a RESOLUTION RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT,ZPMH#2521 -JOHN AND NORMA HOGARTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 19th day of November, 2007, considered the request of John and Norma Hogarth, 15601 Casler Avenue, Fort Lupton, Colorado 80621, for a Recreational Vehicle to be used as a Temporary Use during a Medical Hardship, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot 5, Block 39,Aristocrat Ranchettes,Second Filing, Weld County, Colorado WHEREAS,on November 19, 2007, the Board of County Commissioners, having heard all of the testimony, finds that pursuant to Section 23-4-200 of the Weld County Code, said request should be denied for the following reasons: 1. Section 23-4-200.A.1 - It is the opinion of the Board of County Commissioners that the proposed mobile home (recreational vehicle) is not compatible with the surrounding area, and is not in harmony with the character of the neighborhood and its effects upon the immediate area. 2. Section 23-4-200.A.4- It is the opinion of the Board of County Commissioners that the general health,safety, and welfare of the inhabitants of the area and the County will be jeopardized or compromised by the location of the mobile home(recreational vehicle)on this site,as neighbors and surrounding property owners have expressed opposition to the request. LEGAL DESCRIPTION: Lot 5, Block 39,of Aristocrat Ranchettes;located in Section 27,T2N, R66W of the 6th P.M., Weld County, Colorado PARCEL NUMBER: 1309 27 406012 PARCEL SIZE: 0.99+/-Acres ZONE DISTRICT: A(Agricultural) WATER SOURCE: Aristocrat Water SEWER SOURCE: Self Contained The Department of Planning Services'staff has reviewed this request and recommends that this request be denied for the following reasons: 1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-180 of the Weld County Code, as follows: A. Methods of disposal of sewage or other wastes in compliance with the requirements of the Colorado Department of Health and the County Department of Public Health and Environment, except for applications for temporary storage of a mobile home under section 23-4-160 below. Evidence shall be submitted from the disposal site that the recreational vehicle is being disposed of on a regular basis. B. Recreational vehicle: a transportation structure or self-propelled vehicle with or without flexible, removable or collapsible walls and partitions designed to be used as a dwelling for travel, recreation or vacation uses. The term recreational vehicle shall include: recreational vehicle, camper bus and travel trailer, but shall not include pickup trucks with camper shells that do not extend above the cab of the truck. For the purpose of this code, a recreational vehicle shall be subject to all requirements and restrictions for mobile homes as provided in this chapter when its placement is intended for nontransient residency.A recreational vehicle shall not be used for tem porary storage,temporary accessoryfarm use,temporary accessory use during a medical hardship, temporary accessory use as an office, or as a principal dwelling unit. The proposed application is for the use of a recreational vehicle to be used for a medical hardship, which is not a use allowed per the Weld County Code.. 2007-3531 Should the Board of County Commissioners approved this request,the Department of Planning Services'staff recommends the following conditions be attached: 1. The recreational vehicle shall maintain current license plates at all times. Failure to do so will result in a violation of a derelict vehicle. 2. The applicant shall submit a detailed plan as to how often dumping will occur for the recreational vehicle to ensure that sewage does not seep onto the ground. 3. The recreational vehicle shall not be occupied by any persons other than those permitted through the medical hardship. Failure to comply will result in revocation to the permit. 4. All zoning permits for mobile homes(recreational vehicle)during a medical hardship are temporary. Such permits shall be subject to review annually on the anniversary of the original permit's issuance. Such permits shall be extended only if the use continues to be in conformance with the criteria set out in Section 23-4-180. Any permit fora medical hardship use shall automatically expire, and the mobile home shall be removed upon cessation of the medical hardship or at any such time as the mobile home is used for other than the permitted use. 5. The applicant shall submit documentation to the Department of Planning Services by November 1st of each year describing the status of the medical hardship. This permit is temporary and shall terminate once the medical hardship ceases to exist, at which time the applicant shall no longer use the recreational vehicle for overnight stay. 6. All temporary permits for mobile homes shall not be transferable by the applicant and/or owner to any successor;the zoning permit shall terminate automatically upon conveyance or lease of the property. The mobile home shall be removed from the property,or a new zoning permit shall be applied for and approved. 7. The property is in violation of Chapter 23 of the Weld County Code (Violation #VI-0700043). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 8. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights of way,or be removed from the property.All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 9. The applicant shall address the following from the Weld County Building Inspection Department by November 28, 2007, to correct the hazardous electrical conditions in the garage, which the recreational vehicle is currently powered by in the garage. Failure to do so will result in a violation and possible revocation of this permit. 10. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 11. Any future structures or uses on site must obtain the appropriate zoning and building permits. 12. Casler Avenue and Henry Street are designated on the Weld County Road Classification Plan as local gravel roads, which require 60 feet each of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. 13. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Section 15-1-10 of the Weld County Code. 14. The applicant shall maintain compliance with Section 23-4-180 of the Weld County Code at all times. VI #0700109 - BEARD: Ms. Siron presented the case report for the record and pursuant to the case file,this property is in violation of Sections 23-3-150,23-3-150.A,23-3-150.6 and 23-3-150.C of the Weld County Code. To bring the property into compliance, the noncommercial junkyard must be restored, removed or screened from all adjacent properties and public rights-of-way. Ms. Siron stated this violation was continued from July 10, 2007,to allow staff adequate time to notify the property owners of the violation hearing date. Ms. Siron is requesting this case be referred back to the Department of Planning Services to allow staff time to work with the property owners to bring said property into compliance. Neither the property owners or a representative was present, and there was no public testimony given. Commissioner Rademacher moved to refer VI#0700109 against Edwin and Helen Beard back to the Department of Planning Services. The motion was seconded by Commissioner Garcia, and it carried unanimously. VI #0700081 -VILLALOBOS: Ms. Siron presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-150, 23-3-150.B and 23-3-150.O of the Weld County Code. To bring the property into compliance, the chickens must be removed and a letter must be submitted stating when this occurs, and the derelict vehicle must be restored or removed. Ms. Siron stated the derelict vehicle has been removed; however, a letter must be submitted regarding removal of the chickens from this site,or an on-site inspection must be made. There has been no contact from the property owners,and staff Is requesting this case be referred to the County Attorney for immediate legal action. Neither the property owners nor a representative was present, and there was no public testimony given. Commissioner Garcia moved to refer VI #0700081 against Jose and Luz Maria Villalobos to the County Attorney for immediate legal action. The motion was seconded by Commissioner Rademacher, and it carried unanimously. ZCV#0701039 -ZAPIEN BROS CONCRETE, INC.: Ms. Salzman presented the case report for the record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30, 23-3-30.1,23-3-40 and 23-3-40.R of the Weld County Code. To bring the property into compliance, the commercial vehicles numbering more than the one (1) allowed, must be removed or appropriately permitted,and the noncommercial junkyard must be restored, removed or screened from all adjacent properties and public rights-of-way. Ms. Salzman requested this case be continued to September 11,2007,to allow staff adequate time to notify the property owners of the violation hearing date. Neither the property owners nor a representative was present, and there was no public testimony given. Commissioner Rademacher moved to continue ZCV#0701039 against Zapien Bros Concrete,Inc. until September 11, 2007, to allow adequate time for staff to notify the property owners of the violation hearing date. The motion was seconded by Commissioner Garcia, and it carried unanimously. Vt#0700043-HOGARTH: Ms. Salzman presented the case report for the record and pursuant to ,,,kthe case file, this property is in violation of Sections 23-3-20, 23-3-20.A, 23-3-30, 23-3-30.F and 23-3-30.1 of the Weld County Code. To bring the property into compliance, the noncommercial Hearing Certification, Zoning Violations August 14, 2007 2007-2538 Page 3 PL0824 junkyard must be screened from all adjacent properties and public rights-of-way,or removed from the property, and the camper trailers must not be occupied or used as a dwelling, they must be removed. (Clerks note: This case was held in the break room at the Department of Planning Services, due to the property owner being unable to get his oversized wheelchair into the Hearing Room.) Ms. Salzman stated there is one remaining camper trailer that must be moved to the screened area on site, and the fence has been reconstructed. The issue of living in the mobile home on the property will have to be addressed with submitting an application for a medical hardship due to the mobile home not being wheelchair accessible. Staff is requesting thirty(30) days to allow adequate time for the property owners to submit a medical hardship application. John and Norma Hogarth stated the mobile home is too small to accommodate the oversized wheelchair and they do not have the funds available to make changes to the structure. The motor home is more accommodating due to shorter walking distances. Commissioner Long stated to Mr.and Ms. Hogarth that the Department of Planning Services will have to deny the application for the Medical Hardship, and then it will be brought before the Board of County Commissioners to address. Ms. Salzman stated the cost of the application is$300.00,and wanted the property owners to be aware of this. Commissioner Long suggested the property owners contact church organizations or other such groups to help with the remodeling or funding to make the mobile home more accommodating. Wendi Inloes, Department of Planning Services,stated there is also a$75.00 fee for a temporary situation, so the entire fee will not be waived. Roger Vigil, Building Inspections, stated he would like to do a visual inspection on the motor home that they are living in to make sure the structure is safe. Commissioner Garica moved to refer VI#0700043 against John and Norma Hogarth to the County Attorney for legal action, with the instruction to delay action upon such referral until September 11, 2007, to allow adequate time for the property owners to move the camper trailer behind the screened area and to submit a Medical Hardship application, with the fee of$300.00 being waived, and to also waive the electrical inspection fee of$44.00, providing the structure is safe to use as a dwelling. The motion was seconded by Commissioner Rademacher,and it carried unanimously. BCV#0701009 -REYES: Peggy Gregory, Department of Planning Services, presented the case report for the record and pursuant to the case file this property is in violation of Section 29-8-40 of the Weld County Code. To bring the property into compliance,all inspections must be completed and the permit to connect the two(2)mobile homes must have a Certificate of Occupancy issued. Ms. Gregory spoke with Benito Reyes on August 8, 2007, to advise the property owners of the violation hearing date. Ms. Gregory is requesting this case be referred to the County Attomey for immediate action due to the second permit having expired,and the extension on the second permit has also expired. Neither the property owners nor a representative was present,and there was no public testimony given. Commissioner Garcia moved to refer BCV#0701009 against Felix and Benita Reyes to the County Attorney for immediate legal action. The motion was seconded by Commissioner Rademacher, and it carried unanimously. If it is determined that the application meets the approval criteria of Chapter 23,Article IV, Division 3,of the Weld County Code,you will be notified that the zoning permit is approved. If the staff determines that the application does not meet the approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a public hearing. In addition to other zoning violations, this violation was initiated due to the presence of a Camper/Trailer- Recreational Vehicle being utilized as a Medical Hardship without the necessary Zoning permit. However, there is a matter of long standing concern regarding this property. There has been a large feral cat colony that has been living and expanding at this property over several years that the Hogarth's used to claim. However, it is now my understanding that they are no longer claming these animals through statements that they have made to Animal Control. These cats are spreading out in to the neighborhood seeking food, shelter, and a place to give birth to their young, and possibly new territory due to crowding. Several residents of Aristocrat surrounding this property including myself have taken it upon us to trap, spay/neuter, and release or adopt out feral cats that have come from unknown locations as well as another neglected colony we believe was on Lamb Avenue and have spread out to our properties. We have spent hundreds of dollars and much time and effort in an attempt to improve the quality of life, decrease the level of disease, and control the breeding of these cats. It has been stated to me that the Hogarth's are moving in to this motor home to allow the cats to have the primary residence to live in which they have destroyed. I do not know if this is accurate. It has also been stated to me that they are in the process of being evicted from their property. I do not know if this is accurate as well. I also have been told that there are 50-60 cats at this location. This raises a concern for us that these cats will be further neglected or possibly abandoned because of the hardship the Hogarth's are going through. Additionally this will place more financial and physical burden on those of us who have worked so hard to try to control or eliminate what ever we can of these feral cat colonies. I personally, with the assistance of a surrounding property owner have trapped, spayed/neutered, released or sent for adoption 12 cats in the last two weeks and over 50 cats in the last seven years. This has been a costly and strenuous effort and we cannot afford to continue to do so. My participation has been primarily from the neglected cats on Lamb Avenue but an adjacent property owner to the Hogarth's has been taking in and participating in spaying/neutering and releasing approximately a half dozen cats per year several times that I know of, which are likely to be from the Hogarth property. We would like to request that Weld County Animal Control become more actively involved in this situation. If the Hogarth's' are no longer claiming or are able to care for their feral cat colony or should this colony be abandoned due to their hardship or eviction these cats need to be removed and relocated to shelters or other foster locations and the appropriate action taken. We would need the assistance of Animal Control to do this as the sheer numbers are beyond our resources to handle or continue to pay for. Thank You, Traci L.
