HomeMy WebLinkAbout20073627 RESOLUTION RE: APPROVE AWARD OF CONTRACT FOR DEMOLITION AND CLEAN-UP OF PROPERTY AT 3715 YOSEMITE DRIVE, WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,The Board of County Commissioners of Weld County had, on August 6, 2007, authorized the cleanup of the property described as Lot 13, Block 5, Hill-N-Park Subdivision, Weld County, Colorado, also known by the street address of 3715 Yosemite Drive, Greeley, Colorado 80634, and the demolition of the modular home on the property because it is a dangerous building, and WHEREAS, despite the representations made by Lynette Scoggins at the meeting of the Board on August 6, 2007, the property remains in violation of the zoning provisions of the Weld County Code, (District Court Case No. 04 CV 1775), and must be cleaned immediately to prevent irreparable harm to the people of Weld County, and the modular home (which is a dangerous building), has not been abated, and WHEREAS,Weld County Department of Planning Services officials have solicited bids for the cleanup of the property and the demolition of the building, and WHEREAS,only one party, Agritrack, Inc., responded,with a bid of$8,500.00,to clean the property and to remove the dangerous building and the two dead trees, and WHEREAS,the bid presented by Agritrack, Inc., is reasonable, and the work must be done as soon as possible to prevent irreparable harm to the people of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Department of Planning Services shall notify Agritrack, Inc., that its bid to remove all debris, junk, and trash, and to abate the dangerous building located at 3715 Yosemite Drive, Greeley, Colorado, 80634, by demolishing and removing it from the property at a cost of $8.500.00, has been approved, and that the work shall commence at the earliest possible date. 2007-3627 HL0034 CO ; f-k- pL a/�l /07 APPROVE AWARD OF CONTRACT FOR DEMOLITION AND CLEAN-UP OF PROPERTY PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 3rd day of December, A.D., 2007. -'" -. As a result of the inspection, the mobile home has been determined to be a "Dangerous Building" This letter is to inform you that I have determined that the mobile home at this location is a dangerous building as defined by Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings. The conditions that caused this building to be declared a dangerous building are as follows: 1. Whenever, for any reason, the building or structure or any portion thereof, is manifestly unsafe for the purpose for which it is being used. 2. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii)a harbor for vagrants, criminals,or immoral persons; or as to(iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts. The building is ordered to be abated by the following: 1. By removing or demolishing and removing the debris from the site. Prior to demolishing the mobile home a demolition permit shall be required. The demolition permit shall be obtained from this Department by November 17,2007 The mobile home shall be demolished and a final inspection of the property approved by November 27,2007. 2007-3627 Failure to comply with this order may result in the posting of the building to prevent unauthorized entry and the abatement work being performed under the direction of Weld County and the costs thereof charged to you as the owner of the property. You, or any person having any record title or legal interest in this building, may appeal this action to the Weld County Building Code Board of Appeals provided the appeal is made in writing, as required in Chapter 5 of the Uniform Code of the Abatement of Dangerous Buildings,as adopted by reference in Chapter 29 of the Weld County Code. Such notice shall be filed in our office within 30 days from the date this notice is served to you, either personally or by certified mail. Failure to appeal will constitute a waiver of all rights to an administrative hearing and determination of this matter.
