In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the Commercial Zone District until a Site Plan Review has been approved by the Department of Planning Services. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,C.R.S., as amended. (Department of Public Health and Environment) E. The applicant shall operate in accordance with the approved "waste handling plan". (Department of Public Health and Environment) F. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, as delineated in 25-12-103, Colorado Revised Statutes, as amended. The facility shall be operated in accordance with the approved dust abatement plan at all times. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code. (Department of Public Health and Environment) L. The facility shall utilize a properly permitted well or public water supply (Central Weld County Water District). If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Department of Public Health and Environment) N. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. (Department of Public Health and Environment) O. The applicant must take into consideration storm water quantity capture and provide accordingly for best management practices. (Department of Public Works) . P. All structures, including signs, on site must obtain the appropriate building permits. (Department of Planning Services) Q. Effective January 1, 2003, Building Permits will be required to adhere to the fee structure of the Weld County Road Impact Program. (Ordinance 2002-11) (Department of Planning Services) R. Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) S. Exterior illumination of structures and lots shall be restricted as follows: 1) Sources of light shall be shielded so that beams of light will not shine directly onto adjacent properties. 2) Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. T. A building permit shall be obtained prior to the construction of any building. A plan review is required for each building for which a building permit is required. Commercial building plans shall bear the wet stamp of a Colorado registered architect or engineer and be accompanied with a completed Code Analysis Data sheet. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Based on the Site Plan Review Application the proposed building will have multiple occupancy classifications including B, and S1. Fire resistance of walls and openings, sprinkler requirements, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Weld County Code. (Department of Building Inspection) X. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. If there is an existing septic system located on the site,the applicant shall include in the application a copy of the septic permit. This information can be obtained from the Department of Public Health and Environment. Sewage disposal will be by Engineered Septic System as drawn by High Plains Engineering and approved by Weld County Health Department. Requirements of 15% of the total lot have been met as per landscape plan and all necessary setback requirements have been met. Other than frees and bushes, all landscaping to be xeroscaped and plantings to be watered via drip system. Because of the design of the landscaping, it should require minimal care. Dead plantings will be replaced annually and the area cleaned at least monthly. Drip system will be checked periodically during summer months to maintain its efficiency and lines blown out in the fall to assure that it does not freeze. N. Site at 23275 U.S. Highway 85, La Salle, Colorado Dear Mr. Pier, We performed a site observation and percolation test on the above referenced site on August 27, 2007, as it relates to the site drainage. In addition, we have performed calculations regarding the necessary storm water retention requirements that would be required for this site. The following are our observations and opinions. The site is South of La Salle, Colorado on U.S. Highway 85. The site consists of approximately 12 acres of sparsely vegetated land with a 4,800 square foot building (0.11 Acres) in the Southeast corner. The site is located in the Southwest Quarter of Section 6, Township 4 North, Range 65 West of the 6•`" P.M., and is bounded on the North by the Union Pacific Railroad tracks and the East by U.S. Highway 85, and open fields to the South and the West. The site is relatively flat with slopes running in a Northeasterly direction of approximately 2% to 3%. The site has a natural detention pond at the Northeast corner of the site. The railroad tracks to the North are approximately 5 feet above the site at an elevation of 4,690± and the highway to the East is approximately 20 feet above the site at an elevation of 4,715±. At the time of the observation, top soil removal and minor leveling excavation had occurred with the bottom of the excavation at 4,682±. The percolation tests were taken in the bottom of this excavation. The site is unique since historically it has never had an outfall for storm water other than the percolation of the storm water into the soil. Thus, the site has had a retention pond historically. The owner indicated that on rare occasions he has seen water standing in this corner, and that the water stood for only a few hours at the most. The soil profile performed at the time of the percolation tests indicated that the soils on site consisted of a loose silty sand. The percolation rate was found to be 10 minutes/inch. Therefore, the observations substantiate that this soil type would be a quickly percolating soil type. The percolation rate is in fact the pond discharge rate. The 10 minutes/inch equates to 600 seconds/inch. The area of the detention pond is a minimum of 150 feet by 150 feet, which equals 22,500 square feet. An inch equates to 0.083 feet. Therefore, with the percolation rate of 600 seconds/inch, if the storm water percolates an inch over the 22,500 square foot bottom this would equate to 1,867.5 cubic feet and would take 600 seconds. Thus, the discharge rate would be 1,867.5 cubic feet/600 seconds equals 3.11 cubic feet/second (cfs). Land mark Mr.Jay Pier Project No. PIERJA-7H5E-01-321 September 17, 2007 Page 2 of 3 In analyzing the drainage patterns for this site, the standard runoff coefficients "C" and the percolation rate will be used to determine the proposed size of the pond and it's associated safety factors. Since a majority of the site is open and the soils are loose the standard 100-year runoff coefficient of 0.20 can be used for "sandy soil lawns". It is our belief that this is conservative since the site is sparsely vegetated. The standard 100-year runoff coefficient of 0.90 can be used for the building "roofs". The weighted runoff coefficient "C" is ((0.90) x(0.I !acres) + (0.20)x( I.89acres))/12 acres = 0.21. Using this number in the "Mass Balance" calculation attached for a 100-year storm intensity for 12 acres with a discharge rate of 3.11 cfs gives a storage volume required of 0.32 acre feet. An extremely conservative "C" factor would be to double the 0.21 to 0.42. In this case the required storage volume would only be 0.87 acre feet. The area for the retention pond is approximately ISO feet by 150 feet or 22,500 square feet as mentioned above. This in turn equates to approximately 0.52 acres. With a required storage volume of 0.32 acre feet, the required depth of the pond is 0.32 acre feet/0.52 acre, which equals 0.615 feet or 7.38 inches. The proposed pond is to be 4 to 5 feet deep (48 to 60 inches). Thus a safety factor of 6.5 to over 8 foot exists. If we were to use the conservative 0.87 acre feet requirement, the required pond depth would calculate to 0.87 acre feet/0.52 acre, which equals 1.67 feet or 20 inches. At 4 to 5 foot depth this is still a safety factor of 2.4 to 3. Typical requirements for a retention pond is to provide twice the calculated 100-year storm storage capacity. The safety factors listed above far exceed this requirement. These calculations have assumed the retention pond area is the only area that is percolating. However, with the entire site consisting of the same overburden, the entire site in fact has a similar percolation rate and would dissipate storm water. This would account for the owner's statement regarding how rare it is to have seen water in this area and that it did not remain there long. There is some offsite water that may pass through this site to this retention pond. However, there are roads with barrow ditches and raised irrigation banks upstream of this site to the South and West. Again the topography of the area is at a 2% to 3% slope, therefore, little if any offsite storm water will likely make it to the retention pond. The onsite buildings finish floor elevation is above the 4,691 elevation. Storm water would overtop the Union Pacific Railroad at a 4,690 elevation. Therefore, there is at least one foot of free board above this emergency spill elevation. This should be an adequate safety factor to protect the building in a 100-year storm event. I have also provided a copy of the "Mass Balance" calculation for the 100-year storm event for the 12 acre site with the calculated discharge rate of 3.13 cfs. Additional incidental information has been attached as reference for the assumptions and calculations made to come up with our conclusions and opinions. In conclusion, it is my professional opinion that this site will continue to function as it has historically with the percolation being the storm water discharge from this site. This site is a relatively small flat site. The enhancements made to the retention pond area will increase the calculated storage capacity and increase the safety factor. In addition, there is free board from the finish floor of the structure on site to the emergency spill elevation. Therefore, it is my professional opinion that this site has very adequate storm water retention capacity and that the public safety or property should not be threatened by a 100-year storm event. Only the bottom of the pond will allow percolation of the stored water. Using the value 0.000139 cfs/ft2 (shown in the appendix) the pond release rate is 3.73 cfs. • The current and historical runoff from OS-1 is calculated to be 46.48 cfs for the 100-year storm event. The retention pond is designed to store 100% of the offsite runoff over a 24-hour period of the 100-year storm. Calculations to determine the required storage volume to retain OS-1 flows use a release rate of 3.73 cfs applied to sub-basin OS-1 result in a rate of 0.074 cfs/acre. The 0.074 cfs/acre is then input into the urban drainage detention spreadsheets (see appendix) resulting in a total storage requirement of 2.82 acre-ft (122,639 cf). • The storage volume required for the onsite basin, DR-1 is calculated using the existing percolation rates for a release rate on the pond bottom. The retention pond is designed to store 150% of the onsite runoff over a 24-hour period of the 100- year storm. Calculations to determine the required storage volume to retain OS-1 flows use a release rate of 3.73 cfs applied to sub-basin DR-1 result in a rate of 0.312 cfs/acre. The 0.312 cfs/acre is then input into the urban drainage detention spreadsheets (see appendix) resulting in a total storage requirement of 1 .12 acre-ft (48,989 cf). All proposed gravel areas within the site are considered to be impervious to provide an additional factor of safety. • It was assumed that 25% of the proposed site would become impervious in future development in all onsite runoff calculations. • Totaling the required storage volumes of 2.82 and 1 .12 acre-ft for sub-basins OS-1 and DR-1 , respectively, results a combined storage volume of 3.94 acre-ft. • The total time required to drain the retention pond through the existing percolation rate of 3.73 cfs is less than 47 hours. It is assumed that OS-1 flows will take 36 hours to drain and the DR-1 flows will take 10.33 hours to drain for combined time of 46.33 hours which is less than the maximum of 72 hours stated in the Weld County Storm Drainage Criteria. All calculations are in the appendix of this report. The retention pond water surface during the 100-year storm event is below 4684.0. Comments External Roads: The external roadways are capable of handling anticipated traffic from the proposed facility. Weld County Road Classification Plan (FHU): (June 2002) WCR 48 is a paved local and requires a 60-foot right-of-way at full build out. This road is maintained by Weld County. Taking a quick look at it, what stands out the most would be if the drainage wasn't maintained and fine sediment settles in the pond over time decreasing infiltration rates allowing water to pool and raising the groundwater level in the area that would effect the embankment stability. If the water continuously drains as quickly as the report states, I don't believe there will be an issue; however, I'm not betting it will. Also, since the site is undeveloped, water can infiltrate over a large area. If the area is paved or compacted, runoff will be concentrated in the pond increasing the chances of silting up the basin. I did some quick, rough computer modeling with the limited drilling info and the topo you sent so don't try and go to court with it or anything :). I started out by using the topo map to calibrate the model since the current configuration is stable. According to the plans, the pond is supposed to be a 3:1, but the topo lines are more 1.8:1. I used an embankment slope of 1.5:1 based on our conversation and the photos you sent. I also used the silty sand reported in the borelog for the pond and the embankment to be conservative. Using the 1.8:1/1.5:1 situation the embankment is stable (FS >1.0)with a FS of 1.1;we strive for 1.3. However, if the pond silts up and holds water up to 4 feet deep for a long period of time raising the groundwater the FS decreases by 18%to failure. I went ahead and modeled the proposed pond slope of 3:1 and it was similar to the 1.8:1 slope. The only difference is the water depth can be raised to 6 feet before a failure may occur. So, what does all this mean? If the pond is sloped at 3:1 as planned and drainage is truly 10in/min and remains constant with maintenance, there doesn't appear to be any significant issues to the highway. As the slopes get steeper and if drainage rates decrease causing pooling and effecting groundwater levels, the risk of the embankment and effects to US 85 increase. I don't have any knowledge of a retention pond causing embankment problems so close to a road. Hopefully this helps. I spoke with Mark yesterday regarding this site -basically there is a natural depression in the topography adjacent to CDOT ROW, and the site developer wants to turn this into a "retention basin"which will accept all runoff from their site. They did some boring tests and determined a 10 min/in infiltration rate through sandy soils at the basin. Their assertion, then, is that the water will infiltrate quickly enough so that there will not be standing water in the basin past 24 hours or so. They have not included an emergency outfall for the basin, as their design is entirely based on this quick infiltration rate within the basin. I have attached their boring tests, proposed basin topography, etc. I was wondering if you could give this a once- over and see if their data looks reasonable from a geotech standpoint? Weld County was hesitant to approve the plans until CDOT is satisfied that a retention basin so close to US 85 would not jeopardize the embankment. If the landowner did not maintain this basin, I could see it possibly getting clogged down the line - have you ever seen an embankment threatened by a retention pond in such close proximity? I'm mainly just looking for"red flags" that jump out at you, from a hydraulics perspective their design is probably ok assuming that the infiltration rate is indeed correct.
