The issuance of this permit does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. Water from this well shall not be used for lawn or landscape Irrigation or for any other purpose outside the business building structure. 5) The pumping rate of this well shall not exceed 15 GPM. 6) The annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot(108,600 gallons). 7) Approved as the only well on a tract of land of 25.00 acre(s)described as a portion of the SE 1/4 of Section 5,Township 11 North, Rnage 66 West of the 6th PM,Weld County, reference attached exhibit"A". 8) The return flow from the use of this well must be through an individual waste water disposal system of the non-evaporative type where the water is returned to the same stream system in which the well is located. 9) A totalizing flow meter must be installed on this well and maintained in good working order. That Poudre Valley is acquiring in fee simple absolute a parcel of land described in Exhibit A attached hereto. Poudre Valley requires the property described in Exhibit A for construction and operation of an electric substation, 3. Thar Poudre Valley is also acquiring an access and utility easement to the substation as described in Exhibit B attached hereto. The Terms of Access and Utility Easement attached as Exhibit C shell govern the parties' respective rights and ohlig::tionc under the easement. 4. That along with the Petition in Condemnation Poudre Valley filed a Motion for Immediate Possession; however the Court did not take action on the Motion. 5. That the Respondent Donald Mueller, as Treasurer of Weld County Colorado, was served with pleadings on October 20, 2006 and tiled his Disclaimer dated October 24, 2006 6. A. USE OF EASEMENT BY PETITIONER. The right to use the Easement shall belong to Petitioner and its directors, members,officers, agents, employees, designees, contractors, guests and invitees,stmcessors or assigns, and all those acting by or on their behalf lbr the following purposes: I tltillilL5.To install, construct,reconstruct, relocate, maintain, enlarge, repair, use, operate and remove any and all electric utility or telecommunication lines, including, cable 7'V, telephone, fiber optic lines, and other communication facilities lines, pipes, casings, wires, conduit, poles, towers, and any other appurtenances necessary for electric utility and telecommunication lines or other improvements owned or operated by Petitioner, 2 Access. To have a right of entry and access in, to, through,on, over, tinder. and across the Easement at any and all times deemed necessary by Petitioner for ingress to and egress from an electric substation to be constructed on the property described in Exhibit A and for all purposes necessary and at all times convenient and necessaty to exercise the rights acquired in the Easement. The Petitioner shall construct a temporary access road within Melasement as necessary to conduct construction operations traflic between the electric substation and U.S, Highway 85, and will install culverts and drainage (bell tics under the access road as necessary. Petitioner may use any permanent access road constructed by Landowner on the property for access to its electric substation. 3 'Term ganse iy1t. This Easement shall remain in force and effect for so long as an electric substation is maintained and operated by die Petitioner on property described in Exhibit A. 4 Assienabilitv. During the term of this Easement; (a) Petitioner shall construct any electric utility or telecommunication lines within the Easement to specilications required by federal, state and local regulation; (b) Petitioner will at all times maintain any fences, electric utility and telecommunication lines in proper condition and repair all damages thereto at its own expense. With Landowner's written consent, which shall not unreasonably withheld, the terms of this Easement may be modified from time to time with additional consideration to comply with any future modification to federal, slate and local laws, rules, regulations, orders or other requirements; (h) Petitioner shall give Landowner prompt notice of any of the following occurrences arising with regard to the Properly or Petitioner's activities thereon; i. Any spill, release, contamina!ion or other occurrence dint constitute a violation of the provisions of any applicable laws, rules or regulations or this Easement;and ii. Any notices, claims or allegations of environmental violations or contamination received from any federal, state or local governmental agency or authority or the filing or commencement of any judicial or administrative proceeding by any such agency. Petitioner shall further indemnity, defbnd and hold Landowner harmless from and against any and all damages, claims, demands, causes of action, actions, losses, liabilities, fines, costs, and expenses (including without limitation reasonable attorneys' fees and expenses and costs of investigation or trial) arising out of damage to livestock, property or injury to or death of Landowner's employees or any other person or party, where such injury, death or damage occurs as a result at the Petitioner's negligent operations under this Basement; �) Petitioner shall indemnity and hold Landowner harmless from and against any and all claims and liens upon the Easement for labor or materials furnished to Petitioner; (k) Petitioner shaft be liable to Landowner for nay and all actual damages or physical injuries arising out or or relating_ to the actions of any agent, employee, contractor, subcontractor, guest or invitee resulting from the negligent actions or omissions ofthe Petitioner; (I) All operations hereunder shall be conducted by Petitioner in a fair and reasonable manner, and all necessary precautions shall be taken to avoid damage to roads, gates, culverts, cattle guards, turd fences. All damage to the above-named facilities shall be reported to Landowner within twenty- four (24) hours and shall he repaired by Petitioner within a reasonable period of time, as nearly as practicable to the condition existing prior to such operations. Any public hazard, such as a damaged bridge or culvert, caused by Petitioner's use of the Easement, shall be marked or barricaded and proper steps taken for the repair thereof by Petitioner; (m) Petitioner shall maintain with financially sound and reputable insurance companies or associations, insurance in an amount that a reasonable, prudent operator would deem sufficient to satisfy all damage and indemnity claims that may arise hereunder. Petitioner shall provide ill Landowner from time to time, at Landowner's request, evidence of maintenance of any required insurance, 7 Taxes. Landowner shall pay all county taxes assessed against the Property based on the present valuation thereof. Petitioner shall pay all county taxes, if any, assessed against the Property because of additional value placed thereon for lax assessment purposes by reason of improvements placed upon the Property by Petitioner, and Petitioner shall, within thirty (30) days after written notice From Landowner, reimburse Landowner for Petitioner's share thereof. 8 Specific Enforcement.
