from McDonald Equipment, in the amount of $154,290.00. Commissioner Minutes, January 10, 2007 2007-0136 Page 2 BC0016 Masden stated he will request to be recused, since he has relatives that are sales representatives for McDonald Equipment. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. The motion was seconded by Commissioner Garcia, and upon request for a roll-call vote, the motion carried 4-0, with Commissioner Masden recused. APPROVE TANDEM TRUCK TRACTORS BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated an additional tractor has been added to replace the tractor that recently burned,therefore, a total of five tractors will be purchased. He stated staff recommends acceptance of the low bid from Transwest Trucks, in the total amount of$413,000.00. In response to Commissioner Rademacher, Mr. Persichino stated the cost to replace the burned tractor will be provided through insurance funds. Commissioner Rademacher moved to approve said bid,based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE TANDEM AXLE DUMP TRUCKS W/ ATTACHMENTS BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Transwest Trucks, in the total amount of$403,710.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE BELLY DUMP TRAILERS BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Utility Trailers of Colorado, in the amount of$54,000.00. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Masden, the motion carried unanimously. APPROVE 15 TON TILT DECK/TOW-TYPE TRAILER BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Columbine Equipment, in the amount of $16,490.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE TRIPLE AXLE TRAILER BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the two lowest bids submitted by Colorado Machinery and D and E Sales did not meet specifications;therefore, staff recommends acceptance of the third lowest bid from Honnen Equipment, in the amount of $27,519.00. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE WATER TRAILER BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Faris Machinery, in the amount of$77,950.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE 3/4 TON 4X4 CREW CAB PICKUP BID - DEPARTMENT OF PUBLIC WORKS AND BUILDINGS AND GROUNDS: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$50,975.48. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE 3/4 TON 4X4 STANDARD CAB PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of $23,177.99. Commissioner Garcia moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. Minutes, January 10, 2007 2007-0136 Page 3 BC0016 APPROVE 3/4 TON 4X4 EXTENDED CAB PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Board requested in a work session that the Mining Division of the Department of Public Works purchase a 3/4 ton pickup, instead of a 1/2 ton pickup, and this pickup meets the required specifications. He stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$21,145.99. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE 1/2 TON 4X4 EXTENDED CAB SHORT BOX PICKUP BID - DEPARTMENT OF PUBLIC WORKS AND BUILDINGS AND GROUNDS: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$17,106.00. In response to Commissioner Rademacher, Mr. Persichino stated this pickup will be utilized for the Weed Division, as a utility truck for inspection of properties, and a sprayer will not be mounted to the back of the truck. Commissioner Rademacher moved to approve said bid,based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE 1/2 TON 4X4 PICKUP BID- DEPARTMENT OF BUILDING INSPECTIONS: Mr. Persichino stated staff recommends acceptance of the low bid from Weld County Garage, in the amount of $15,110.00. Commissioner Garcia moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. APPROVE 1/2 TON 4X4 EXTENDED CAB SHORT BOX PICKUP E85 BID-DEPARTMENTOF PUBLIC WORKS AND BUILDINGS AND GROUNDS: Mr. Persichino stated the E85 will not be compatible with this size of vehicle,therefore,staff recommends the acceptance of the low bid from Garnsey and Wheeler Ford. He stated an additional pickup will be purchased for the Department of Buildings and Grounds,and the total purchase amount will be$96,784.25. In response to Commissioner Rademacher, Mr. Persichino stated one pickup will be utilized in the Trucking Division, two will be utilized for maintenance support, and the pickups have extended cabs. Responding to Commissioner Jerke, Mr. Persichino stated the cost of E85 fuel is too expensive for this size of engine. Commissioner Masden moved to approve said bid,based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE 1/2 TON 4X4 REGULAR CAB LONG BOX PICKUP BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the total amount of $52,669.95. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. ACTION OF THE BOARD CONCERNING 1/2 TON 4X4 FULL SIZE EXTENDED CAB PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated staff determined a 3/4 ton truck was necessary,therefore, staff recommends rejection of the bid. Commissioner Rademacher moved to reject said bid, based upon staffs recommendation. Seconded by Commissioner Masden, the motion carried unanimously. APPROVE 1/2 TON 4X4 EXTENDED CAB PICKUP BID-SHERIFF'S OFFICE: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$20,284.15. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. APPROVE PATROL VEHICLES BID - SHERIFF'S OFFICE: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford,for the purchase of nine vehicles in the amount of $20,426.15 each. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. Minutes, January 10, 2007 2007-0136 Page 4 BC0016 APPROVE PATROL FET SUV BID-SHERIFF'S OFFICE: Mr. Persichino stated the low bid submitted by Hyundai of Greeley does not meet specifications,therefore, staff recommends acceptance of the second low bid from Garnsey and Wheeler Ford, in the amount of$29,794.33. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE CIVILIAN VEHICLES BID - SHERIFF'S OFFICE: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$19,300.00. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. (CLERK'S NOTE: Bid was rejected by the Board on January 17, 2007). APPROVE TRANSPORT MINI VAN BID-SHERIFF'S OFFICE: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$20,728.31. In response to Commissioner Garcia, Mr. Persichino stated the price of the vehicle does not include the installation of the radio. Commissioner Rademacher moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. APPROVE TRANSPORT MID-SIZED VAN BID - SHERIFF'S OFFICE: Mr. Persichino stated staff recommends acceptance of the low bid from Garnsey and Wheeler Ford, in the amount of$28,228.66. Commissioner Masden moved to approve said bid, based upon staffs recommendation. Seconded by Commissioner Garcia, the motion carried unanimously. ACTION OF THE BOARD CONCERNING BACKHOE BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the bid was originally presented as Bid#60700028, and staff recommends rejection of the bid due to an error within the bid. Commissioner Rademacher moved to reject Bid#6070028, based upon staffs recommendation. Seconded by Commissioner Masden,the motion carried unanimously. Mr. Persichino stated the bid was re-bid through Bid #B0700053, and the low bid submitted from B and G Equipment did not meet transmission specifications, therefore, staff recommends acceptance of the second low bid from Ron's Equipment, in the amount of$65,500.00. Commissioner Masden moved to approve Bid#60700053, based upon staffs recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. ACTION OF THE BOARD CONCERNING ONE TON DIESEL DUAL WHEELS W/UTILITY BOX AND EXTENDED FRAME BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the bid was originally presented as Bid#B0700037,and staff recommends rejection of the bid since none of the vendors could meet the required specifications. Commissioner Garcia moved to reject Bid#60700037, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. Mr. Persichino stated the bid was re-bid through Bid#B0700053,and the low bid submitted from Garnsey and Wheeler Ford did not meet specifications;therefore,staff recommends acceptance of the second low bid from Rush Truck Center, in the amount of$74,226.18. Commissioner Rademacher moved to approve Bid#60700053, based upon staffs recommendation. Seconded by Commissioner Masden, the motion carried unanimously. ACTION OF THE BOARD CONCERNING ONE TON DIESEL DUAL WHEELS PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated this bid was duplicated, therefore, it is necessary to omit,and/or reject the bid. Commissioner Garcia moved to reject said bid, based upon staffs recommendation. Seconded by Commissioner Jerke, the motion carried unanimously. Minutes, January 10, 2007 2007-0136 Page 5 BC0016 PLANNING: CONSIDER PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR MAJOR SUBDIVISION FINAL PLAN MJF#1062 FOR HILL-N-PARK THIRD FILING - JER, A PARTNERSHIP: Chris Gathman, Department of Planning Services, stated staff received a letter from the applicant, requesting partial release of collateral, in amount of$102,566.00. He stated the Department of Public Works is requesting that the paving warranty amount of$15,384.90 be retained for a period of one year. He further stated the applicant has submitted a new Letter of Credit, in the amount of $15,384.90, and staff recommends approval of the partial cancellation and release of collateral. Commissioner Masden moved to approve said partial cancellation and release of collateral. Seconded by Commissioner Jerke, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
