HomeMy WebLinkAbout20070912.tiff HEARING CERTIFICATION DOCKET NO. 2007-06.B RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1580 FORA HOME BUSINESS(MANUFACTURING STEEL FRAMES FOR STEEL WASHERS) IN THE A (AGRICULTURAL) ZONE DISTRICT -JUSTIN AND ANDREA DAVIS A public hearing was conducted on March 14, 2007, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner William H. Jerke, Pro-Tern - EXCUSED Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jenny VanEgdom Assistant County Attorney, Cyndy Giauque Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 26, 2007, and duly published January 31, 2007, in the Fort Lupton Press, a public hearing was conducted on February 14, 2007, to consider the request of Justin and Andrea Davis for a Site Specific Development Plan and Use by Special Review Permit#1580 for a Home Business (manufacturing steel frames for steel washers) in the A (Agricultural) Zone District. At said hearing, at the request of the applicant, the Board deemed it advisable to continue the matter to March 7, 2007, and again to March 14, 2007, when the applicant could be in attendance. On March 14, 2007, Cyndy Giauque,Assistant County Attorney, made this a matter of record, and advised Justin Davis, applicant, that he has the option of continuing the matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Jerke will listen to the record and make the determining vote. Mr. Davis stated he would like to proceed today. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the site is located south of Weld County Road 136 and east of Weld County Road 99. He stated the application was submitted to the Department of Planning Services to correct a land use violation which was presented to the Board on February 14, 2006. He further stated the Colorado Division of Water Resources originally had concerns regarding the availability of water on the property; however, it has been determined that the well on the site will provide adequate water. Mr. Gathman stated only the family members which live on the site are allowed to utilize the well water, and the business shall not employ any outside employees, as described in Development Standard #16. He stated the nearest surrounding property owner is over one mile away, and he displayed photographs of the site. In response to Commissioner Masden, Mr. Gathman stated the violation process was a result of a complaint submitted to the Department of Planning Services. 2007-0912 PL1870 HEARING CERTIFICATION - JUSTIN AND ANDREA DAVIS (USR#1580) PAGE 2 Char Davis, Department of Public Health and Environment, stated the well has current permits and staff has no objections to the well being utilized for purposes relating to the business. She further stated the residence is served by septic system which is properly permitted. Ms. Davis requested the addition of Development Standard#11,to state:"The applicant shall operate in accordance with the approve Waste Handling Plan," and stated the standard was inadvertently omitted from the Planning Commission Resolution. The Board concurred with the addition of Development Standard #11. In response to Commissioner Garcia, Ms. Davis stated the Waste Handling Plan is also discussed in Condition of Approval#1.C. Responding to Commissioner Masden, Ms. Davis stated the applicant will not be installing another restroom facility, rather, the restrooms within the residence will be utilized. Don Carroll, Department of Public Works, stated the location of the site is east of the Towns of Grover and Hereford, approximately one mile south of Weld County Road 136, and staff does not have traffic counts within the area. He stated he has recently visited the site, and all manufacturing activity takes place within the quonset on the site. He further stated a single family residence is located at the site, and there are no issues associated with parking or access. In response to Chair Long and Commissioner Garcia, Mr. Davis stated the manufacturing process does not utilize water, and he assembles raw materials which are sent elsewhere for further processing, such as painting. Responding to Commissioner Masden, Mr. Davis stated he assembles approximately thirty to forty units per week. He further stated the units are hauled by pickup truck to the City of Cheyenne or the City of Loveland to be shipped out for further processing. No public testimony was offered concerning this matter. In response to Chair Long, Mr. Davis stated he concurs with the Conditions of Approval and Development Standards, as amended. Commissioner Masden moved to approve the application of Justin and Andrea Davis for a Site Specific Development Plan and Use by Special Review Permit #1580 for a Home Business (manufacturing steel frames for steel washers) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included the addition of Development Standard #11, and the necessary renumeration. The motion was seconded by Commissioner Garcia , and it carried unanimously.
