Home My WebLink About840610.tiff RESOLUTION RE: PREPARATION OF BALLOTS IN DETERMINING ESTABLISHMENT OF BRIGGSDALE PEST CONTROL DISTRICT WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, at the request of the landowners and lessees of State land in the Briggsdale area of Weld County, petitions have been circulated for the formation of a pest control district for grasshoppers (Melanoplus) , and WHEREAS , under the provisions of Title 35 , Article V, CRS, as amended, said Petitioners constitute at least twenty-five percent (25%) of the resident landowners and lessees in the proposed district, which is more particularly described in Exhibit "A, " attached hereto and made a part hereof by reference. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, accept said Petitions and direct the Weld County Extension Service to prepare ballots for the determination of the establishment of the Briggsdale pest control district. BE IT FURTHER RESOLVED that the Weld County Treasurer, Weld County Assessor, and the Director of the Cooperative Extension Service be, and hereby are, appointed as a Board to count the ballots as they are returned and make a report thereof as provided by statute; said count to take place on the 11th day following the mailing of the ballots (or first working day thereafter where the 11th day falls on a weekend or holiday) at 8 : 00 a.m. 840610 CA The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of May, A. It has been verified from the assessors records and State Land Commissioners records that there are 239 resident landowners and 4 resident leasees that are not landowners. This is a total of 243 resident landowners and leasees of state land within the proposed district. For an election to be held, twenty-five percent (25%) of these are required on petitions. The required number is 61 persons. The enclosed petitions show 72 names which is more than the required number. The proposed district has 249,760 acres total . The U.S. Forest Service has verified that there are 31,263 acres of federal land within the proposed boundary. This leaves 218,497 acres of private and state leased land in the proposed district. For the vote to pass, 50 percent (50%) , or 109,248 acres must be voted and 66 2/3 of those voting must vote in favor of establishing a district.
