RE: ACTION OF BOARD CONCERNING PETITION TO AUTHORIZE VACATION OF
A PORTION OF COUNTY ROAD 128.5, BETWEEN STATE HIGHWAY 71 AND COUNTY
ROAD 149,AND A PORTION OF COUNTY ROAD 149, BETWEEN COUNTY ROAD 124
AND COUNTY ROAD 128 SECTION LINE - MULTIPLE PETITIONERS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road Petition from Cervi Enterprises,
do Mike Cervi, P.O Box 1930, Greeley, Colorado 80632, Burns Ranches, P.O. Box 69, Kimball,
Nebraska 69145, and the State Board of Land Commissioners, Northeast District Office,
301 Poplar Street, Sterling, Colorado 80751, a copy of said petition being attached hereto and
included by reference, requesting vacation of a portion of right-of-way for County Road 128.5,
between State Highway 71 and County Road 149, and a portion of right-of-way for County Road
149, between County Road 124 and County Road 128 Section Line, being more fully described as
follows:
County Road 128.5, between State Highway 71 and
County Road 149, being generally located in
Section 18 and between Sections 17 and 20; and the
public road right-of-way lying 30 feet on either side of
the section line between Sections 20 and 21, and
Sections 28 and 29; all in Township 11 North,
Range 56 West of the 6th P.M., Weld County,
Colorado.
WHEREAS, a hearing before the Board was held on the 10th day of September, 2007, at
which time the Board deemed it advisable to continue said matter to October 8, 2007, to allow
adequate time to obtain additional public input, and
WHEREAS, at said hearing on October 8, 2007,the Board deemed it advisable to continue
the matter to October 15, 2007, in order to allow the matter to be heard by a full quorum of the
Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to October 15,
2007, at 9:00 a.m.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 8th day of October, A.D., 2007.
