SUBJECT: USR -1593 Prior to the Board of County Commissioners
Conditions of Approval
The applicant has addressed each condition of approval:
1. Prior to scheduling a Board of County Commissioners hearing:
A. The applicant has not delineated any on-site sign(s). If on-site sign(s) are desired the
Department of Planning Services shall be notified in writing. If the applicant does not notify
the Department of Planning Services signs shall adhere to Article IV Division 2 of the Weld
County Code as it related to signs in the A(Agricultural)Zone District. Further,the location of
the sign, if applicable shall be delineated on the USR plat. (Department of Planning

B. The applicant has not indicated that there will be any lighting on site. If lighting is intended a
Lighting Plan, including cut sheets of the intended lights,shall be provided to the Department
of Planning Services for review and approval. The lighting plan shall adhere to the lighting
standards in accordance with Section 23-2-250.B.6.of the Weld County Code. Further,the
approved Lighting Plan shall be delineated on the plat. (Department of Planning Services)
C. The applicant shall either submit to the Weld County Department of Planning Services a copy
of an agreement with the properties mineral owners/operators stipulating that the oil and gas
activities have adequately been incorporated into the design of the site or show evidence that
an adequate attempt has been made to mitigate the concerns of the mineral owners.

D. The applicant shall provide the Weld County Department of Public Works Drainage Division a
site grading and water detention plan for review and approval. This plan shall address the
concerns/requirements outlined in the Department of Public Works referral dated December
13, 2006. Written evidence of approval shall be submitted to the Department of Planning
Services. (Department of Public Works)
E. The applicant shall submit a detailed Landscape/Screening Plan to the Department of
Planning Services for review and approval. The plan shall address the maintenance of the
landscaping and screening, as well as the replacement of dead, dying or decaying plant
materials. Further, given that the site is proposed to have evergreen trees and shrubs
planted in rows staff requests the incorporation of an irrigation system for the establishment
of the proposed plant materials. Staff will require an approved weed management plan and a
reseeding/post construction plan to facilitate soil stabilization and plant material growth. The
updated landscape and screening plan shall address the issue of a landscape and screening
component for the buffer between the outdoor storage component and the adjacent
properties for this proposed facility. The landscaping and/or screening shall fully screen the
facility from rights-of-way and adjacent properties in accordance with Section 23-3-250A.5.B.
and 23-3-250.A.9. of the Weld County Code. (Department of Planning Services)

Lighting Plan
1 .] A single light of approximately 7,000 lumens covering
approximately 16,000 square feet that is designed for
downward directional will be installed.
2.] Lighting will avoid direct illumination of the public right-of-
way, adjacent properties, and public roadways.
3.] lighting will operate only from evening darkness to morning
daylight.
4.] Light will be installed approximately 375' North of property
line adjacent to County Road 68 '/ and approximately 185'
West of property line adjacent to Greeley Number 2 irrigation
canal. Location is directly adjacent to the gated entranceway
into the storage lot. Light will be installed at same time
automated is installed prior to opening business.
5.] No other lighting is planned for the site due to no customers
will be allowed on the site after dark.

The applicant asked that the following condition be moved to a requirement to be met prior to

D The applicant shall provide the Weld County Department of Public Works Drainage Division a
site grading and water detention plan for review and approval. This plan shall address the
concerns/requirements outlined in the Department of Public Works referral dated December
13, 2006. Written evidence of approval shall be submitted to the Department of Planning

As per the memo dated April 16, 2007 from the Department of Public Works it was agreed that this condition

Drainage: Prior to recording the Final Plat and the initiation of activities on the subject site, Weld County
Public Works requires that the applicant provide a drainage report and construction plans acceptable to the
County that is prepared, stamped, and signed by an professional engineer licensed to practice in the State of
Colorado. The drainage facilities proposed in the report and plans shall be fully constructed and accepted by
the County prior to the initiation of the proposed activities on the subject site. No site grading shall be
performed without an approved drainage report and erosion control plan.

1.] The storage lot surface will be surfaces with 2" —4" chipped gravel or road base gravel.
2.] The roadways will be covered with 2" —4" of recycled asphalt.
3.] The storage lot will be surrounded with a 6' chain link fence with 3 barbed wires at the top.
[The chain link fence will be covered with an opaque C95 windscreen which will provide 93%
visual screening on the east side adjacent to the Greeley Number 2 irrigation canal, on the
south side adjacent to Weld Country Road 68 1/2, and on the west side adjacent to the driveway.
4.] The entryway will be located at the northwest corner of the lot adjacent to the driveway and
will have a coded access and a Fire Department Knock box.
5.] There will be an emergency exit located at the southeast corner of the lot adjacent to County
Road 68 'A.
UPON OPENING BUSINESS AND DEPENDANT ON WEATHER, PLANTING AND GROWING
SEASONS
1.] The 12' buffer zone [adjacent to County Road 68 'A to the south, adjacent to the driveway to
the west, and adjacent to the Greeley Number 2 irrigation canal to the east] will have one of
the following;
a. New Mexico Privot bush: 2' -4' when planted 5' apart, 8' tall x 5' spread when
mature after 2 years.
b. Peking Cotoneaster: 2' - 3' when planted 5' apart, 10' tall x 5' spread when mature
after 2 years.
c. Lilac: 2' -4' when planted 8' apart, 15' tall x 8' spread when mature after 2 years.
[Note: Spacing will be based upon recommendations of the nursery.
2.] The buffer zones will be covered with 2" —4" of recycled tree mulch for moisture retention.
3.] All surfaced affected by landscaping installation but are not within the boundaries of storage lot
area will be graded and reseeded to comply aesthetically with surrounding areas.
LANDSCAPE MAINTENANCE PLAN:
CONTINUING ON-GOING ACTIVITY ON A AS-NEEDED BASIS
The owners/operators shall be responsible for the following:

2.] Maintenance, removal, and replacement of decaying, dead and / or dying trees and
bushes.

UPON OPENING BUSINESS AND DEPENDANT ON WEATHER, PLANTING AND GROWING
SEASONS
1.] The 12' buffer zone [adjacent to County Road 68 %to the south, adjacent to the driveway to the
west, and adjacent to the Greeley Number 2 irrigation canal to the east] will have one of the
following;
a. New Mexico Privot bush: 2' - 4' when planted 5' apart, 6' tall x 5' spread when mature
after 2 years.
b. Peking Cotoneaster: 2' - 3' when planted 5' apart, 10' tall x 5' spread when mature after
2 years.
c. Lilac: 2' - 4' when planted 8' apart, 15' tall x 8' spread when mature after 2 years.
[Note: Spacing will be based upon recommendations of the nursery.
2.] The buffer zones will be covered with 2" -4" of recycled tree mulch for moisture retention.
3.] All surfaced affected by landscaping installation but are not within the boundaries of storage lot
area will be graded and reseeded to comply aesthetically with surrounding areas.
LANDSCAPE MAINTENANCE PLAN:
CONTINUING ON-GOING ACTIVITY ON A AS-NEEDED BASIS
1.] Maintenance, grading, and snow removal on the facility.
2.] Maintenance, removal, and replacement of decaying, dead and /or dying trees and bushes.
3.] A professional company will be contracted annually to control weed growth in the storage facility
and fence lines.
IRRIGATION PLAN:

LIGHTING PLAN
1.] A single light of approximately 7,000 lumens covering approximately 16,000 square feet that is
designed for downward directional will be installed.
2.] Lighting will avoid direct illumination of the public right-of-way, adjacent properties, and public
roadways.
3.] Lighting will operate only from evening darkness to morning daylight.
4.] Light will be installed approximately 375' North of property line adjacent to County Road 68 '/2
and approximately 185' West of property line adjacent to Greeley Number 2 irrigation canal.
Location is directly adjacent to the gated entranceway into the storage lot. Light will be
installed at same time automated gate is installed prior to opening business.
5.] No other lighting is planned for the site due to no customers will be allowed on the site after
dark.
SIGNAGE PLAN
1.] At some time in the future if COUNTRYSIDE STORAGE, Inc. decides a sign is needed it shall
be placed approximately 20' West of the driveway and approximately 20' North of property line
adjacent to County Road 68 '/2.
4.] Sign shall be constructed with [2] two 6" x 6" wood support beams and have metal peaked roof
at the top.
3.] Downward directional, low intensity, lighting will be mounted under the roof that will operate only
from evening darkness to morning daylight.
4.] Sign shall be designed and constructed to meet all of Weld County Planning Department's
requirement's and any and all of Weld County Codes.

Greetings, and thank you for considering our Application. We respectfully request your
approval of USR 1593. The purpose of our Application is to provide well-managed, well-
maintained, safe and secure self-storage facilities for Weld County and Windsor area residents. We
have successfully run a similar operation in southern Weld County for many years, and we hope to
bring those same quality services farther north.
We understand that you must consider the Planning Commission's recommendation. In
doing so, we would urge you to review the Minutes of the Planning Commission hearing(February
7. 2007), in addition to the Planning Commission Resolution. Although the Planning Commission
recommends denial,the Planning Commission vote was extremely close(4 to 3),and we believe that
careful re-consideration by you would justify approval of our Application.
In the Planning Commission Minutes,we believe that you will find some confusion between
the merits of our Application(the Planning Commission's impression was generally favorable),and
the reasons for denial (still unclear to us). In short, we believe that the Planning Commission may
have given too much weight to Windsor's Comprehensive Plan, and too little weight to our good
faith attempts to comply with that Plan and meet Weld County's requirements.
You should know that we approached Windsor and its Planning Department on several
occasions, and we even asked for annexation. Despite our inquiries. Windsor apparently does not
wish to annex our property, and we and Windsor both question whether our property is even eligible
for annexation due to lack of"contiguity." At the same time.Windsor wants to limit and restrict the
use of our property, even though in our opinion the proposed use is reasonable and compatible.

Under those circumstances, we believe that this Board may approve our Application if(1)
Windsor does not consent to annex our property or annexation is legally impossible;(2)the proposed
use is compatible with the Weld County Code and Comprehensive Plan; (3) we have attempted to
comply with Windsor's Comprehensive Plan; and (4) we pay the costs of any required public
services or facilities, which we will do.
Our Application meets all of these criteria—we can't annex to Windsor because Windsor
won't consent and it may be legally impossible; and our presentation to you hopefully will
demonstrate how our Application is compatible with Weld County Codes and Windsor's Plan.
Otherwise,we have already agreed to meet all of Weld County's requirements for development,and
will comply in all respects with any conditions of approval.
We were told that our Application was denied by the Planning Commission because it was
inconsistent with Weld County Code Section 22, but the Planning Commission really and truly
struggled with that decision. The reason that our Application was found inconsistent with the Weld
Code was because "the proposed use is located within the Town of Windsor's Urban Growth
Boundary," and therefore must comply with Windsor's Plan.
In short, it appears to us that the Planning Commissioners denied our Application due to
Windsor's Plan, even though we are willing to meet all of Weld County's requirements, and most
if not all of Windsor's similar requirements. It seems strange to us as Weld County residents that
Windsor's Plan should completely defeat our property rights.
Nevertheless,we reviewed Windsor's Plan thoroughly,and we respectfully disagree that our
Application is incompatible. We even researched Windsor's landscaping, screening and buffering
regulations,and are willing to meet those requirements in addition to the County's. We believe that
the most important components included in Windsor's Plan are: (1) the Zoning Map; (2) the
Transportation Map; and(3)the Land Use Map. Our Application is consistent with all but the last.
For example,when you look at the Zoning Map of nearby existing uses in Windsor,you will
see that the closest surrounding Windsor zone districts to our property are(1) I-H Heavy Industrial
to the south (this are the existing gravel mining operations, which are extensive); (2) RMU
Residential Mixed Use to the east(this is commercial zoning on our same street 1/4 mile away);and
(3) GC-PUD General Commercial to the southeast. There is also a commercial dairy operation on
our same street(over 600 head), and other commercial uses nearby as we will explain. Under those
circumstances, our limited commercial use on the corner is compatible.
When you look at the Transportation Map, you will see that our property is located at the
—� intersection of Road 13 and Jacoby Road(Road 68.5). Both of these Roads are planned by Windsor
as major arterial streets—Jacoby Road as an"Urban Major Collector" and"Arterial Entryway" (80

feet of right-of-way) and Road 13 as a"Rural Minor Arterial"(130 feet of right-of-way). Since our
property is at the intersection of these two major roads,we believe that traffic is not an issue and is
already planned-for(our business generates little additional traffic anyway). Again, such an area is
compatible with commercial use.
There are many other goals and policies of Windsor's Plan that our commercial proposal
meets(Windsor says it should"encourage, improve and expand" commercial uses),but in the end,
Windsor's Plan states that it is only a"guideline"and a"planning tool"representing the"hopes and
dreams" for the area.
We also have hopes and dreams for our property, and would thank you for carefully
considering our Application and granting approval. Thank you very much.
