RE: ACTION OF THE BOARD CONCERNING AUTHORIZATION FOR THE WELD COUNTY
ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST EL RODEO MEXICAN
FOOD FOR VIOLATIONS OF THE COLORADO RETAIL FOOD ESTABLISHMENT
RULES AND REGULATIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, El Rodeo Mexican Food is allegedly in violation of the Colorado Retail Food
Establishment Rules and Regulations, and
WHEREAS, despite efforts by the Weld County Department of Public Health and
Environment staff to resolve said matter, the violations have not been corrected, and
WHEREAS, on the 17th day of December, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violations,
and
WHEREAS, Alfonso Perez, owner, was present at said hearing, and
WHEREAS, after hearing testimony from all present, the Board of County Commissioners
deems it advisable to suspend the food service license for El Rodeo Mexican Food for the
remainder of 2007, at which time the applicant must apply for a new license, and to assess the civil
penalty of$1,000.00, authorized pursuant to Colorado Revised Statutes, at the time of application
for a new license.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said the food service license for El Rodeo Mexican Food be, and hereby
is, suspended for the remainder of 2007.
BE IT FURTHER RESOLVED by the Board that a civil penalty, as authorized pursuant to
Colorado Revised Statutes, in the sum of$1,000.00, be issued against El Rodeo Mexican Food,
and that the full amount shall be collected at the time said license is renewed, which shall not be
prior to January 1, 2008.
BE IT FURTHER RESOLVED by the Board that the County Health Officer be, and hereby
is, delegated with authority to terminate the suspension, or place the suspension on hold upon
remedy of the violations of the Colorado Retail Food Establishment Rules and Regulations.

SUBJECT: El Rodeo Mexican Food
El Rodeo Mexican Food, located at 1029 9th Street, Greeley, Colorado has failed to
maintain compliance with the Colorado Retail Food Establishment Rules and Regulations
(please see attached time line). The Weld County Department of Public Health and
Environment has given the facility all opportunities to come into compliance as afforded to
them in the Colorado Revised Statutes. Unfortunately, staff continue to observe violations
that have the potential to directly result in illnesses of patrons dining at the establishment.
The Weld County Department of Public Health and Environment recommends the Board
of County Commissioners (BOCC) revoke El Rodeo's Retail Food Establishment License.
In the event the facility's Retail Food Establishment license is not revoked, we recommend
that the BOCC direct the facility pay the assessed civil penalty as a condition of reopening
or continued operation.

the size and shape of container, cooling parameters would not have been met. All potentially

is cooled to 70 degrees in 2 hours. Product determined to be off temperature less than 2 hours so
was spread out on flat sheets and placed in freezer to cool rapidly. REPEAT VIOLATION.
03c 2 burritos checked and found at 125 degrees. All burritos must be held at 135 degrees and above
at all times. Burritos placed into oven to reheat. Corrected at time of inspection. REPEAT
VIOLATION.
03e Chicken found thawing in standing warm water (75 degrees). Chicken itself was frozen on one
side and at 66 degrees on other. Food shall be thawed in following manner: 1) Under
refrigeration 2) under cool running water for no more than 2 hours or 3) as part of the cooking
process. Discussed and corrected at time of inspection.
06b Hand sink found blocked with dirty dishes at time of inspection making it in-accessible to use.

03e Found eggs that had been bought in the morning (less than 4 hours ago) sitting on floor in
kitchen. Eggs were temped at 74 degrees. All potentially hazardous food shall be held at 41

03g Since large reach in cooler out front held most of the refrigeration space (cooler not working) the
establishment has been determined to not have an adequate amount of equipment to maintain
temperature. The establishment is being required to cook fresh and not cool any product until
such time that the reach in cooler can maintain proper temperature. Correct immediately.
09a Found fish in freezer without label. Based on consistent size of fish and based on questioning of
owner it was determined that the fish was most likely coming from an approved source. The fish
should have a label. Correct as soon as possible, but by next regular inspection.
12a Lids of container in small reach in cooler found with excessive food debris. Clean on a regular
basis and as needed. Correct as soon as possible, but within 10 days.

1/2 hours ago and then put on pan to start cooling. Facility shall use methods to rapidly cool food
product such as ice baths, refrigeration, leaving uncovered, etc. Staff uncovered food and placed
in reach in cooler (smaller amount of food product). Corrected at time of inspection. Repeat
Violation.
